Wow, this is simply pathetic.  I would think we have more pressing immigration matters to deal with than kicking a widow out of the country, not to mention better things to spend our money on.

The widow of a U.S. citizen must return to her native South Africa because her husband died after less than two years of marriage, a federal judge has ruled.

U.S. District Judge Owen Panner ruled that immigration officials had reasonably interpreted that the two-year rule was firm, and that Carla Arabella Freeman must leave the country because she and her husband, Robert, hadn’t been married long enough before he died in a 2002 car accident.

Panner ordered immigration officials to wait 30 days before deporting Freeman, allowing the woman’s lawyer time to decide whether to take the case to the U.S. 9th Circuit Court of Appeals.

The attorney, Brent Renison of Portland, criticized the decision, saying it “is not what a civilized country does.”

Although the two-year rule doesn’t come into play often, Renison said that immigration attorneys have learned of at least 25 similar cases.

Immigration officials in Georgia, for example, are seeking to deport Olga Bota, a

38-year-old Romanian citizen whose American husband died from stomach cancer in 2000.

Bota has a 4-year-old daughter who is a U.S. citizen, said Cherie Elizabeth Patronis, the Atlanta attorney representing her.

Rubi Dobrenz, who lives in Mount Vernon, Wash., faces deportation to her native Peru because her husband committed suicide shortly after their marriage in early 2000, said Bart Stroupe, her Seattle attorney.

Renison said he is not aware of any federal court that has sided against immigration officials in such cases. Sen. Dianne Feinstein, D-Calif., co-sponsored a bill passed by Congress in 2000 that allowed Suchada Kwong, a native of Thailand, to become a permanent U.S. resident.

Kwong faced deportation after her American husband was killed in a car wreck in Clark County, Wash., in 1996.

Renison said Rep. Sheila Jackson Lee, D-Texas, has introduced a bill to replace the two-year-rule with a standard that says the marriage must be entered in good faith.

About ten years ago or so, there was a Navy test pilot out here that died in an F-86. He was married to an Australian woman for just a year or so. She had to fight to stay in this country.

Think that's bad, they are trying to deport my wife, and I'm still alive. Had to go to court couple weeks ago, next date is in November, all because they want proof I make enough money after I gave them W-2's for 5 years. I was advised to get a lawyer to waste more money. I wonder if I ignore them if they will send in the ATF to burn my house down.

Fact.

And to be fair, it's so that if you get married, you can prove your not going to be homeless or unable to support yourself and your spouse, which is a good idea I guess, but whoopee.

Sitting in a court room with $100 a day lawyers and no one that can speak English isn't as fun as going to the dentist, and a complete waste of time. Maybe Kerry will tax all those rich bastards and pay for my public defender.

seems kind of fediddleed up to me. hammer the people trying to work within system as expected while not go after streetcorners full of guys you know just infiltrated. if you are citizen write your congressman and call congressman office.

It is plain ridiculous to ask for the "proff" you can "afford" the wife. > I was just trying to highlight the absurdity, but it did not work the way I planned it.

Midnight is totally right, I hope everyone male or female that is having this problem can stay.
  Bureaucrats just have no common sense,the law was to stop people from paying someone to marry them to become citizens and then divorcing and go there own way.

Seems obvious to me they hafta to after the ones the KNOW about, cause they can't find the illegals.

Homeland Security will have nice statistics to show on how they are making the country safer.

The decades of liberal pandering to the hispanic vote has created this situation. They learned threy could get anything and now its so bad now that both parties are giving them just about any immigration right they think will please them.

Tell me whats the last time the democratic party ran an illegal immigration campaiogn ad with the words "They keep coming" over a video of Mexicans runningover the US border?

Althought both parties seem to ave embraced the illegals now it's clearly the democrats who got us where we are politically by pandering to the mexican vote and equating pushes for immigration enforcement and reform with racism.

All they need to do is come ask me and I will show them where I pick up the "day laborers" that we hire sometimes at work to do the lawn stuff around the office. But then I will be taking away jobs from the illegals who want to work and giving them to lazy legal americans who want union benefits to cut grass once a week.

Yep all "la migra" has to do down here is drive around to all the local  Home Depot parking lots every morning and they will find all the illegals they want.

Personally, as a legal immigranmt to the USA,  I'm conflicted between my disdain for their criminal tresspassing of the USA and my respect for their attempt to get a better life and their willingness to work hard and I imagine honestly in most cases to attain that goal...
