Ok..so I hav enow won 2 out of five tickets
Skateing and 1 speeding ticket
Im going back to Trail By written Decleration for my last ticket
But I would liek to hear soem ideas of..welll excuses..lies..whatever you want to call them..I call it truth for thsi argument
I was coeming down Highway 50 from South LAke Tahoe..Curvy 2 lane Highway..
I coem around a corner........I guess im going somewhere in the 90's..
Argh Highway Patrol sitting around coner in Blind Spot..I get ticket
So..Im thinkn ..whats goon abe a good argument....
1) Mistaken Identity (This worked for my last tickect at night)
but..its not dark ..but there were many other cars speeding
2) Admit to speeding, or say you were passing soem semi turks and an extremly fast large vehicle started to ride your azzz so you speed up to give him room to pass (unsafe conditoins)
I dont think admiting to speeding is a good thing..but im leaning towards the .."iw as passing semis and a lager SUV was barrleing down on my ..riding my bumper"
All of this is feasibel as the CHP officer could not see what was happening behind me becuase of the blind corner
Now...hold your breath if you are going to preach about ..paying the ticket blah blah...

How long till he pulled you over?
If he lost sight, claim mistaken identity... in court claim this, and make sure the officer admits to losing sight, be sure to remind him of the other car going that fast that passed you like a bat out of hell almost running you off the road. Also, do not admit you saw him turn on his lights, say you saw him come at you with his lights on. Hence the fact that he turned them on for someone else.
Worked for me last year in NC and again in CO this year.

I can use the $250.00 for the ticket better, and I can definitely keep the money the insurance company will charge in increased premiums for a bunch of bull watermelon tickets a highway patrol man writes. To tell you the truth, if they spent 50% of the time they write tickets chasing real crime, this might not be such a corrupt and immoral society.

I've never had a ticket in Britain, but I speed where it's safe, ie there's a BS nanny instigated limit. But when I do finally get caught, I wouldn't lie about what happened.

I have a very effective way to win in court. It always works for me. However I am a bit afraid to post it in an open forum as it would probably not work if everyone did it.
If you want to hear it let me know your email and I will tell you how to do it.
It is honest and not unethical, it is based on how the court system works.

What I said about believing in Christ is one thing.
I do not believe in going to church, as I feel most church dogma's warp the word... that said, I also feel that a ticket for 4 mph over the speedlimit is rediculous. I also feel that a trooper who loses sight of a vehicle should also follow the law and not say he did not lose sight...
So, if you want me to admit it is "wrong" to lie about speeding... yeah, it is, but do I think God really cares... Naw... I don't.

BTW, I just finished volunteering at the library to have a speeding ticket expunged from my record. I guess I'm just contributing to the immoral injustices of our society.

I agree with you Bodhi, about a 4 mph speeding ticket, and also agree that troopers should follow the law. And I can understand how a thinking person such as yourself can get discouraged by the way many churches spout twisted dogma.
There are LOTS of churches out there though. I hope one day you find a compatible one.
Picture a day in the future when everybody in the country is like GreenCloud, or worse. Disdainful of authority, self-serving, dishonest and proud of it. We'll lie to each other during every transaction, we'll break every law we can get away with and fight it deceitfully if we get caught. Think we'll still be the greatest nation on the Earth? Any way to avoid that future?

