I've had some weird moments that i'm not sure what to make of. It would randomly drop to desktop without warning. This with DX 9.0b - anyone had this issue?

I get those with my laptop (3.4HT proc, 1GB RAM and 9700video) but not with my desktop (XP2100+, 1GB RAM, and 9800 pro). I'm convinced it is the mobile video card in my case.

Get your latest video drivers, and of course 9.0c.

I was able to CTD using old old ATI drivers (cat 4.2's) no problems with 4.6 or 4.9 though.
