I like him too, but here it's 0.08 where they can bust you.  Not sure if they have to, but there's a mandatory low limit where it's automatic.  Police have to, it ain't like the old days where you have a chance to not be arrested because the cop is a good guy and offers options, for example call someone sober to come get you and drive you and the car home.

Some of the best and widely played publicity with movie stars and one that seems to be the IN thing to do to get publicity is checking into a drug rehab.

So far as totally whacked out behavior and drug and booze addiction and even dui driving or... even whacked out fights with cops....  this is pretty commonplace for actors...

It is pretty uncommon for them to admit it right away and to actually apologize without some kind of blame game.

contrast that with the behavior and fight with cops of a certain black female congressman and the kennedy driving through the white house anti terrorist barriers drunk as a skunk,

In both cases... it was somebody elses fault until they were absolutely cornerered much later.

I take it you've never lost anyone to a drunk driver.  Not only have I had friends killed by drunk drivers, but a drunk driver hit me from behind 8 years ago while I was stopped at a red light on my motorcycle.  Every day, I can still feel the injury.

A cop who lets a drunk driver go is no "good guy".

I'm sorry for your loss Chairboy.  Mel Gibson could have been in an accident if the police hadn't pulled him over and it's good the way things turned out.  Guess the point I was trying to make is Gibson put himself in the situation, and might have been treated better if he hadn't acted like someone who shouldn't be driving at the time.  The policeman was civil to Mel and he blew it.

FWIW, the idea that you can't be busted for DUI with less than a .10 or a .08 is bogus. Those particular stats are not the be all and end all of DUI. Those are just legal presumptions of intoxications and do not take into account other factors such as additional intoxicants like drugs. The law justr says that you will be legally considred intoxicated at that BA. The breath test ONLY tests for the presence of alcohol and nothing else. That's why blood tests are done in cases where some other kind of substance is suspected.

The law is written that you can be found guilty of dui (driving under the INFLUENCE not intoxication) if your driving ability is impaired to the SLIGHTEST degree. Not impaired to the max, the slightest degree. It does not take a .10 or .08 to get there. I arrested one female who was falling down (litterely fell down getting out of the cab of her PU) drunk and she blew a .04. She could not complete a single sobriety test to save her life. She admitted to a single glass of wine and that she had never had any alcohol before, but you have to take answers like that with a grain of salt. The most common answer to how much have you had to drink is "2 beers / drinks". The BA she had and her weight was consistent with a single glass of wine. She apparently had no tollerance for it.

Intoxication does not mean only alcohol or illegal drugs but encompasses prescription drugs taken properly under care. There are notes on many of themn saying don't drive or operate machinery. If you do and it impairs you, welcome to the drunk tank waiting for your ride. Prescription drugs are not an excuse any more than it would be a protection from getting into a collision and hurting someone. You can't take it back after you smashed your vehicle into something or someone else.
