As some of you may recall, I got married onFeb. 26th of this year in India to an Indian woman.
The last time I saw her was when we said goodbye at the Mumbai airport on March 9th. We do talk everyday though.
Once I got back to the US we talked to several lawyers and hired an immigration specialist in Austin, TX. After sending him the documentation I had brought back with me and then supplying some additional documentation that was needed (and involved sending a package to India that was then sent back to Austin) the I-130 (petition for green card for a foreign spouse) was submitted the first week of May. The Dept. of Homeland Security recived it the second week of May and on July 16th gave a receipt number for the I-130.
Once we had the receipt number the K-3 (petition to wait out the I-130 processing time in the US) was able to be filed, and was sent on July 24th. While the K-3 has a nominal processing time of 90 to 120 days the Dept. of Homeland Security was only working on K-3s filed in December of '06 as of mid-July.
We were hoping she could join me in the US in the September-November timeframe, but now January-March is looking more likely.
I am strongly considering writing a letter asking for help from Congresswoman Lynn Woolsey once we get a receipt number for the K-3 so that I can reference the case numbers.
All told, this is a very exasparating process. We knew it would take time, but this is dragging out longer than we were expecting.
We miss eachother and having our clocks 12.5 hours different makes it harder.
Anyways, just though I'd use the O' Club to vent a bit and maybe get some feedback/support.

Hang in there. My wife and I were on opposite clocks when I was in Korea for a year, and the extra effort it takes to talk or do some sort of contact every day is worth it.

Keep your chin up fella, it'll be worth it. Going through the same sort of process at the moment, only in reverse (as in my wifes american, I'm english)

Doing so, can jeopardize the process, and force you to start at square one. This almost happened to my buddy.
My best friend married his wife 2 years ago and she is still about 2 months from living here in Michigan. She was born in Hong Kong and lives in Windsor, Ontario. They have been yanked around for over 2 years.
Homeland Security is a joke when it comes to this sort of thing. Pre 9/11, there wasn't much to complicate the process.

Yeah, you can't muck about because if they find out they'll just stamp a perma-can-not-enter on her passport and that will be that.
Also, they don't give visas to people they think might stay in the US.
Her brother was just denied a UK visa for that reason. He doesn't own property in India yet and isn't married, but does have an education. They thought it too likely that he'd stay in the UK.

I'd recommend contacting an attorney who specializes in candidates coming over from India. There are various types of visa's, and they'll figure out which is best. Sheela Murthy comes to mind.
