A Texas school has filed for a temporary restraining order preventing the Seattle Seahawks from using the term "The 12th Man" to describe its fans.

Texas A&M University claims that the school patented the term in 1990 and a variation "12th Mania" in 1996.

Texas A&M has filed a court order to stop the Seattle Seahawks from using the term "12th Man" to describe its fans. Why now?

 Just for the publicity


 Because there's nothing else memorable about the Aggies


 They want Paul Allen to pay them off


 Because they're Steelers fans


 They've got to much time on their hands


 Because they'd never heard of the Seahawks before last Sunday


 Because the school would otherwise "suffer immediate and irreparable injury"





A hearing is set for a district court in Brazos County, Texas for Thursday, three days before the Seahawks play their first Super Bowl game ever.

The school seeks to stop the Hawks from "using, selling, offering for sale, disseminating, distributing, delivering, circulating, issuing, marketing, displaying, promoting or advertising any products goods or services" that use "12th Man" or "12th Mania"

A booster Web site for the school claims that the term has been in use to describe Aggies fans since 1922.

In Seattle, the 12th Man tradition began in 1984, when the Seahawks retired the jersey number 12 to honor their fans. Back then, the otherwise drab Kingdome was the loudest venue in the NFL, even though the team had just two winning seasons in its first seven years after beginning play in 1976.

Ya dont mess with the 12th man. That there is a serious offense in these parts and like you posted its been around for a good bit. I dont think the Seahawks are gonna win their court case. Not in Brazos County anyway.

Meanwhile in Seattle, when this story broke, Paul Allen had #12[/b] added to the port and starboard side of "Seahawk One" Boeing 757 as a way of flipping the bird to Texas A&M. (you can barely make out the new #12 white lettering in this pic below, below the cockpit)
(Basically this means his lawyers can beat up their lawyers, especially considering he's like the 2nd or 3rd richest guy in the world.;) )

Where to begin.......

I was born and raised in the area and I have found myself now in employment of TAMU. Over the years some things have become very apparent. As smart as they are, and there are some geniuses that go to school here, they just lack the abillty to use plain old common sense at times.

A&M was winning championships before you guys were born. The Corps has been around for quite a while. Just because you thought up the "12th man" recently does not mean you invented it.  Why don't you invent a soda and call it Coca-Cola while your at it?

the reason they waited till now to do anything about the Seahawks using the 12th man thing, is because before the game last Sunday, no one outside of Seattle knew the seahawks were using it! the first thing I thought when I saw that flag raised was, " what the hell are they doing, stealing that slogan from A&M?!?!?!" there's gonna be some pissed off aggies!
The Aggies have been using it since 1922, when they had a student come out of the stands to help their injury depleated team... and they've had it trade marked, and copy righted for quite some time.

Heh according the Bryan-College Station bEagle A&M used the "12th Man" slogan for decades (duh), but they made it official in 1990 when they received a licensing trademark which the Sehawks never did.

Wonder what other parts are being left out of the real deal.

A&M has sent letters to other franchises including Budweiser when the use of the 12th Man slogan is used. They have all pretty much complied so it never became an issue to make news. This Allen dude didnt cooperate.

In a three-page "Notice of Removal" filed about two hours before a scheduled hearing in a Brazos County court just a few miles from the A&M campus, the Seahawks transferred the case to federal court in Houston, about 100 miles away.

According to the motion, since Texas A&M is alleging a violation of its federally registered trademark by the Seahawks, a federal court has jurisdiction in the case.

"It brings everything here to a screeching halt unless the federal court decides to remand it," said state District Judge J.D. Langley.

Langley said the maneuver was fairly common for a case involving entities from different regions. There was no immediate comment on the action from Texas A&M.

The university owns the trademark to its generations-old "12th Man" reference for Aggie supporters in the stands and won a temporary court order in Bryan earlier this week to keep the Seahawks, who play Pittsburgh on Sunday in the Super Bowl, from using "12th Man"in their marketing.

The Seahawks have recognized their followers as a "12th Man"since the mid-1980s and even retired the No. 12 jersey in 1984. Now with Seattle in the Super Bowl, their "12th Man" promotion, which previously has aggravated the Aggies, has gained an even higher profile.

Texas A&M has been arguing the NFL team is infringing on the school's legal claim to the slogan, which they say they've used for more than 80 years. The school twice has registered trademarks for the "12th Man" label in 1990 and 1996 that include entertainment services and products like caps, T-shirts, novelty buttons and jewelry.

Seattle's version of a "12th Man" banner, a flag with the No. 12 on it, was flying this week from the team's hotel in suburban Detroit. So was a flag atop Seattle's signature Space Needle and the state Capitol in Olympia. Then there's all the team merchandise and apparel with the "12th Man" logo.

Seahawks are gonna lose this one... Aggies copyrighted that a long time ago and also came up with the 12th man organization and messing with that is worse than messing with the players mothers... they take that very very seriously down there, there is certain spots on campus that you can't even walk on or you'll have 200 corp men on them... I went to UT but visited A&M quite a bit, they take that crap really serious down there

They don't have the copyright.  That's what's funny about this.  If Paul Allen LITERALLY copyrighted this back then, the Aggies are screwed.   Again, the Aggies DO NOT possess THE LITERAL copyright to the "12th Man".  Saying it since 1922 is NOT a Copyright.
