MS who so easily sues others for imagined patent violations now got bitten back. Poetic irony.

The XML editor was engineered from one that was released as an add-in for Word by another company.

So what's going to end up happening is Microsoft is probably just going to shell out a back-dated "license fee" to use it and not change a thing.
Ron White says you can't fix stupid. I beg to differ. Stupid will usually sort itself out, it's just a matter of making sure you're not close enough to become collateral damage.

You think Microsoft is going to let a little thing like a federal court stand in their way?  Pft.
Do not attribute to malice what can be easily explained by incompetence, fear, ignorance or stupidity, because there are millions more garden variety idiots walking around in the world than there are blackhearted Machiavellis.

Microsoft is going to use their perk points and buy controlling stock in that little company.
