Here in Southern Illinois, there is a cellular company called First Cellular. Apparently, they were bought out to Alltel. Today they started to shut down the first cell towers and are starting to leave a lot of people without phone service (the adjacent tower to mine is shut down). Rumor has it that the Alltel towers will use a different type of technology that will leave the current First Cell phones SOL since they arent compatable.
First Cellular has stated that if you lose your cell service, YOU STILL ARE UNDER CONTRACT AND HAVE TO PAY even though all the towers around you are no longer operational.
This will be getting interesting within the next few weeks

Time to break out the class action lawsuit.
A lesser but much wider-spread practiced perpetrated by cell phone companies has to do with the AC adaptors for their phones. Notice that every time you upgrade to the next generation cellphone, even if its from the same manufactoror, even the same family of phones, they've made minor changes to the plug hooking into your handset (LG does this the best, and without fail, every 5-6 months). When you get the new phone, which I do quite often because I break them quite often, I end up having to get a new adaptor for the car. It's cheap now, because you can buy just the plug itself, but it's an expense nonetheless, and perpetrated quite intentionally.

Radio shack I think sells all in one car chargers
Basically you pick the adapter that fits your phone and attach it to the charger.
For some reason my chargers die after about a year and ned to replace it anyway.
My Cell phone itself is now 3 years old and works fine.
So I see no ned to replace it.
I dont text message nor take pictures.
All I need is the phone to work when I want it to. and it usually does.
Cant tell ya how many people I know got new phones that ddint work as well as their old ones.
so I'll stay put tilll I have to replace it

Yeah, I got that all-in-one, Dred. The device is a great invention designed to remedy this idiotic problem created by the manufacturors. Funny thing is, this business practice is apparently actionable, and some Mass Torts lawyer out there actually signed up clients to go forth and collect. Didn't hear anything else about it. There's the legal concept of De Minimis, which states that some things are just to insignificant to bring to court as a criminal offense, but I have no idea how this applies to insignificant matters multiplied thousands or even millions of times over. There's no such thing as too small when it comes to recovering a compensation, of course.
De minimis or not, it's still de annoying.

If they are upgrading technology, they will probably offer you an upgrade phone with a contract extension. Went thru this a few years ago myself.

All they have to do is say "Well, there's cell service SOMEWHERE that works with your phone." If that doesn't work, then they'll invite you to find the part in the contract you signed that says they have to provide service near your home.

My name is Bob. Let me relate how I handled the situation with my wife, Debbie. When I took "early retirement" last year, it became necessary for Debbie to get a full-time job along with her part time job, both for extra income and for the health benefits that we needed. Shortly after she started working, I noticed she was beginning to show her age. I usually get home from the golf course about the same time she gets home from work. Although she knows how hungry I am, she almost always says she has to rest for half an hour or so before she starts dinner. I don't yell at her. Instead, I tell her to take her time and just wake me when she gets dinner on the table. I generally have lunch in the Men's Grill at the club so eating out is not reasonable. I'm ready for some home cooked grub when I hit that door.
She used t o do the dishes as soon as we finished eating. But now it's not unusual for them to sit on the table for several hours after dinner. I do what I can by diplomatically reminding her several times each evening that they won't clean themselves. I know she really appreciates this, as it does seem to motivate her to get them done before she goes to bed.
Another symptom of aging is complaining, I think. For example she will say that it is difficult for her to find time to pay the monthly bills during her lunch hour. But, boys, we take 'em for better or worse, so I just smile and offer encouragement. I tell her to stretch it out over two or even three days. That way she won't have to rush so much. I also remind her that missing lunch completely now and then wouldn't hurt her any (if you know what I mean). I like to think tact is one of my strong points.
When doing simple jobs, she seems to think she needs more rest periods. She had to take a break when she was only half finished mowing the yard. I try not to make a scene. I'm a fair man. I tell her to fix herself a nice, big, cold glass of freshly squeezed lemonade and just sit for a while. And, as long as she is making one for herself, she may as well make one for me
too.
I know that I probably look like a saint in the way I support Debbie. I'm not saying that showing this much consideration is easy. Many men will find it difficult. Some will find it impossible! Nobody knows better than I do how frustrating women get as they get older. However, guys, even if you just use a little more tact and less criticism of your aging wife because of this article, I will con sider that writing it was well worthwhile. After all, we are put on this earth to help each other.

EDITOR'S NOTE: Bob died suddenly on May 27th. The police report says that he was found with a Calloway extra long 50-inch Big Bertha Driver II golf club rammed up his ass, with only 2 inches of grip showing. His wife, Debbie, was arrested and charged with murder; however, the all-woman jury found her Not Guilty, accepting her defense that he accidentally sat down on
it.

I don't know if there is or isn't a clause like that but I do know that when I moved from North Texas to BFE californio I lived in one of the only holes on the map that didn't have cell service. As a result T-mobile terminated my contract free of charge.
You might look into that, alot of contracts state that if you can no longer get service within x amount of distance from your area you contract is null and void.

In short, no; what you outlined would not be legal under federal law.

I suspect T-Mobile terminated the contract as a courtesy, and the same will apply to this cell company. While they may be able to attempt to force you to continue paying, it's likely that they'll be magnanimous to avoid public embarasment.

Cingular wanted to shut down its old analog system that it aquired from AT&T but the FCC said no, that they would have to continue to provide the service until 2008. Is your phone an old analog? Contact the FCC.

Yeah but in the Cingular case, they had agreed as part of the deal to take over AT&T Wireless to maintain service for the AT&T existing customers.
I havent been able to find anything on the agreement between Alltel and First Cellular yet, but if it isnt spelled out in the deal that they have to maintain existing customers' service, then no court is going to force them to.
Alot of smaller, regional cell companies are folding recently because they cant afford to keep up with the advances in technology and give competitive pricing plans.