If your out of State whatever you do. Dont ever get pulled over in Barryville NY and expect to be able to get in touch with the court there.
They dont have a phone # on the ticket to get in touch with the court if you have to and it Seems nobody outside of barryville has ever heard of it. Including Lawyers who's offices are no more then 20 miles away.
Oh and dont expect the mailing address written on the ticket to make any sence either.
Mine said to mail it to the "Town of Highland in the town of Barryville"
Dunno bout any of you but I never heard of sending mail for one town to another town.
On Top of that if you do eventually get the number be prepaired to either not be able to get through orrr to get an answering machine.
Oh also they seem to be prone to closing for a week at a time. so hope you arent trying to get in touch with them during that week LOL
Now I personally have never heard of an entire court being closed for a week at a clip. But evidently in Barryville they do that.
Anyway. Got a ticket for doing 58 in a 40.
Only problem was I was doing 50 and not 58.
50 was the speed I saw on the last speed limit sign I saw. 40 was the speed limit posted on the sign about 75 feet in front of where I was pulled over at.
Also the officer never mentioned anything about me speeding or why he pulled me over but said he was giving me a ticket for not wearing a seatbelt. Now I was wearing a seatbelt but 5 of the 10 of my other passengers werent. so I wasnt about to argue the point with him.
so he hands me the ticket and walks away and I drive away. Bout an hour later my Bro in law notices there are two tickets not one the other for speeding.
Anyway
I end up writing a couple letters. One to the court clirk and the other to the judge.
Pleading guilty to the seatbelt and guilty with my written explination on the speeding charge. figuring there was no way I was gonna win but thinking I might be able to at least minimise the damage.
End result.
Speeding ticket dismissed
$50 fine on the seatbelt with a $55 surcharge.
Needless to say I was tickled pink
Dunno exactly what it was I said in those letters that made the difference But I can post them if anyone is interested.

I was doing 55 in a 40 - just carelessness on my part, plus I crossed an intersection where the speed limit dropped from 45 to 40 without really being posted clearly (in fact the officer pulled me over before we reached the new speed limit posting). Anyway that put me enough over the limit that the officer felt a warning wasn't sufficient. So it was more than $100 fine, and I felt the pain of paying it too.
I was told to fight mine too, but I was wrong and I knew it so I just paid the fine and moved on-- with a resolution to watch my speed more closely in the future.

I know a guy who didnt bother getting his drivers licence till he was like 32 years old.
He got caught driving with no licence so many times they issued him a drivers licence.. then revoked it LOL(true story)
Anyway. He had himself a pretty decent lawyer cause he never spent a day in jail.
Get a good lawyer and he cant get you off on just about anything.

I agree. I have paid tickets in the past, most recently the one I received in Vermont last New Years. I even paid it knowing the officer put the wrong date on the ticket. Could have esily gotten out of that one, but I knew I was wrong on that issue, and paid it. As for the "getting out of tickets" comment, I feel a need to clarify that I will do it, if I feel that the ticket is not valid. I deal with what I do wrong, so long as I am not being taken advantage of. So, I am not hypocritical, just conscious of the ethics involved in citations and enforcement of said. IE, if it is a legit ticket, then fine, but otherwise, I am going to do all I can to get out of it.

Not the case at all...
radar guns are very rarely accurate to within 3 - 6 mph, especially on slower targets. Add a vehicle coming at you head on at an angle and the margin gets much larger...
Just not a fan for CS tickets over a low discrepancy is all.

Hmmm... doppler error as a function of speed?
How so?
As for angles... doppler is a measure of closing velocity. If the radar gun is offset, the velocity of closure will be slower than the actual speed of the vehicle.

Every radar unit I've used is accurate to 2 MPH or less both at 35 MPH and at 60 MPH. Calibration is tested regularly. Perhaps the crap old ones you buy on Ebay are less accurate; I've never used that junk. A radar unit cannot be used for speed enforcement if it isn't accurate. Radar units in Ohio also have to have audio.
When a target vehicle is at an angle off it's called Cosine error. This causes the radar display to read LOWER than the vehicle is actually traveling (in other words it benefits you the motorist). In fact about 90% of radar errors will benefit the motorist; there's only a few specific, easily avoided conditions that actually cause the readout to be artificially high.

I am curious inasmuch as you seem to know what your talking about.
How is it the officer that ticketed me was off by 8 MPH
As soon as I saw him driving in the opposite direction I instintivly looked at my speed which read 50.
How is it he clocked me at 58?
My Speedometer isnt off, I've checked.

