BECKLEY, W.Va. - On Friday a federal judge sentenced the people behind an adult Website that sold defecation and urination videos and DVDs to jail terms, ending one of the first federal obscenity cases involving the Internet.
Michael J Corbett and his ex-wife Sharon Bates, who were married when running the site in question, had pled guilty to one count each of mailing obscene material in August.
The Associated Press reports that U.S. District Judge David Faber on Friday sentenced Corbett to 18 months in prison, a $30,000 fine and three years of supervised release. Bates was sentenced to 13 months in prison, a $10,000 fine and three years of probation.
The couple had run the Website GirlsPooping.com, where they sold titles such as Outdoor Pooping Paradise, which showed ten women defecating outdoors, and an enema tape called Simone’s Daddy’s Little Girl.
The Corbett’s had earned $70,000 in three months, shipping out six to 30 orders a day through the U.S. mail. GirlsPooping.com offered 53 titles.
United States Postal Service Inspectors were responsible for investigating Girlspooping.com, starting in January of this year. By March, they had enough information to obtain an indictment from a federal grand jury against everyone involved with the site.
Faber also sentenced the Webmasters for the site, Joseph Tanner and Randall Rogers, who maintained the site through their company Tdigital Services, Inc. The company shared in the profits of the Website.
Tanner will spend 13 months in prison and pay a $20,000 fine, while Rogers was sentenced to three years' probation.
Each of the charges could have led to five years in prison and fines up to $250,000.
According to the Associated Press, Faber cited both Rogers' minor role in the crime and a physical condition that confines him to a wheelchair as reasons for his lesser sentence.
Tanner and Rogers each pleaded guilty to one count of conspiracy to mail obscene material and conspiracy to use the Internet for the purpose of sale and distribution of obscene material.
The Corbett and Bates had previously forfeited $15,010 seized from their bank accounts, the domain name associated with their website, and all obscene materials and equipment used to produce or manufacture obscene materials. They also agreed to pay the United States $60,000 in lieu of forfeiting their home, which was used in the sale of obscene materials.
Joseph Tanner forfeited $80,000 and all obscene materials and equipment used to produce obscene materials.
Thank jebus. If they weren't prosecuted, just think of all the people that would continue to not be harmed by this in any way. Money well spent, now lets go after the mainstream porn distributors, followed by Playboy...and frankly, Cosmo's covers are getting kinda kinky.

Not related to the subject of this thread, but that IS a good use for our tax dollars.

So.... (this is gonna be popular)....... if it's OK to entrap pedophiles, is it OK to entrap drug users? I mean... leave a joint lying on the sidewalk and arrest whoever picks it up? Or how about bank robbers... leave a few hundred laying on the counter?
Is this a slippery slope? Does anyone care?
After typing all that I decided I don't.... fry 'em.

I'm still trying to figure out how looking at images can be considered criminal.

it HAS to be a crime to look at Michael Jackson..
please tell me it is.. please

MT it wouldnt be entrapment if the website let the user know there information posted on the site is illeagel
Visitors to the site will be alerted that they are breaking the law and that their details could be circulated to law enforcement officers in a host of countries.

What are the odds of this being thrown out on a first amendment appeal?

Why would you appeal when you plead guilty?

So if I send you a link to a dodgey website via email and you click on that link does that make you a pedaphile?
IMHO while the intent is good the method they use is extremely flawed.

All internet tracking methods are flawed. They presume guilty until proven innocent.

Did you read the article???????????
Visitors to the site will be alerted that they are breaking the law that their details could be circulated to law enforcement officers in a host of countries.
In the past, police have swooped on frequent visitors of such sites, often identifying them through credit card details they used to pay for viewing the images
I dont know about you....but If i'm alerted that what i'm doing is "breaking the law" I dont continue browsing and then enter a credit card to get more. A person who is a pedifile might though.
I know you arent defending child porn but if ONE less kid in this world is molested wouldnt this be worth it?

Did you ever learn anything about the internet ?????????
All I have to do is direct link to an image or a page in the site and embed that link in an email, then email that to someone and bingo they're listed as a potential pedaphile. Its not very hard to get someone inside without 'clicking' that kind of warning.
For example, I could find a piccy link there, embed it in this posting, then YOUR IP address would access it and be listed as a potential pedaphile - when in reality all you did was open this topic.
Besides, this is NOT targetting the hardcore scum. They're all on IRC and newsgroups or in places like Thailand & Cambodia actually committing the act.
-
I don't get it. I only skimmed the article, but aren't the people only mailing their particular brand of depravity to paying customers? I'm assuming the people in the videos are not minors and are willing participants. Where is the problem?
-
Where is the problem?
postal regulations, regarding what can be mailed, I'd imagine.
they'd probably avoided jail time if they'd used UPS.

