Again............

Seems the police or law enforcement is NOT responsible for your safety.  EVEN WITH A COURT ORDER?!?!?!?

This Lady talks about it in what I consider a very sensible manner.  I am in full agreement with her!  Her picture suggests she is VERY EZ on the eyes :D  
Sadly she reports that she had a ex that hit her so hard she now has a detached retina.  :(

Now ........

The actual case is a terrible read.  A restraining order issued.  Problems!  Mother calls police and reports it and request the police to act on the court order.........  3 daughters are gone.

the police will take care of themselves first, each other secondly and finally the public just as anyone else would.  your personal safety is your responsibility.

I can't find anywhere in the article where this "limited access to their children" is defined.  What access?  The term "abduction" is used but there are no details.

In cases like this my guess is that you have to prove negligence.  Were police negligent in not arresting the father?  I don't know.

But I do agree that you can't sue law enforcement because they may fail to stop a crime.  If my house gets broken into am I going to sue the city because police didn't stop it from happening?

The was a case a couple of years ago in Columbus where there was a minor riot in a bad part of town and a torched car set a house on fire.  The responding fire department came under fire from the rioters.  The fire department held back and the house burned to the ground.

The homeowner plaintiff sued the city saying that it was the fire department's responsibility to put out the fire.  The plaintiff lost the case.  The court ruled in part that while many firefighters risk their lives to save others, it is not their job to risk their life from hostile gunfire.

I remember reading another story related to this case a few months back.  IIRC, the father took the girls within his normal visitation time, and the police did not believe the man to be violent from his record.  Based on this, they didn't see that they had any right to interfere in what they saw as a divorce-in-progress woman trying to use the police to take legal potshots at her "estranged" husband.   The man gave no indication of his intentions that the police could see until he was standing outside the police station instigating a shootout.  It's a very sad case.  But I do agree with the point the article made, that every person is responsible for their own self defense.  That doesnt mean everyone should buy a gun (although if they want one and feel a need for one, they should be able to yes).  But everyone should be capable of protecting themselves and their families.  

Police enforce existing laws and catch people who have broken the law.  Thats their job.  They arent personal security guards.

This is a slightly interesting troll, not from Wrag but from the author of the editorial.

The fact that it is an editorial and not even an attempt at a true investigatory story throws a spin on it. Frankly there is too little information in the "article" to really get a true idea of the circumstances of the "abduction" and court ordered visitation restrictions.

Domestic situations are always such a quagmire once the accusations start flying. It's so emotionally charged that it's almost impossible to sort out.

If there were more info you could possibly draw some kind of conclusion about the circumstances of the original incident. The only real point made is the author wants to insure the female side of a divorce has access to a weapon to defend themselves. On the face of it that's kind of silly as they already have that option in the US UNLESS they also are under a DV charge as domestic violence precludes firearms ownership. I also don't see given the extremely sketchy info in the articla that the possession of a firearm would have stopped the murders. Obviously the mother wasn't present at the time of the killings.

Depending on Police to stop a crime is a matter of fickle circumstances at best as the Officer has to be there to see the situation happening in order to do anything about it other than to investigate it after the fact. Anyone who believes a phone and dialing 911 will protect them is silly at best and a victim at worst. You can't call out "kings x" and have the assailant stop the assault while you both wait for the 911 call and Police to arrive before continuing the crime. :rolleyes:  In almost all situations Law Enforcement is a reactive operation and not proactive particularly given the constitutional guarantees. There has to be a crime FIRST before the Police can take action.

not only that roughly 50% of the new students at our dojo are young women.  many women are finally coming to the realization that the girlymen they helped create in the late '70s through the '90s can only hurt them now and many do.  these ladies are taking steps to mitigate their vulnerability.

Here's a clue. No one can be arrested for violating a restraining order UNTIL they violate it. That means the "bad" person is already there before the Police get called. Think about it.

why wasn't the woman bruised beat up etc. 3 young kids all under 10 years old, how were the taken. 99 percent of most women I'm sure will fight to the death before they let a guy kidnap her kids, theres gotta be more to this story than whats printed... I don't care who it is, nobody will ever take my kids... Story just sounds a little off to me, I want more info. before I start blaming cops for this lady's kids getting upducted.. Very sad story though

Iceman,

The kidnapping could be a case of simply picking up the kids for court ordered visitation and not brining them back, hence no hint of violence when he got the kids. Remember this is a domestic dispute situation not a kidnapping for ransom.

your probably right Maverick, allot of crazy ppl in the world man... Not sure if ya'll heard this story or not but I live in Fort Worth, TX, There was this guy that I kinda knew, I played on the same minor league football team as he did, seemed like a pretty straight guy no mental probs anything like that, but one day I'm driving home from my day (office) job and all the traffic is stopped on Highway 360 which goes up on a big loop up in the air onto Interstate 20, anyways I'm wondering what the holdup is and I here on the radio that some guy just pulled over and threw his girlfriend off the bridge into oncoming traffic, didnt think much of it other than some whack job... got home and it was all over the local news they said his name and that he played minor league football and i was like omg I know that guy... Turns out that he got into a bad argument with her and just stopped the car on the overpass got out pulled her out and dragged her to the bridge and threw her off, then he did a swan dive off of it... crazy!!! nobody knows exactly why, allot of people got out of there cars and tried to help but didnt know what was going on until he threw her off
