St Clair County is trying to close the "Caseyville Rifle and Pistol Club", but has lost twice and been ordered to pay ~$80 in legal fees to the Gun Club.  Now it seems they are going to try to use "eminent domain" laws (again) to close the club.  Is anyone here familiar with the Illinois Eminent Domain laws that would explain how a county could justify using eminent domain to close a modern up-to-date Gun Club that has been determined by a judge not to cause a public or tranportation danger?

It just seems strange that a county would use so much time and money to close a club like this.  Other than "anti-gun" reasons, why would a county government be so determined to close the club?

THEY'll say that it's for the benefit of the greater portion of the community. eminent domain laws are really scary, as there's so much grey area for them to maneuver around with.

I saw nothing in the article indicating that Scott AFB has ever had an aircraft struck by gunfire from the ground. That being the case, this sure seems to be politically motivated, and not an issue of aircraft safety.

Maybe HTC should give the judge a free hour in an Ostie and let him see if he can actually hit an airplane on purpose.

Well, the issue with Eminent Domain laws is that the county can make up anuthing to enfore it.  The the only way i know to get around it, if they have a large track land, is put some of that in a conservation essment.  With that, it should protect the land from any development outside of the ownership.

sounds to me like the owner, or one of the club members pissed off the wrong person.

it it were actually a safet hazard to the air force, i think they'd have already been on this.......they don't need the likes of a county lawyer to handle their problems.

 the club should counter-sue(i hate saying that too) and include all of their legal fees, and any fees whatsoever that are related to this issue. bet the county backs off then.

CAP1 makes a good point, if the gun club had actually gotten crossways with the Air Force, they wouldn't be dealing with some piss-ant county lawyer, but with the Federal government.
