Do we "have" to have the UDP switch?

Fariz, the UDP/TCP switch has always been there, HTC just tweaked it as there were a few slipping through the cracks. If it happens a lot it means you have a dodgey connection, and may well have been one of those invisible planes :)

What I wonder, if it is possible for system to detect if connect is ok now, and after some time switch back to UDP again? If it is impossible during flight, may be it is possible to do on runway, during refuel?

I think HT said once  they are sent UDP but with a confirmation within the game for re-transmission if necessary. Although I do recall him saying it was still possible for the gun packets to get lost in extreme circumstances.