Since you say your citation was dismissed (through mail, no less) it's likely that something was amiss to begin with.
However, for the sake of discussion, here's a couple possible ways that a radar reading can be artificially high:
--The most common is simple target mis-identification. With radar you don't pick your target, so determining the radar's target is up to the officer. Visual observation, radar audio, and knowing which targets a radar unit will pick (range, reflectivity, etc) are the officer's tools for doing this. It's usually simple, but every now and then it can be a bit tricky. Be aware that an officer doesn't require a radar reading to write a citation (not in Ohio anyway), so staying close to a semi or other such radar magnet won't gaurantee safety.
--Shadowing errors cause target readouts to be high. However, more often than not such an error causes the target speed to be absurd, often twice the speed limit. It is possible though for the error to be low--say 8 MPH--if the patrol car is overtaking a very slow-moving, highly reflective vehicle. Shadowing errors are super easy to spot since the radar unit's patrol car speed reading will be lower than the patrol car's actual speed (speedometer). Also, this only happens in moving mode.
--Batching can cause the target readout to look funny; this only happens if the patrol car is accelerating or braking hard and honestly it's practically a nonissue. Basically you (the cop) don't trust the radar if you're flooring it or jamming on the brakes.
Overall it's much more common to get a low reading than a high one.

Actually that kinda surprised me I figured the best I could hope for was to get it reduced to 50 in a 40 inasmuch as I did mention in the letter it was possible I somehow missed seeing a sign that read 40 but it wasnt very likely.
The Cop was traveling in the opposite direction as me.
Does the direction in which your heading effect the readout?
And how accurate is it when your moving and headed in the opposite direction of the car (in my case full sized van) your clocking?
I know there is no way I was going 58. I had just mentioned not 5 min before that you hadta watch your speed carefully in those parts cause I knew they were a bit testy when it came to the speed limits there.
Plus it was mountain roads and they roads were wet and among my pasengers included 2 very small children. so I was being extra careful.

Are we equating speeding to drunk driving? I know you're an adult and quite educated, but this post came off like a high school student. Who is going to kick his ass...you? Jeez...
GC, there are ways to beat a ticket, but at the speed you were going I doubt it will be easy to beat this one. Knowing the CHP, your clocked speed will be on the ticket. Depending on the speed limit, you could also be slapped with reckless driving. Be advised that going over 100 MPH will constitute a revoked license and a year in prison for reckless driving and public endangerment.
I doubt seriously you'll have that ticket expunged. It's not your first moving violation and I can almost bet the ranch that the judge will take that into consideration if you fight it. I also doubt that the officer will forget who you are, especially after he sees the ticket. You are probably going to waste money trying to fight it, as you'll have to incur court costs on top of the ticket. I know you want out of it but from this end I don't see an out at all.
Pay the ticket, take the points and do better next time.

Every week here in Mass. I read about some poor family being ripped apart because some young 16-19 year old is speeding, they either kill themselves or their passengers, or some poor pedestrian or passenger in another car.
I think he posted here to show off,

It's plenty accurate. Radar measures closure rates (both positive and negative closure rates) by using the change in wavelength caused by the doppler effect--so cars closing on each other in opposite lanes is basically the optimum circumstance.
A lot of lateral separation--like a very wide median on an expressway--will cause speed readings to be a bit low but that only benefits the motorist.
Drediock, it sounds like you'e trying to figure out whether the guy had a wrong reading or just pulled "58" out of thin air. I can't really help you make that determination. Is it possible that he cited you for 50 and he just had a sloppy looking 0 that looked like an 8? I know some people who actually draw 0's with a slash through them. If your citation was dismissed without requiring so much as an appearance, then the most likely case is that it was dismissed for being filled out wrong. In any case, to be dismissed in such a casual manner almost gaurantees that it was in some way a bad ticket; unless NY does things a lot differently than OH does.

Well yea, Im wondering how he got 58 from 50.
No it sure looked like a 58 to me. didnt leave any question in my mind.
The only thing I can think of and correct me if Im wrong is that I mentioned the fact that he never once told me why I was being pulled over. and never told me I was being given a speeding ticket.
He told me I was getting a ticket for the seatbelt and what I could do to either plea guilty or fight it. then handed me the ticket/s and walked away.
I mentioned this in the letter which I attached to my plea and suggested that this could be confirmed if the officer voice recorded our exchange and he listened to the recording.
I seem to remember hearing someplace that an officer has to tell you why you are being pulled over and specifically what you are being ticketed for.
Now whether it was this. the ticket was screwed up in some way, or the Judge was impressed with my letter and/or my driving record,was in a good mood and didnt feel like helping to subsidize the insurance industry for the next several years by hitting me with the points I dont know.
And I aint complaining.
But it sure makes me curious LOL
In the end for them it even works out better.
I've always loved camping and fishing up there and have dropped some consideable coin into their local economy ove the years.
I know it sounds weird but..
Its always been almost a magical place for me, and so different from what Im used to. I've always referrd to the area as "My church" its almost a religious experiance for me.
when I got the tickets it was almost like the magic was suddenly stolen from it.
And I probably wasnt going to go back there because it no longer held that special meaning
then when I found out the charges were dismissed it was like the magic came back.

