I agree 100% to this, but I am sure the law isnt.  thats kind of like brake checking a tractor trailer truck with a prius, DONT DO IT!  the end result will be BAD  :lol   :aok :rofl

Nah, following to close and creating an accident are pretty clear .... stems from all of the California insurance fraud jazz in the 70s and 80s.

on a serious note, you can sit back and play what if after the fact.  what if he had a gun and the bikers also had theirs?  what if they had taken the gun away from him and shot him with it,  what if...  there's lots of what ifs.  I'd like to think that he would have pulled out his gun and they bikers would have left him alone but what if they hadnt?

I always have one next to me when I play as i always use a headset.  but what if I had a CHL and that day when I stopped at the 7-11 to buy a beer after work at 2 pm and the cop that thought I looked suspicious enough to put his hand in his gun.  what if he had seen it...

what if several people in that dark theater would have had a gun, how many more would have died?  or perhaps only the shooter would have been killed after only firing a couple of guns.

we all can play what if's all day long, but the truth is that you cannot undo what has already been done.

I grew up with real bikers, outlaw bikers. Specifically the outlaws and Black widows in Florida. You run into supporters mostly, people who want to be associated, that are the biggest assclowns you will ever meet. "Oh I know this guy blah blah". I know the chapter president and treasurer, hell they even talked me into buying an old 1978 harley fatboy to fix up. Problem is however, I was college educated and when I seen 5 bikers die in my area (accidents mostly) I gave up the project and sold it off.
Here the real bikers get associates and supporters to do the work, young guns who have something to prove because they are dumb enough to do it because they want to be associated. The old school outlaws are all in prison, most have life sentences.
What this video shows (and its not the first time trust me, I know the new york group, it pops up on motorcycle pages now and then) they have done this bullying tactic 2-3 times. Young punks just trying to feel invisible and bullying.

/I never associated, but fact is I never felt safer then in a biker bar - long as you say yes sir and no sir they never bother you. Call someone an "old timer" or "grandpa" you are liable to have your bellybutton beat when you goto the bathroom.
//Not a supporter either, its just heavily influenced in my area because Gangs took over the area long ago, and then the Bikers moved in to clear them out the 4 bars on my road are all outlaw motorcycle bars, with a supporter club house somewhere in the area as well

"Invincible" on a Dirt Bike as a few of those turd burglars?   :rofl    It is a shame that the victim in the Range Rover didn't realize his vehicles full potential and NEVER should have stopped until the 5.0 were right there with him.

Speed-Bump-Boy's family have apparently retained Gloria Allred, what a perfect match for the little snake. I take it there's juries in civil trials in NY? "No, ladies and gentlemen of the jury, my client was not involved in an unlawful confinement and a vicious attack on a family, he was checking on another rider who was, um, uninjured and was, um staying in his saddle to um, better facilitate the checking and, um, stayed in the saddle to um, restrain the, um, non-vicious attack on the, um, family in the SUV who are, um, like, rich and stuff, unlike my client who, um, is, ah, um..."

NY is a pure comparative state.  The biker is going to get paid something.  They only need to show that the SUV driver was even 1% negligent for the biker to recover that 1%. 

Here's a quote from a website run by an injury lawyer that explains it pretty well:

Presently, thirteen (13) states follow a pure comparative negligence system:  Alaska, Arizona, California, Florida, Kentucky, Louisiana, Mississippi, Missouri, New Mexico, New York, Rhode Island, South Dakota, and Washington.  In a pure comparative negligence system, a judge or jury assigns a percentage of fault to each responsible party and then apportions the damage award accordingly.  Using this system, an injured person may recover his or her damages even if the injured person was 99% at fault in causing the injury, with those damages reduced by his or her portion of the fault.  For example, in a car accident between Dave and Debbie where Debbie was found to be 99% responsible, and the jury found that Debbie suffered $10,000 in damages, that award would be reduced by Debbie’s 99% fault in causing the injury.  In the end, Dave would only have to pay 1% of Debbie’s damages, or $100 in this case.

The only question here is if the SUV driver bought his policy from a decent, reputable insurance company that will actually pay  the biker instead of trying to wriggle out of it for "intentional act" on the part of the SUV driver.  As ridiculous as it sounds I could see some companies try to do that.  They'll certainly have to defend the driver, but they might try to avoid paying any indemnity.  He certainly has assets so hopefully he paid up for a good company.

Thanks for that, very informative. Is the system set so that the % responsibility is set by judge only, or is there some form of jury system which the defendant (or plaintiff?) can demand?
