La Grippe of THE TRIAL LAWYERS (http://www.weeklystandard.com/Content/Public/Articles/000/000/004/793dgqvs.asp?pg=1)
So why is it that 100 percent of our flu vaccines are now made by two companies in Europe? The answer is simple. Trial lawyers drove the American manufacturers out of the business.
"All this is the result of a legal concept called "liability without fault" that emerged from the hothouse atmosphere of the law schools in the 1960s and became the law of the land. Under the old "negligence" regime, you had to prove a product manufacturer had done something wrong in order to hold it liable for damages. Under liability without fault, on the other hand, the manufacturer can be held responsible for harm from its products, whether blameworthy or not. Add to that the jackpot awards that come from pain-and-suffering and punitive damages, and you have a legal climate that no manufacturer wants to risk."

Don't forget Senator Clinton:
According to the Wall Street Journal, though Hillary care as a whole
crashed and burned in 1994, the former first lady was able to change
the laws governing the manufacture of vaccines.
And the results have been disastrous.
During last fall's flu vaccine shortage, the Journal noted:
"The reason for today's shortage - as well as seven previous preventive vaccine shortages since 2000 - is that there are just five vaccine makers. This lack of suppliers is partly thanks to Hillary Clinton, who as first lady turned government into the majority buyer of vaccines and pushed prices so low as to make business unsustainable."
In July 2003 the Journal noted that the problem goes back to 1993, when Mrs. Clinton's "Vaccines for Children Program" was first implemented.
The vaccine crusade was being pushed at the time by Mrs. Clinton's Children's Defense Fund mentor Marian Wright Edelman - even though U.S. child vaccination rates in the early 1990s were considered relatively high by medical experts.
But that didn't stop Sen. Clinton and her "reformers." She pressured Congress to back her plan in a bid to make vaccines more available to poor, uninsured and underinsured children. In the process she turned the government into the major purchaser and distributor of vaccines.
Not only did Sen. Clinton's reform fail to result in any noticeable
increase in childhood vaccination rates, it managed to drive down
financial incentives for private companies to develop and produce
vaccines.
A year after the Journal's report on Sen. Clinton's crusade, the number of manufactures producing flu vaccine has declined to just two.
From another article:
Now, Kerry is even blaming the flu vaccine shortage on President Bush. However, the flu vaccine shortage can be traced directly back to Democrat Hillary Clinton. During President Clinton's tenure, Mrs. Clinton tried to force US drug manufacturers to produce vaccines for children and give them away, virtually, free. Not only did the drug manufacturers balk at this but, they saw the real threat of lawsuits. With no protections offered to them, they could be sued should anyone have an adverse reaction to the vaccine. So, they stopped manufacturing it and outsourced. Another Dem lie bites the dust. However, John Kerry is still using this falsehood and others in his campaign against President Bush. As long as he can continue to blind his faithful with lies, Kerry will continue to use them.

As much as I like to ***** about lawyers, the vaccine is being produced in the US. By a French company, but still in the US.

Well, we've got plenty of viagra.

>>Well, we've got plenty of viagra.<<
Thats funny, but interesting too. The complications from viagra can be severe, and yet I don't see it comming off the market because of law suits. Could it be America thinks with its other head? :D

i heard a rumor that viagra may cause unwanted pregnancies..

tsk tsk
So we allow our vaccine makers to be sued out of existance causeing shortages.....great plan skull....great plan.
Q: What happens when a polio vaccine maker gets sued for 20 million because 1 in 10,000,000 kids has complications.
A: They 1. move off shore or 2. They quit making polio vaccines.
either way Americans will suffer.
BUT the bigger picture is this. Liberals want socialized medicine so bad that this and massive mal practice lawsuits are part of the game plan. If you sue the medical industry out of existence the Govt. is then forced to take it over.
What happens when this same practices are applied to the govt. Can our govt afford these massive pay outs AND the cost of Govt provided health care.....the answer is definatly no. So now you change the law to forbid people for sueing the govt. for free health care. <----why can't we protect these companies now?
None of us here are saying that these medical professionals should have complete immunity to liability claims.....just that there is SOME protection for them. AND this is hardly the republicans fault.

:) old.. old..old.. (did I say OLD?):D
the joke not me :)
On another point someone was talking about socialized medicine and how bad it would be. Anyone participates in an HMO? I'd go to a vet before I participated in an HMO. Them suckers will kill you.
-
Edwards was the correct answer. He was the lawyer for a guy who sued for 5 million dollars after he caught the flu after getting the vaccine. He wasn't critically sick or even sick past the normal flu stuff either. He just got the flu.
Here's for slip and fall lawyers :aok !

socialized medicine!!has anyone been to a VA hospital or been seen by a ARMY{or other service} doctor, they for the most part are the bottom of the barrel ,,why because they cannot be taken to court,,,cant sue the goverment, america has the BEST health care system, its not perfect but what is! the thought of goverment controling heath care should scare the hell out of everyone ......
my wifes father hasent been feeling well for the last year ,and i have drove him to dayton OH VA hospital 5 times myself,to be checked out, finally last week he was feeling so bad he couldnt wait for his next app at the VA,we took him to the emergency room, within 10 hrs they found he has stage 4 cancer in his heart lungs ,unfortunatly he will not be with us much longer as it is so advanced that it cannot be treated, the civilian doctors said that there is no excuse for them to have missed it ,,but because the VA is the goverment they will just contine as before
GOVERMENT RUN HEALTH CARE ,,BE AFRAID ,,VERY AFRAID

HMO's are about the same. They WILL kill you. Go to a veterinarian, a pharmacist, an ER, but do not go to an hmo doctor.
I'm serious, I've seen some horror stories (e.g., cutting veins too short for a bypass, heparan drips in people with bleeds, complete artificial valve failures undetected till death etc.) I'm serious, stay far away from HMO's.
-
We use an HMO for our health care. It's health insurance offered by my wifes workplace. So far we have had no problems with them. (Kaiser Permanente) We have been very satisfied with the health care they offer.
When I shot my right knee with a nail gun, I drove myself to the HMO (nail was still in my knee). Their small emergency clinic was very efficient.
When my daughter got bit by a dog, they paid for everything, ambulance, ER you name it. We didnt pay a dime.
-
Good luck to you. But HMO's get the cheapest doctors and it shows.

Elfie now imagine your HMO or even the clinic refusing to help you becuase they are afraid to get sued. Doctors today are practicing defensive medicine (if they are still practicing) because they can't afford not too. No one who wants this reformed want's to make these guys completly imune from liability but some sort of protection must be given to them.
Imagine your daughter contracting viruses that used to be simple to inocluate from because the company that made them last year went out of business because of greedy lawyers. Imagine her getting sick from a sub-standard inocluation made overseas under no FDA guidlines and having no recouse to take because of it. This is a serious matter.

And imagine your doctor being one of lowest paid in his proffession, and ask yourself , "why?" Either he's benevolent, desparate or incompetent - or maybe just starting out. Me, I'd opt for the expensive guy with a well documented history. Sorry, but sometimes there are no second chances.

I'm not sure what you are trying to say here? How does this realate to what I've been saying with the second chances thing?
-
I'm saying avoid HMO's like the plague. They hire the cheapest doctors and do the cheapest test, and if you get old and expensive guess whats going to happen? A heparan drip when you have a peritoneal bleed.

ahhh....I see!
