If anyone has any experience or knowledge in this I would apprieciate some info.
17 months ago my employer came to me and asked that I take a temperary 30% reduction in my salary because of financial problems the company was experiencing. I was also promised, verbaly, that the monies withheld would be made up to me and I would be recompensated. That was 17 months ago and I haven't seen a dime and my slary is still reduced. I asked for a part of it returned 8 months ago and was turned down.
Is there anything that I can do to get this back through any labor laws or am I just screwed out of $44k because I didn't get this in writing?
By the way, there is no paper work that I signed about taking a pay cut either.

Seriously, we don't know jack about this, but it sounds like you could use a professional opinion. That's a lot of scratch you're talking about.
[edit] and in the interest of disclosure, I do work for a labor lawyer. But it's still a good idea to see one when you have a question like this. I think the best that you can expect from this thread is to find out if you should talk to a lawyer or not. I'm saying you should

where u given a writen notice of the 30% cut?
couse if not than what u say may actuly stand up in court
due to the fact that it was a verbal agreement and not written
and just like SILKBOY put it...... get lawyer

If the cut is not in writing, surely you have been on the original signed contract for 17 months, and therefore should have been receiving full pay. The cut was only verbal, so on paper for the last 17 months you have been under-paid 30% by your employer? You keep all your pay slips?

obvuisly he recived payments 30%less for the last 17 months
hopefully you get you payments in checks....this ought to be enough proof that u are underpayed..
the only hard part will be to proove that your emlployer agreed to pay you the 30% back at a later date

What he said.. Sounds like that was a verbal agreement to me if they stated that you would be compensated in the future for the temporary salary loss..

I was not given a written notice regarding the cut.
I keep every pay slip.
The payments are direct deposited, so there is also a bank record as well.

Then with no wriiten poicy or announcement of the cut...it should be like it never existed...hence they owe you all the money regardless of any other circumstances.

I know...I would just demand full pay and be compensated for the cut....They don't have it in writing so they have to comply.

Just make sure that you have another job lined up before taking any action since these guys will fire you once your lawyer calls.

With 44K back pay....he can afford to take his time looking for a month or so...I assume anyway..unless he has financed his soul away.

Na the problem is that when they get the word, I'll be out and you never know when the money comes... if it comes. I need to cover my rear with something else in the mean time.
anyways.. i doubt I can collect from these guys anyways. They have a pretty slick setup where the company that pays me and that I work for doesnt have any assets.... it gets paid by other companies that actually own the products that I work on... and it's all tied up in trusts.
I need to call a lawyer and see what I can do.

Sounds like these guys have a pretty good idea of how to play folks. Might want to keep a lil black book if there is something useful. Basically, it sounds you and everyone else who got played for the 30 % is screwed but if you don't care return the favor.
