After reading and responding to the I have evolved thread lets look at the issues in an adult manner.
Do bicyclist do rude and stupid things on the road? Yes they do and are subject to the same laws as those in cars.
Do people in cars do stupid things when they are behind a cyclist? yes they do.
But there actions can lead to a death so I see a difference.
I never have understood how and why people get there undies in a buch when they "think" they are stuck behind a bicycle.
I mean are you not the ones with a steering wheel and a gas pedal?
Average car on the road today has somewhere around 200hp.
Now if you cant find a safe way to go around a bicycle then you really need to
work on your driving skills.
Again i pose the queastion.
Is there anything or any reason that the few seconds you might be delayed by a bicycle that would condone acting like a fool to someone or injuring them?
Look I do not defend any rider who does not obey the traffic laws they should be punished like anyone else.
But when someone uses there car or truck as a weapon to intimidate someone on a bike they have crossed the line and really need to seek some help.
If this is someones total lack of respect for human life then then we have places for them: prison.
I obey all traffic laws when riding my bike and I try to use some common sense when and where i ride.
I DO NOT ride on small county roads that are two lanes there simply is not enugh room for me to safely ride even though it is legal to do so
I DO NOT run red lights as this is a darwin award in the making just plain ignant.
I DO NOT ride down the middle of the lane when riding alone as I only need about 1 foot on the right to ride.
I DO NOT take up the whole lane when riding in a group as it is rude and illegal to do so.
Texas Law states that we have the right to ride on public roads unless otherwise posted but we DO NOT have the right to impede traffic or to cause an accident.
It really is this simple show some maturity to others and maybe they will do the same.
There is nothing so important to me that I have to run someone off the road
it just aint worth it.
Besides the criminal court price you might pay there is also civil court to worry about.
One word can some up all the Laws we have on the books>>> common sense think before you act and think about the other guy too as his life is worth just as much as yours.

I searched for road warriors on yahoo images and it came up with this:huh

Thats a picture from the new upcoming movie "Brokeback Warriors"

I always seem to find a bike on a corner with an oncoming car. If I ever get in a position where a bike is in my lane and Im in danger of a headon...the bike better be ready to go mountain biking. Bikes dont belong on the highway.

Yes. And as a matter of fact, any time I see anyone on a bicycle who is outside of a bicycle lane, I run them over. Only a few have escaped the deadly punch of my Ford Thunderturd, and for those I stopped and backed over 'em. I'm getting tired of just running down cyclists all the time though, so I think I'm going to start targeting jaywalkers next...they're worth more points. Actually, now that I think of it, maybe I'll just model my driving on Death Race 2000.

there's always the deep satisfaction of a well placed rake handle thru the front spokes.

A couple of years ago, there were a bunch of ugly ladies who always walked down my road. The problem wasn't that there were 3 of them, the problem was that they always walked 3 abreast, right down the side of the road.
I actually heard that one of the ladies got clipped by a car coming around a blind corner.
-
appended to the end of the above:
"..then there were two ugly old ladies; always walkin down the road..."
-
The way I see it, you should be in control of your car at all times and not speed through residential neighborhoods. Watch out for cyclists and pedestrians, and do everything in your power to avoid hitting them.
One time a guy passed my car in a 30 mph residential zone and flipped me the bird as he passed (my neighborhood mind you). As I pulled up to the red light about a quarter mile down the road beside this car, I matter-of-factly hung out the window and said while looking him in the eye "This is a residential area and the speed limit is 30 mph. Slow down." That's all I said...I wasn't pissed but was more like "don't speed in my neighborhood." After the light changed, the guy literally started screaming at the top of his lungs he was so mad (as he drove off the other way). We went different directions, but I could hear him screaming from a hundred yards down the road. I wanted nothing to do with that crazy idiot, and evidently he didn't want to deal with me either. I could tell what he was thinking as he pulled up to the red light...Oh Chit!!! :D
Btw, flipping a bird is illegal in Alabama in that situation (vehicles)...think it's called menacing or something like that. I didn't learn that personally, but one of my friends did after a different event (and different circumstances.) Cost him $500, and when he went to buy a hunting rifle for deer season about a year later, that incident came up on record and almost prevented him getting the rifle.

