Title: Any Family Practice Attorneys in here?

I have a specific problem.

My ex wife and I divorced each other in the state of Texas. We basically did it on our own. It was an amicable divorce and we devided our belongings the way we wanted to. The judge signed the divorce decree and it was filed in records. This happened in September of 2005.

My problem is this: I plan on marrying a Brasilian national in Brasil. To do so I need my divorce confirmed and approved by the Brasilian Superior Federal Court. I have sent everything they have requested and hired an attorney there to represent me. Everything was in order with one exception (isn't that always the case?) The Brasilian judge is requireing some sort of adenddum or sheet added to the document with verbage stating the divorce is final, what date, and that there is no further recourse.

I have contacted the records department for the county we filed in and were heard in and they said that other than the authenticity stamp they put on the decree there is no other verbage or addendum or whatever. They said the signing of the divorce decree by the judge was all that was needed and it was effective immediately on signing.

I'm at a loss. I either need to send a copy of the law that controls that or find some way to come up with what the Brasilian judge is asking for.

Any of you attorney types know anything about this? Any help or direction to take to get this would be greatly appreciated.

You could ask an attorney to simply write what you just said for confirmation and supply it as an affidavit to the divorce papers. Second option is to marry the girl in the US and bypass the entire situation.

Thank you Sikboy. I will do just that.

Maverick, I could marry her here and bypass all that until I moved down to Brasil at retirement at which point I would need to go through the whole process. She wants to be married there, with her family and friends around her.  I really would like her to have her wish, after all, a marriage ceremony is very important to a woman. Not that it isn't for a man, it's important to me too, but all her familial support is there, not here. I did like the idea of the affidavit though. Thanks for the input.

After you get married to this woman.
Is the plan to continue living in Brazil? orrr Are you planning on moving back to the USA?

She will be moving here to live with me after her retirement this comming August. When I retire, we will be moving down there. About 6 years from now. I think I may know where you are going with this but go ahead.

Ok I hope for your sake this isn't the case but I do hope you are aware of the practice that seems to take place more so with Brazilian women of marrying an American. Coming to the USA with him. then leaving him and taking everything he has with her?

I've known two people whom this happened to
Not real well but I knew them.

Both pretty much the same case.
Head down to Brazil every year for Vacation and hook up with the women down there.
"Fall in love" with one and truly believe they loved him too.

They get married and come back to the good ol USA.
She sticks around for a little while. then split. Taking as much as they could of his with them. In one case it was literally every last dime he had in the world. Literally...EVERYTHING.

Both cases the gentlemen in question were nearing retirement..
In Both cases the men obviously could not retire.

Your basic story seems familiar.

If your close to retirement. Why on earth do you need to get married?

Hell I don't understand why you would want to. But that's besides the point and a subject for another debate.

You certainly don't NEED to in this day and age.

Whatever you do. Keep your financial watermelon separate and secure no matter what.
Whatever you feel, and no matter whatever you believe she feels.

You are right. To be able to survive in this world no one really "needs" to be married. I am assuming, of course, that solitude, or loneliness isn't a problem for the individual. As you also pointed out that is a subject for another discussion.

I think I've mentioned that I grew up in Brasil. I was 2 when I went down there, 18 when I came back for good. In the summer of 1961 I was fourteen going on fifteen and I had my first real sweetheart. The girl of my dreams. She was 13 and would become 14 the following Janurary. We fell in love. Puppy love probably but interestingly enough I never forgot her and always had a special place in my heart for her all those years since then.

That is the young lady I plan on marrying. Each of us went about our personal lives over the years and we lost contact with each other. We had gone to school together and belonged to the same church and in fact my mother had been her sunday school teacher.

Her sister is married to a gent that lives in Alabama. Her sister, in fact her family, had been friends of my family over the years and kept in contact. One day her sister calls asking me for my email address. She sent me some pictures of a young lady that was nine months pregnant and asked me if I could guess who she was. Turns out she was my fiancee's youngest daughter and she was carrying my fiancee's first grandchild.

