They should have hit him harder, and on the head...while he was still in the store.

Robber Sues Victims After They Beat Him
ROCHESTER, N.Y. (AP) -- A man is suing an auto-parts store for assault and battery after he attempted to hold up the business and employees responded by beating him with a metal pipe.
Dana Buckman, 46, walked into an auto shop brandishing a semiautomatic pistol last summer, only to have it turned on him by two AutoZone employees, police said. The men beat Buckman with a metal pipe and held him with his own gun.
Buckman escaped and was arrested a week later.
He pleaded guilty to first-degree robbery and was sentenced to 18 years in prison as a repeat violent felon.
Buckman claims the men chased him out of the store and continued to beat him. He is suing the auto shop and the men for the injuries he suffered and for emotional distress.
"In some respects, you wonder if a case like this even needs a defense. It speaks for itself," said lawyer Patrick B. Naylon, who represents AutoZone and the employees.
But lawyer Phillip R. Hurwitz, who represents Buckman, said the employees crossed the line by pursuing Buckman and attacking him.
"The danger was past," Hurwitz said. "These two employees took it upon themselves to go after Mr. Buckman after he left the store."

This is a prime example of why we need serious judicial/legal system reform. In this case, the lawyer that filed the suit should be disbarred, for LIFE, and fined 10X the amount of the cost of filing the suit and the fees incurred by those being sued.

Were it up to me, I would like to see it legally permissible to chase and violently beat any perpetrator of a felony.
I.e., You stick up a liquor store, the employees get the right to chase your pimply butt down the street and beat you within an inch of your life.
Don't want to be scarred or maimed for life? Don't want to take a beating and walk with a limp?
Put down the gun and get a job.

There should be a counter suit by the employees of the store and EVERY patron inside against the guy that held it up and his lawyer that brought this suit. The lawyer bringing this suit should also be a defendant as he has the "deeper pockets" and is a party to the original suit. It makes as much sense as many of the suits holding entities not involved in a situation but are sued since they have deep pockets.
I agree that the lawyer (liar) bringing the suit for this guy should be disbarred for cluttering up an already strained legal system.

Living in a different world over here.
In finland a cop was sued AND convicted for shooting at a guy that try to over run him TWICE with a car.
Over here (Finland) it is quite possible that you get convicted for hitting some one that is breaking into youre house.
So if some one try to rob you when you are visiting Finland, be gentle ;)
Maybe all the stupid lawyers you throw into the sea, end up over here?

Assuming that these statements are true and not taken out of context, that is a real screwed up situation. Glad it's there and not here.