I've seen more County Sheriffs, State Troopers, and Local Police break more Motor Vehicle codes than I have. Why are they above the law? They, technically, are under the same Motor Vehicle Code that I am. Explain.
I find it funny that people buy "Mountain Bikes" with Rock Shox and ride on PAVEMENT. I wish I had money to blow like that.
Finally, cyclists that BLATANTLY ride in the surface streets, divided highways instead of riding on BIKE PATHS (they are called this for a reason) or sidewalks.
Here in Metro Detroit we have "Hines Park", it has a 30 mile BIKE PATH, do the Lance wannabe, leotard wearing sissies use it? No, they go in the road. I enjoy making those sissies sweat, they BLATANTLY break the laws by crossing the shoulder and cross into the lane (I;ve already inquired on this with a buddy). They know they are supposed to use the BIKE PATH, so I screw with them. I'd love to see a biker flip me off, imagine myself in my gas guzzling, non-UN conforming exhaust emissioned SUV smiling and asking him where his gagball is to match his "uniform".

Then you are the exeption to the rule.
If all bicycle enthusiasts behaved the way you say you behave I would never have a problem with them.
Problem is. Around these parts 90% of the ones I see DO all the things you say you dont do.
I wouldnt even mind if they were on the country roads as I could easily see why they would want to be. For the same reasons I take the country roads whenever possible. If they would JUST learn to move to the right when cars and other vehicles come up behind them.

Around here, we have a huge group of complete MORONS who insist on riding their bicycles on the curvy rural roads with no shoulders. Only a complete and total fool would do that. We've already had one bicyclist horribly mangled because two cars met in a blind corner and they had nowhere to go, so one hit the bicyclist.
I've already taken a $150 stainless steel mirror clean off the side of my truck because an ignorant fool on a bicycle was on a road with no shoulders and two trucks met. Had I not taken the ditch, the fool on the bicycle would have been the hood ornament on a 4 ton truck. Instead, I lose a high dollar mirror, and the moron rides off on his damned bicycle scot free. They have NO BUSINESS on rural roads with no shoulders and blind curves. There are roads with LANES for the idiots, and there is also a multimillion dollar "greenway" the tax payers paid for, for the benefit of the bicyclists. They rarely use either. But I bet this morning, as I drive up to the farm, I pass a flock of those bicycling idiots at least once on the shoulderless curvy roads, and they are all over the road.

Like i said common sense is all it takes to not win the Darwin award.
On the other side of the coin I think we can all agree that some people drive there autos poorly.
Like speeding drunk driving not using a signal when lane changing and my all time favorite when almost at a stop light the dude next to you pulls in front of you because there was a car in front of him and he just had to be in front LOL
that is the most childish crap ive seen.
Now if there is a line of large trucks in front of you heck yea come on over as they will take all day getting up to speed.
We all make bone head moves from time to time but this mentality that the
roads only belong to those in cars is BS the LAW says differently and untill
it changes you have the responsability to watch out for everyone and thing on the road weather you like it or not.
And just FYI I get pissed off to when stuck behing a bunch of rude cyclist and have voiced my opinion many time to them example hey lady your bellybutton is wide but you dont really need the whole lane do you?
Or my favorite single file moron
:aok
It can be frustrating I agree the problem lies in the attitiuds of both the automobile drivers and the bicycle riders.
What the bike riders have to understand is that by being rude and or inconsiderate thay are only making more animosities between themselves and those in cars.
When im riding it just makes sense dont piss off the dude with the four thousand pound car DUH!
Take up as little roadway as possible obey all traffic laws and guess what! your chance of getting yer butt run over will lesson and in the process you will
be giving a better impression to the folks in there cars.
And last but not least you might think we look funny in bike shorts but I get to follow young ladies with very tight little hinnys in there bike shorts life is good:aok

Actually the cyclists actions can lead to a death as well, thats why motorists get their undies in a bunch. The most common thing I see here is cyclists sneaking through red lights, I've seen more than a few near missies when they thought 'its clear I'm fine" .... smack...
Most cyclists think they are a law unto themselves hopping between road-mode and I'm-a-pedestrian mode, often treating people on the footpath the same way they see motorists treating them.
I get no more frustrated with a cyclist slowed up traffic than I do with a car slowing up traffic, and I treat them the same.
BTW, I used to do a lot of riding, so I've seen both sides of the story, and I'd have to say more often than not its the cyclist in the wrong (sure I've dodged a few car doors, the odd old lady who didn't see me when she turned etc)

I'm disappointed. I expected a thread about pickup trucks with spear-guns mounted in the back and strange cars built out of junk and perhaps the last of the V-8 Interceptors. Well, at least we got some people running over cyclists and a mention of Death Race 2000.