One thing led to another and I managed to get in touch with her again through an email. I had thought of it as an opportunity to practice my Portuguese since I had not used it since comming back to the US. That went along for a bit and we essentialy fell in love again.  We met again in Brasil at the end of 2005 and decided we wanted to be together again and this time for life.

Is it possible she just wants to take me for all I have? I suppose it is possible but I highly doubt it. Though we have been out of touch all these years, she is the same person, though more mature and lovely, that I remember when we were kids. She is a devout Christian, something that means a lot to me and not someone I just happen to have met down there on a vacation trip.

You are correct though, nothing of this world is guaranteed but I am willing to stake my whole life in an effort to make her happy for what's left of ours.

BTW not getting married doesnt have to mean lonliness or solitude in this day and age.
It just means your not married :)

Hello Mark and congradulations. I remember we discussed Brazil on here some time ago. I've got at least 40 trips to Brazil under my belt. The legal system down there can be a pain to deal with at times.

Have you tried contacting a local family court judge or maybe the clerk for such? Maybe a nice letter faxed describing what you are looking for might help. Or maybe just even call...

Has your girlfriend been here to visit?

I seem to remember running into a Brazilian lady about a year ago or so at a Home Depot here with a very similar story. I believe her boyfriend may have even been with her. They were shopping for blinds or something. Spoke Portuguese to her and she was surprised.

Yes, she has been here to visit. She has been in the US about 6 times previous to our engagement. Since then she has been here in Fort Worth twice and is due here again the beginning of April. She loves it here.

Good idea on contacting a local family court Judge or clerk. I need to find out how to contact them, perhaps I just need to go to the Court House and explain the situation.

I might have actually bumped into you all...hard to remember exactly though. I sure remember her telling the story about how they used to know each other in Brazil, etc. It was at some store somewhere...

The only Home Depot she has been in is on south I35 just south of Sycamore School Road. She doesn't leave home without me and she stays pretty glued to me most of the time. I think I would have remembered that.

Everyone of those woman that just in for money 100 times more in for long term. I remember back 15 years ago when Everyone said, " Rod Shes just after your money" I had company with 16 locations in 12 states. Was divorce from childhood sweetheart after 4 great girls. I decided I would raise my daughters worry about love if and only if girls could decide.
 I met A Romanian Girl who was attending Suny in my home town. Was I looking for wife not even close. Our first date was over 24 hrs long,she was and still is remarkable woman. Everyone of my employees and friends told every horror story about woman just out for money. If I had listen to these people my life never would've been complete. No prenuptial because if you need prenuptial then you shouldn't marry in first case.

 long story short My wife is now PhD (ex-gymnast  eat your heart out) I'm retired and I wouldn't change my entire life one bit. for if i didn't have first wife never would've met second, Our daughters and i mean our daughters treat her as if only mother they have had, She knows them better than I. and greatest thing She has done for me is my Son, (Clangjr) being 50 and having a 9 year old you would thing gets old fast but he keeps me young at heart.



 Love no matter what or with who is key to long life. Grandparents were married for 78 years until passing of my grandfather  age of 104 in a car crash. Like I have told my daughters Do not marry until you know its right one. I will support you no matter what he or she does for living or how they look, as long as you tell me they are the one in your heart. To quote Rod Stewart  " build a stairway to heaven with a prince or a vagabond" and I'll stand behind you....





 So if your sure beyond a doubt in your mind Go for it don't look back.



 remember American woman more out for money than any other woman in world, I'd be more afraid if she was American.

'Grats Mark, in advance. Seems like you found your soulmate along time ago, and then re-found her again. You look like a great couple. I hope she is not a nurse, because you might find your Harley days behind you! (My wife was a nurse when we married, and although she rode with me, she always had "stories" of the ER room of bikers that came in...so I sold it. She stopped telling those stories. ;) )