and nope its
Highland town court
in Barryville
Actually when I first tried to get the phone Number to the court I figured I'd call the Trooper station in the town of highland.
Since thats the only refrence to police and law enforcement agency phone # I could find figuring if anyone would know the number they would.
Nobody there had even HEARD of Barryville LOL
Was a rather interesting and amusing conversation that followed that had both the officer and myself laughing.
they eventually gave me another number to call
what followed after that was a 1 1/2 hour goosechase
( I have the phone records to prove it) with me ending up calling one law enforcement agency after another. each giving me another phone number of someone "who would know" Who in turn would give me the # to someone else.
Funny thing about it too was each place I talked to wanted to know the name of the officer. and each place I talked to claimed they never heard of him.
now this seemed to make sence right up to the point where I finally got the local Troopers and the local Sheriffs Dept for the Highland/Barryville I was looking for.
And even THEY claimed they never heard of the guy.
I remember joking with the Sheriffs officer that I was beginning to feel like i was in the twighlight zone. Which seemed to amuse her greatly though she did agree.
All in all I must say that NY law enforcement agencies are filled with very nice, patient, well spoken and friendly people with a pretty decnt sence of humor because we seemd to spend almost as much time laughing as we did trying to get me where I needed to be.
Unfortunately When I did get the number I gont an answering machine and I found out it was closed...for a WEEK. It did however politely ask me to leave a breif message along wiht my phone # and my call would be returned. ( I did, and they didnt) Now one would think that the local sherriffs dept would know the court would be closed for a week.... Well they didnt, least the lady on the phone didnt untill I called her back, informed her of that little tibit and to see if there was a local prosecuter I could call instead. (there isnt)
All this because I wanted to find out the right mailing address and how they work the fines.
So my next step was to try to call a local lawyer.
Figgering if ANYONE would know what to do they would.
Well that led to another hour of almost the exact same fiasco described above. Nobody, and I mean NOBODY outside of barryville had ever heard of it. they all had to look it up on a map to find it. Most were too far for them for it to be worth their while. Each gave me the phone # of another. Finally I found 1 who again after he managed to find it on a map (it was a half hour ride right up the road from him for Crissakes) Said the typical fines could range to a Max of $200 plus a mandatory surcharge and it was kinda out of his way but he could handle it for $500.
So I asked him "Think we can win"
Him:: "I dont know" (didnt sound very confident to me)
Me: "so your telling me that for $500 you can go up there and take care of it but you dont know if we will win and if we dont win it will cost me up to a $200 fine +
AND $500 for you?"
Him:: "Yes thats about the size of it"
Me:: "Well hell I can loose $200+ all by myself I dont need to pay you an extra $500 for that"
Him::"Well you can represent yourself, what you do is go to court and see if the officer is willing to reduce the charge if you are willing to plea guilty to a lesser charge"
Me:: "you mean cop a plea? Ok yea I can do that but I really didnt wanna drive all the way back up there cause it would cost me almost as much in lost time as it would to pay you"
Him:: well why dont you try this. I dont know why I didnt think of this before. Im going to give you the number for the Bar association. You call them and they will give you 3 #'s of people you can call in that area."
Me:: ok COOL! thanks"
So I call the Bar.
the phone picks up and I hear
"Hello, you have reached Ny state Bar association We are closed today........"

If you have rear wipers that is.
turn the washer nozzle around so instead fo squirting against the rear window it squirts on the windhseild on the car behind you.
Guy I know did that and would spray washing fluid at tailgaters. Or just as a gag if he knew the person behind him.
Worked rather well
Well on a twist on that fill the container that holds the washing fluid with oil instead.
Cant catch what ya cant see LOL