That's a fairly large loop-hole. I wonder if section 1461 applies to private carriers.

My friend served on a Federal Grand Jury for a year. He can finally talk about some of the things he saw
Some of the pedophile stuff is pretty loosely strung...but what's more damaging, even if these folks just did something stupid at viewing this stuff...is the public embarassment of simply being charged. Whether or not the person is guilty or innocent...or even before it goes to trial...the person's reputation is destroyed. The media coverage, etc...the damage to the family emotionally...then financially, to defend themselves in the legal system.
Don't get me wrong, most are guilty and deserve whatever humiliation they get. But there are some that are simply accused or entrapped, and then publicly crushed...before it ever gets to the bench.

girlspooping.com forced out of business.
There goes my Friday night...

midnight Target: It all started with the Ashcroft breast coverup.
Not really. It started over 100 years ago when US Government declared private mail delivery illegal, then introduced legal restrictions on what could be sent through the monolilistic government mail and started prosecuting people for violating those - often nebulous and arbitrary - restrictions.
Based on the laws that Sandman quoted or similar ones, the newspaper editors were prosecuted for publishing medical articles on contraception - not just abortion - and people were thrown into jail for dissiminating information about contraception, becaue newspapers and letters travelled through mail and any talk cbout contraception was considered obcene and ungodly, hence illegal.
FUNKED1: I'm still trying to figure out how looking at images can be considered criminal.
Some day asking this kind of questions will be illegal. And with advent of brain science, thinking this kind of thoughts may be too.
Gunslinger: but If i'm alerted that what i'm doing is "breaking the law"

Something to think about. This is the kind of thing that absolutely pisses me off.
On a related note, everyone should see the movie Brazil (Terry Gilliam). A well made movie, and with a lot of poignant parallelism with what we consider the normal real world.

You ought to know that the FBI has software that snoops all posted messages for certain keywords. Expect a visit from "Two Guys from Quantico" pizza delivery soon.

Miko I was referring to the second article posted. It said that If a customer went to a pedofile sting site. They were alerted that they were breaking the law. If they gave credit card info they would more than likely get busted. Some say this is entrapment...as a father of two children i say GOOD TO GO!
as far as email links and such go. They'd have a lot more work than possible if they went after every IP address they came across. More than likely they are doing stings on people trading pics and going to sites that people KNOW are illegal

I understood you right the first time. And I am not actually against using the entrapment - or for it, I've not given it much thought yet.
I am just saying that arresting a person under an unconstitutional law is illegitimate, whether he was warned, entrapped, etc.
The doctors in 1900 who were jailed for mailing the contraception brochures were all warned. That does not make the prosecutions legal.
Lincoln warned and threatened his political opponents before he jailed them and suspended habeas corpus and that does not make the jailings legitmate either.
There is no absolute safety. As a father of two children, you have better chances protecting them from predatory pedophiles than you have of protecting them from the State.
Pedophiles did not cause death of millions of germans in WWII or starvation of millions in Soviet Union, governments did.

any crime where there is no clear definable victim is a political crime.
the arrest of tommy chong was political or are they getting rid of the online bong trade?
bong.com
guess not.
since when is video tape of women pooping illeagal?
and what does another free individual having a aborting have to do with a marine with a invisable friend?
i would advise you to stay out of all womens pants except your own.
your invisiable friend that makes decisions for you is not an exception.
-
Ok i'm just not getting you here. I'm referring to a pedifile sting site and you still go back to a law about sending poopy films through the mail.
I dont fear the govt. I watch them though and allways look out for my rights. But when I see the govt making an "active" approach at locking up pedofiles it makes me say hell yea. I have to kids and no set of bars or guards will ever keep me from exacting revenge if some sicko ever came after mine.
This same govt setting up these stings is not the ones u speak of when talking about genocide. I hardley find the comparison.
I do understand were your coming from about this law though. I think what your saying is this is very vegue and could be used as presidence for a number of things that should be perfectly legal. Bringing up Doctors from the 1900s though, IMHO, is not valid. There was a radically different set of morals back then.

What we're trying to point out is I could (via a reflector proxy) get the links to images within this entrapment-website. Then embed the images, for example the following image is not stored on HTC's website, just referred to and loaded AUTOMATICALLY, ie with or without your consent.
Now, whether you know it or not your pc has gone off to my homepage and pulled this image down. Your IP has been logged with my ISP. I could easily have embeded an entire webpages worth of graphics links. In emails you can embed the whole damned webpage.
Now say I was pissed at you, I send you an email, you open it, it links to 20-30 images on the entrapment site. Your IP address appears 30 odd times in the FBI's logfile. What do you think happens next?
