Yes. No. Not during the war, but his initiative, after the war, had started, but before it ended, but not during, but yes, he did.

He committed treason. And looking at the 14th ammendment, he can't legally hold a public office.
Oh well democrats. Apparently your top man can't even be a senator.

The only reason that Jane Fonda wasn't prosecuted for treason (guess the same goes for Kerry) is that the US was not technically at war with North Vietnam. At least that's the way I've always understood it.
Just did a bit of research. From what I read a declaration of war isn't necessary, hostilities will do. However, apparently there must be an intent to betray the United States. In Fonda's case probably provable, doubt that would be so with Kerry.
