Killed by a stray bullet from a Police officer trying to kill a snake in a tree.

NOBLE, Okla. (AP) - Officials in Noble say a 5-year-old boy was shot and killed by an apparent stray bullet fired by a police officer attempting to kill a snake.
Jack Tracy says he was fishing with his 5-year-old grandson -- Austin Haley -- yesterday evening when he saw the first shot hit the water near where they were standing. As he pulled his grandson to his side, he says a second shot hit the boy in the head.
Noble City Manager Bob Wade says police received a complaint last night from residents in a subdivision about a snake.
When officers responded, they decided to shoot the snake. A few minutes later, Wade says there was a commotion in a wooded area behind them where the boy apparently was hit by the stray bullet.
Austin was transported to an Oklahoma City hospital, where he was pronounced dead.
Wade refused to identify the officer suspected of firing the shots but says the officer has been placed on paid administrative leave pending the outcome of the investigation.

Yea I read that this morning. according to what I read, the snake was in a tree and the property owner wanted the snake out of the tree, so the officer figured it was a good idea to shoot up into the tree to kill the snake. Stupid people shouldnt carry firearms, ever,... an accident that just shouldnt have happened

Why call the police to get a snake out of a tree on private property?
At the most they should have called animal control.

Cop should lose his job for that one. Simple thing to do was use a stick or get a local kids pellet gun.

Terrible accidental tragedy.
Polar opposite of something I experienced.
Im working on a Church and the next yard over there is a playground with about 20 kids playing on it. Out of the corner of my eye I see somethign moving very strangely over by the property line.
so me being the nosy bastage I am go over to see what it is. I come across an obviously sick ground hog acting very strangely.
Didnt seem to be hurt but was obviously sick.
So I figure Ill do the right thing to protect the kids and call the police. who in turn connect me to Animal control.
I tell animal control abot the animal, and the close proximity of the kids.
They ask me if I have caught it.
I tell them "no. thats why Im calling you"
They tell me they wont do anything about it or come and get it unless I have it caught in a cage or trap.
So I explain to them about the kids again and tell them Im just wokring on the building and am concerned that if the kids come across it someone might get hurt.
Again they tell me that if I want them to do anything aobut it "I" have to catch it first.
So I respond by telling them they are about as useful to their township as teets on a bull and "What if I had a bear here? Am I supposed to catch that first too"
They told me to catch it first and then call them back and then they hung up on me.

stupid person + high powered firearm = problem.
Look at the snake thread. Why not use a shotgun anyway?

You should always check you backstop. He has NO excuse, the snake was not shooting back.

I'm increasingly of the opinion that we as a people seem to be almost falling over ourselves trying to abrogate the basic tasks of the individual away to the government.
If there's a snake on your property that you don't want, take care of it yourself.
If there's a possibly rabid animal that could threaten children, you should be able to grab a shovel or whatnot and fix it yourself.
We're being trained that we as individuals are less competent than the "they" in the phrase "they should do something about that".

This is proof that what seemed like a good idea at the time can have tragic consequences. You have to think about what you are doing and is it worth it.

When I took hunter safety class as a kid, rule number one was make sure you can see where the bullet will end up if you miss. If the buck is at the top of a hill and you can't see over the rise, don't take the shot.
The cop should have known better.

Negligent homicide or manslaughter2, it will be interesting to learn how the department and DA handles this.

Rule 7 - know your backstop.
You don't just shoot without knowing where the bullet is going....
Obviously, even a cop can screw up.

Sad... I feel for the parents no matter what the cop is charged with... I am sure he is horrified over this himself.

why use a stick if you own a gun.
this was a life threat so the officer used a gun.

I might have but the only thing I had handy at the time was a wet paintbrush and a 1" putty knife.
Neither of which I think would have had much effect.
But. one would think that a "department of animal control" would be willing to do just a bit more then pick up already caught animals

After my recent run in with "Government Officials", I'm not surprised at their willingness to do anything at all.

But.......here is the scenario played the other way around. He see's an obviously sick animal that may be a threat to children. He walks over with a shovel and brains the animal before anything can happen.
One of the children runs home to tell their parents that this strange man is killing something in the playground.
The cops arrive to interrogate him about why he was killing it and cite him for various minor charges.
Animal control shows up (at the behest of the police) to cite him for animal cruelty because he killed it without cause (he can't prove it had rabies) and because he used a shovel.
The Game Commision comes to cite him for hunting groundhog out of season, without an approved weapon, and in a public place.
The local media shows up, courtesy of the parents, to broadcast the story of a deranged man killing small animals in a park full of kids next to a church in an obvious satanic ritual.
PETA shows up to picket his house and rant about how this poor little fuzzy animal is a herbavour that has never done anyone any harm and how bad this man is.
He'll loose his job, a large amount of money, his chance at a hunting license, any public respect he had.....and all becuase he chose to do something. Other alternative is to look over, go "gee.....not my problem" and go right back to work. Thats what society expects of us:(
I'd have asked that person at Animal Control their name, and supervisor's name. Then I'd have informed them that I'll be watching patiently to see which child gets bitten first so that I can inform the parents of exactly who the government official was that refused to take action to protect their child from an obvious threat. Let AC pay for the rabies shots, among other things, from out of the lawsuit!

Are you shure thats what how it went?I thought the police shot a boy and seen a snake...or was it shooting at a boy and killed a snake who knows?:rolleyes:

The problem is most people now a days live in the cities or suburbs, walking outside your house with a gun to shoot an animal in your property will cause all kinds of issues. houses are so close together.
Cops are the only option they give now a days.

Anyone who would use a firearm in an area even remotely close to the public to kill a snake is a complete moron and should have never been allowed to carry one in the first place. Snakes are not a threat unless you accidentally step on one, ore are trying to play with one, otherwise if you want it dead, you kill it with a yard tool such as a shovel or hoe. This guy should be prosecuted!

The cop should have send in some cats to kill the snakes.
If that Neighborhood had more cats then this would not have been an issue

99 snakes out of a hundred one may run across are completely harmless, and an asset to wherever it lives---whenever wife sees a snake near the house she grabs it barehanded and chucks in onto our property (I guess they all get along?) Aside from that, I think the cop's riot gun would have been a better choice than the pistol

bad thing for everyone concerned. I have to agree with angus tho that he should have used a shotgun.
The chances of what happened really happening were extremely small.. it was in the end, an accident.. like all accidents it could have been prevented but there just wasn't that much risk.
I bet the poor guy will wish he had for the rest of his life..
the relatives of the poor child will never be the same either.. sad thing.
In the past... I have been out in the field and heard bullets strike nearby. I shot into a safe spot (bank or tree) in the direction the shooting was coming from and the shooting stopped. In one case I ended up running into the people who were shooting (with a poor backstop) and they were very embarassed. They were sighting in a rifle and were using a paper plate on a tree for a target with no other backstop.. my shots reminded them that they were not alone on the planet and made them remember their hunters safety training.
