Title: Hey Hitech, any news on the legal thing?
Post by: Dago on May 26, 2004, 10:11:10 AM
Just wondering if Hitech either can or is willing to allude to the legal action between HTC and IEN regarding a patent issue?  Curious if it is still going on or if it has been settled.

This case is set for trail on January 10, 2005.

1. Dale has filed a counter-claim against iEN claiming that he is the owner of the patent and not iEN. Dale seeks a judgment delaring him the sole owner of the copyright in the software code that is the subject of the suit.

2. Dale filed a motion for summary judgment, which was denied, but the court granted another opportunity to file another one after more discovery.

3. It appears that iEN didn't make royalty payments on the patent use contract for some six years. Then, iEN made a payment in 2003, for all six years of missed payments, just a week before its lawsuit was filed. But Dale returned the payment and all sums previously paid ($50 by ICI).

4. In returning the payments, Dale rescinded the contract and demanded that iEN stop using his patent and offered iEN an opportunity to enter into a new contract. Whether the contact is rescinded is a contested. Whether Texas or NC law applies is also contested.

5. Expert designation is June 4, 2004.

Doubtful.  The only people that make money in court are the lawyers.

Truth, the Jury makes out like bandits.  Free hotel room, room service, and upwards of $10 a day in some areas.  Lucky bastards.

If dale gets 1000.000.000$ i suggest he makes the game free for all :D

If its 1.000.000$ --> 999.000.000$ ill settle for 1 free year for everyone that has 4,5 posts per day or less here.

Thanks for the info, was wondering what the status was.

Regarding winning a lot of money, the person/company you are suing must first have a lot of money, or good insurance that covers the issue in question.

Ya'll forget ... IEN started sueing everyone in site because it's broke. If HTC wins the suit they probably won't see much money out of it because that will spell the end of IEN. All the yuckety yucks in the big office at IEN will line their pockets with the money that's left then cut and run.
HTC will be out legal fees and such. They will probably never be able to recover all the costs of just fighting this suit from IEN much less recieve any compensation for the wrong that IEN has done.

iEN is the owner of Warbirds.

Here's a quick explanation, it may be wrong.

"Haven't seen or heard about it in ages.. IIRC the smoothing code was HT's, and it was not sold, but licensed to iEN.. who also stopped paying for the licensing rights..defaulted if you will.. When this came up I guess the first thing iEN did was try to send HTC a whole bunch of license payments that must have gotten lost in the mail.. then came out with iEN owns internet gaming because we own smoothing code.. As you can see its scared a lot of people "

There a discussion about it over at AGW.  You can read it here.

Nail on the head Mrs. Roo... therein lies the problem nowadays with our legal system... you can have very little and sue very big.... but, in the end when you lose, the person being sued loses too, because they can not afford to be lax.

If you sue and lose, you need to be held 100% accountable FOR ALL COSTS.

HiTech might get Mild Pill's  T-28 in compensation.  Which he could sell off and with the proceeds get his own plane "pimped."
