UNITED NATIONS - U.N. Secretary-General Kofi Annan (news - web sites) expressed hope that Saddam Hussein (news - web sites)'s capture will accelerate the establishment of a transitional government in Iraq (news - web sites), but he said the United Nations (news - web sites) could not support bringing the former dictator before a tribunal that might sentence him to death.

U.S. has got to make compromises to get the ball rolling.  

Besides, there are alot of things worse than being executed, even in 'civilized' prisons:  Solitude confinment, half rations, etc.

Do we really want to hand Iraq over to the League of Nation, oops the UN - although its been so retarded the last 2 decades it sure has the tailings of the League.

I have no problem with bringing other countries in to help with the formation of a govt, repair and refit of basic services, etc - but I do have a serious problem with the UN leading anything given their record at standing by in war zones and letting non-com's get killed. (i.e. Yugoslavia, Kosovo, Albania)

This is what I disagree with.
I don't care what or who does the tribunal just as long as the death penenalty stays on the table.

I think it would be hard for a representative of the UN to take any other view.

The International Covenant on Civil and Political Rights (drafted in 1966) provides:

2. In countries which have not abolished the death penalty, sentence of death may be imposed only for the most serious crimes in accordance with the law in force at the time of the commission of the crime ....

3. When deprivation of life constitutes the crime of genocide, it is understood that nothing in this article shall authorize any State Party to the present Covenant to derogate in any way from any obligation assumed under the provisions of the Convention on the Prevention and Punishment of the Crime of Genocide.

But the UN has a stated objective of abolishment of the death penalty so there was a Second Optional Protocol to the International Covenant on Civil and Political Rights which states could ratify if they agreed that they would not apply the death penalty.
