It is not necessarily a lie. The reporting method is what we cannot gaurantee. For example, some drivers report the usage with the textures in thier onboard compressed format while not repoting how much memory is being used after the textures are uncompressed to be used.
There is no standard for reporting memory used on a video card. Is it the frame buffer space? Is the texture space? Is it vertex space? No one but the manufacturer knows for sure.
And as NVidia or AMD might actually look at the game for issues from time to time, it is beneficial to them.
