The person that gets the kill, is the person who's done the most damage up until the point the vehicle/aircraft suffers a catastrophic failure.
and that is the proble as i see it... If you are the one who literally "shoots down" the plane i believe you should get the kill. now i know this would increase the "YOU STOLE MY KILL YOU ***" factor but i think thats the way it should be <S>