Rip. I think that irresponsible driving that leads to the death of someone should be murder. It's irresponsible of society to think otherwise.
Speeding, Drunk Driving, Fooling around...
Just imagine it was your son that was hit by a drunk driver. Would the driver be guilty of murder?

RIGHT ON:aok

at the very worst they would be guilty of manslaughter.
-
Sailor,
I don't believe its murder in the 1st degree. Possibly 2nd degree. I definately think its manslaughter, negilgent driving, and everything else you can throw the book at the offender. But murder? I'm not so sure.
Lets look at the definitions of voluntary manslaughter and non-voluntary manslaughter in general (varies from state to state)
Voluntary manslaughter is a felony of the first degree. A person who kills an individual without lawful justification commits voluntary manslaughter if at the time of the killing he is acting under a sudden and intense passion resulting from serious provocation by:
--the individual killed
--another whom the actor endeavors to kill, but to negligently or accidently causes the death of the individual killed.
Involuntary manslaughter is a direct result of the doing of an unlawful act in a reckless or grossly negligent manner, or the doing of a lawful act in a reckless or grossly negligent manner, he causes the death of another person.
Now 1st degree murder is definately out in Drunk Driving, since the act of murder itself is not pre-meditated. However, lets look at 2nd degree murder:
2nd Degree Murder Aperson commits the crime of murder in the second degree if:
(1) with intent to cause serious physical injury to another person or knowing that the conduct is substantially certain to cause death or serious physical injury to another person, the person causes the death of any person;
(2) the person knowingly engages in conduct that results in the death of another person under circumstances manifesting an extreme indifference to the value of human life.[/i]
I suppose in extreme cases drunk driving could indeed fall into 2nd degree murder.
Regarding if it was my son? You can't impose law based on your personal feelings in any particular case nor should we, as a society, base laws on personal instances of what has happened to our loved ones.

The act is premeditated. The driver drove drunk knowing full well he could hurt someone. But he still did it anyway.

This is exactly what law and punishments are. If they weren't there wouldn't be any punishments, no one would feel any pain and everyone would just live like nothing happened.

Ya'll should be aware I design and build bicycles for a living. In my 5 years in the industry I have lost several aquaintances to vehicular manslaughter. What is it about a bike on the road that gets people in cars so freaking riled? You all do realise they have just as much a legal right to be there as you? You do not have some authority from on high to force them off the road or intimidate or threaten them with a 2-3 ton chunk of metal. If a cyclist wants to ride in the middle of the lane on a public road at 10 miles an hour, that's his legal right. If he's a dick, that's his right too. Idiot cyclists piss me off all the time, but I NEVER let it become personal. Just wait for an oportune moment, usually less than 30 seconds, and pass wide around them.

That would be impeding traffic in the eyes of the law. Bikers do not have a right to do that according to the law because they create a hazard for themselves and other motorists. In the link that Farty posted in another thread, it outlined the places in the Texas Traffic Code that pertained to bikes. Nowhere in there does it mention the fact that bikers have a right to do anything but use the sidewalk like every other pedestrian. They must remain as far right as possible and are subjected to the same laws on the roads that drivers are.
There is no special case for them...nor are there special rights.

Do you not read what you post? In the link that you posted that highlighted rider rights on Texas roadways, it made it expressly clear that bikers are to remain as far right as possible on any roadway so as not to impede traffic. They have no "special" rights granted to them just because they ride a bike.
Being a retired cop, you should know that.

maybe you and tex should read what the DMV says about slow moving vehicles. i have, a slow moving vehicle is NOT impeading traffic if they are going as fast as they can.
slow moving vehicle=farm tractor, construction equp.,bicycles, etc.

Dunno about Cherry Creek, Smoky Hill gets their behind handed to them every game though. I think our school slogan is "We'll be better next year".

A slow-moving vehicle must have a relfective triangle affixed to the back of the vehicle (to denote a slow-moving vehicle) and must only use the farhest right lane. Vehicles that do not have this specific triangle (like bikes) can be cited for impeding traffic.
