"He said the free exchange of labor for compensation has been upheld as a right by the Supreme Court, but that doesn't necessarily make the compensation income.
If ever such an argument were to be presented widely, Cryer said, the income to the federal government would plummet. But not to worry, he said, the expenses could be reduced equally by eliminating programs, departments and agencies that also have no foundation in the Constitution."
What color is the sky in this guy's world?

You need to read further...
""The Founding Fathers intentionally restricted the taxing powers of the new federal government as a measure of restraint on its size. By exceeding that limited taxing authority the federal government has been able to obtain resources beyond its intended reach, and that money has enabled the federal government to exceed its authority," he said.
For example, he said, the Constitution does not empower the federal government to regulate education, or employment, and agriculture, yet it does so. "
The planet he is on is the one our founders walked on. It is unfortunate that we have let things get so out of hand. If I ever wished a lawyer success it would be this guy.
He won by contending that a business like walmart for instance... they get to deduct all the expenses out of their income before they get taxed.. Our labor is also an expense and belongs to us.. yet... we are taxed on every bit of money we are payed for it.
anyone who has ever worked knows that it takes a toll. That we are not having some party and loving going to work. It is our labor that we are getting paid on... there is no income... we are trading labor for money to live.
He contends that only investment or free money should be taxed. Interest income for instance...

the country would collapse. the govt would implement a VAT or the govt would tax business and business would increase the cost of goods and services. you are not getting around taxation nor should you
-
Not so quick Storch. You can't tax the company's right to freely choose to trade their labor!
:D
I have always thought that Taxes are legal extortion / theft. This is downright hilarious!
-
how do you fund the country? keep in mind those bureaucracies are staffed by fellow citizens who are gainfully employed and contribute to the economic centrifuge.
the formula we have works maybe not perfectly but it works.

you don't mean fund the country, you mean fund the huge bureaucracy that the govt has become.

after we kick all the illegals out, we'll need 20 million of fruit pickers to replace them. Win - win I say
-
How about they live within their means, like we do...
If there is not enough money, cut programs....like we do.....(don't make that purchase, you can't afford it!)
And, I am all for a massive shrinking of the government....going to the constitution and tearing down all unsupported institutions of the federal government would ROCK!
In any event - I am sick of them increasing their budgets... We should have a flat tax, and the government should trim to size to accomodate whatever income they have.

flat income tax, or sales tax on anything other than food and rent?

that sounds interesting but neither of those two things will ever occur. more likely what we will see is a common monetary system for north america and a further integration with our northern and southern neighbor an even bigger bureaucracy and more taxation for canadians and americans as we drag mexico into the modern era.

Investment can be taken to mean a trade too, applying the same logic. Someone gets the use of my money in return for some more later.

IMHO Storch may have it CORRECT!
Lookin at some of the information posted regarding what appears to be a North American Union, which seems to be some kind of answer to the EU?

it will go beyond that after my lifetime. I suspect my kids will see the greater antilles to be included in this co-prosperity sphere and any one of us afforded the opportunity to select where within this union we will live and work.
provided that global warming caused catastrophic flooding doesn't diminish north america into a series of islands that is.
(personally, I believe that the ocean conveyor will shut down ushering in another iceage making the carribbean the place where northern europeans will flock to and further mess up with their screwy ideas but don't tell hortland I typed this.)

storch... how do you stop runaway socialism from happening then? By your reasoning... They can tax more and more and more and grow government to any size so long as they have a program that it goes to... could be anything.
I am saying that they need to live within their means... I am saying that 90% of the programs the government are in are not ones that we need or that the constitution wanted them to start.
The very premis of taxation is that no tax is too much so long as there is one person making or having any more than any other person.
And if you do that then... you can limit peoples freedom since you are paying for everything they own and everything they are.
Nope.. the only way to limit government is to limit taxes.

Lazs et al.
at this juncture they only way would be revolution. as with most of us americans, I'm far too fat, dumb and prosperously happy to be involved in any revolutionary activities. the only issue which would cause me to rebel would be an attempt to take my firearms or my supply of ammunition. I tax myself and generously support the NRA to help insure our collective right and those of our progeny.
we have a system of government that is far better than any other out there, inspite of what the europeans think or type on this board.
on a personal level I make far too much of my income from homeland security mandated perimeter security and access control work at locations such as airline caterers, flower importers, exporters, customs bonded secure areas and other service providers for MIA, FTL, OPF, the port of miami and port everglades aside from direct work from the counties for me to be angry at taxes.
I gladly, joyfully, gleefully pay my full tax I don't fudge one bit and when I pay my tax quarterly I do so with a sense of priviledge and gratitude.
the majority of the money we are taxed comes back to us in one form or another. the best example is that the islamofacists are busy jihadding in iraq and afghanistan and not on our doorstep because our taxes are funding our all volunteer armed forces in these less than hospitable places. my taxes help fund the fight that our heroic young citizens are fronting in these far away places and I am saddened that my only participation can be with money. I wish I were twenty years younger.
the downward slide to socialism is inevitable. it began with the oyster bay roosevelt at the turn of the last century and once pandora's box was opened there was no way to close the lid. we will see socialized medicine, more entitlement programs and further erosion of our personal liberties and it will come about because the soft sheep in our society will vote it to be so. this in turn will mean further taxation on the individual.
you must understand that at the end of it all we will each bear a portion of the tax burden irrespective of how it's colored. if the income tax were to be abolished the same amount of taxation on us all will emerge with a different lable to replace it.
the only way to avoid taxation is to become an outlaw and rebel against the very society that brings you all the ease from with which you live. so no, I don't get it I don't understand how on the one hand you can accept the benefits of living in this society and then on the other hand refuse to pay your way. maybe you are like other segments of our society and expect a handout? a free ride at the expense of others?
face it we aren't the same group of people that founded the country and it's infantile to believe that any one us would be willing to endure the hardship of life those folks were subjected to in those times.
-
but storch... your taxes are going up every year.
Does that mean that 10 years ago you were taxed to little? Does that mean you will be happy no matter what they go to?
certainly everyone has a different idea of how big an intrusive they are willing to let the government get but...
If it grows every year... at some point everyone will be unhappy.
It is like our laws... we have so many that I doubt that even one of us can get through the day without breaking one or more. it is hardly possible... as government grows... so will the amount of laws broken every single day.
The 55 mph speed limit and prohibition are examples... people ignored the bad laws to the point that the government could do nothing but get rid of the laws... they could not enforce them.
That is the dirty little secret.. we are ruled only because we allow it... with the internet it will get harder and harder for them... people constantly post ways to get around their laws.

lazs,
I pay more in taxes today than I earned ten years ago. the more I pay in taxes = the more I've earned. my goal is to pay $200k in taxes one day.
you don't get it do you?
-
No.. you don't get it. I am not saying that you are paying more because you are earning more.
I am saying that you are paying more of your income every year. Why were you paying too little before? At what point will you be paying too much?
All of us are paying a higher percent of our income no matter what bracket we are in.
