I'm just playing devil's advocate here.  Did he just get handed the pilots manual and told to adhere to it?  Or did he physically get a check ride, etc to make sure he was clear on the basic operating parameters?

The point I'm trying to make is at what point can he just shrug and say "Well nobody told me" and there's no documentation to prove otherwise?

I'm really sorry to hear about all the damage done to your airplane.

I gave him what amounted to a 7 hour checkrude between the plane and 10 page checkout sheet. The stuff on power settings was dpevigic in the checkout - such as max continous power above 85% is forbidden because of the following factors...

He signed it, then he ignored it. So if I gotta sue him I've got plenty to go on. During the interrorigation he tried to cop out by saying " if the engine is that sensative you shouldn't have it online. 2 other instructors brought up the point that in 600 hours of operation this year there has never been an instance to show up of engine abuse by other renters until he showed up. And the oil analysis bears that fact out.

Ok, so he obviously knew and opted to ignore the guidelines.

Does this guy actually have the resources to cover the damage?

I'd be curious how the other aircraft he's rented are doing now.
