Was gonna say that looks like a Diamondback Watersnake. they are protected in most states. They are Endangered, so good luck to some of you who would kill it, instead of relocating it. Don't get caught.
Cool pic, although that takes balls to hold that snake like that. I did it once as a kid and I still have the teeth scars on my right hand.
