Title: Aggravated Assault/ Some legal advice wanted/ I'M fine, but you should see the HIM!
Post by: Serenity on September 19, 2007, 11:16:02 AM
Alright, heres the background.

Last night, I was going to spend the night at my girlfriends house, and go to school with her in the morning. Well, I had to wait until her parents got home, (At 10:30) and I couldnt get a ride. So I had to take the bus. So, I grab my school bag for the next day and head down to the bus stop. At around 10:32(pm), I see these two big hawaiian guys walking towards me. Ive been in Hawaii long enough to know I was about to get mugged. So, as is my standard practice, I unzip the sleeve pocket of my leather jacket, remove the 5-inch thumb-assist knife I keep there, and move it to my side pocket for easy accesability. They get down there, and theyre acting friendly, but like I said, I know better. So with one hand on a knife and the other on my wallet I returned their small talk. Then, at around 10:34pm, it happened. He said "Nice to meet you", and shook my hand. I returned the hand shake, taking my hand off of my knife for a crucial second. As soon as our hands parted, he threw the first blow, connecting clearly with the right side of my face. Surprised me, as I wasnt expecting it QUITE then, but I wasn't hurt. In under a second I had my knife out, extended, and within centimeters of his throaght. I was ready to deliver a lethal blow, and would enjoy it SO much. But then my concience kicked in. "You want to get into the Air Force Academy! This MIGHT be self defence, but if it is considered excessive force, you will NEVER get in!" So, I retracted the knife, and attempted a retreat from the fight, knowing that while I would have NO problems leaving them both unconcious, I might just get annoyed enough to USE the knife. With the knife safely back in my pocket I made my retreat. As I attempted to, he put another blow to my face. Again, no pain. This guy was pretty stupid, he didnt realise that punching a guy in the cheeck would cause no pain, as it connects only with bone. I actually laughed in his face at this point, and again made a retreat. They thought to themselves "We've got a 15 year old, 140lb white kid here, late at night. Don't let him go, he should be EASY to take down". They were wrong. I looked over my left shoulder just in time to take a blow to the left cheeck, which knocked me forward over the railing in front of me. I realised I was now in a favorable position. With ever bit of strength I could muster, I launched my right foot back and connected solidly with his chest. Id swear I felt a rib crack, and he fell backwards over the bus stop bench and didnt get up. The second guy was just now joining the fight, and once more, I had my knife out, ready to strike. A quick slash to his throaght, and plunge it into his back... he'll be no concern and it will be so much fun! But once more, my concience kicked in. "Even if IT self-defense, you will still have killed two people" (If I had stabbed them, they WOULD die. Without question.) "And the Air Force Academy will STILL see that!" So, once more, I begrudgingly closed my blade and returned it to my pocket. I hopped over the afformentioned railing, and ran through a busy highway offramp to put some distance between me and them, just enough to call the police. I decided to trust the police to get there in time to apprehend the bast@rds. It didnt happen. The guy I kicked got up, and stumbled away, followed by his friend. On the way, they stopped to pickup my school bag, and my i-Pod, which I lost in the scuffle. I started to follow them, but realised if it came to blows again, it could be said I was following them with the intent to attack. So, I could only sit and watch as they escaped with my things.

In the end, the police have YET to find them, even though I gave a perfect description, and even one guys first name! They got away with my homework, (I'm serious!) and the Algebra II book I needed to study for a test today, as well as my i-Pod. Im fairly certain that guy cracked a rib, and I got out with a stiff neck, a busted blood vessle right next to my right eye, and a cut lip, but surprisingly absolutely NO pain.

So the question is: I KNOW you are going to tell me I did the right thing by simply exiting the area. But, would the airforce academy have looked down on me for killing two guys in self defense? If I HAD pursued them to see where they went, could I be brought up on aggravated assault, or some other charge if it came to blows again? Thanks.

You didn't need to kill them, only neuter them.  In the heat of the moment, things can go either way before you can do anything about it, but I think you probably could have managed to incapacitate them if you were more experienced.
Killing them was definitely not a reasonable alternative.

Oh, I KNOW I could have incapacitated them, in a heartbeat. But, I knew I would find myseld too tempted to kill them as it would be SO easy, and they hit me first, lol.

I'm not familiar with Hawaiian laws on assault and self-defense, but it sounds like you made all the correct decisions. You are safe and relatively unharmed.

One, bus stops at night are asking for it.  Two, when you saw them walking up, (you knew it was no good) then you should have made the exit right at that moment and went to a more populated and lit area.  Three, always take the exit rather than the fight when it is random violence you are up against.  Four, if you are in a situation where there is no out, then strike quick and with power to the vitals(throat and groin, or abdomen) with a sharp fist, this means to concentrate the force into just a couple of knuckles.  If you can connect in one of these three places properly, the fight is already over.  Five, NEVER, EVER, NEVER pull a weapon unless you need to kill with it.  If you reach the point at which a weapon is to be drawn, then the intent is to incapacitate the attackers, and should be done with stealth, force, and intensity.  Any hesitation when using a weapon more often than not, results in the holder of the weapon ending up on the wrong side!
In the end, you are still alive and safe so you did good.  Good luck!:aok

What I meant to say.  You should get yourself some mace, or shocker of some sort.  The knife is probably too effective in your hands for anything short of overwhelming force from someone trying to kill you.
I've personaly broken ribs with a front kick like you describe and the few times I've done it, the guy gave up.  A friend of mind dislocated some punk's knee and never had any legal trouble from it, although I wouldn't recommend the risk myself.  It's the sort of last resort you should opt for instead of a knife to the throat though, especialy if you're only up against muggers like those two.
As far as I could tell anyway, they weren't out to skin you alive.  Temper temper :)

In the end, ignore most everything said here.  But, if you want, you can ask the guy to stand still while you try to put some kung-fu death grip move from hell on him.  He probably won't stand still for you to try it though.

Remember, the motive for pulling a weapon is NEVER move to kill, or move to injure.  You are stopping the attack.  Whether you kill someone, or injure someone in the attack is irrelevant.  The goal is to get them to stop attacking you.  Anything else can get you in legal trouble, regardless of what is actually happening.

That and carrying a weapon as a minor.

Here in Ohio we have a concealed carry law...If I were in your shoes these two would be in the hospital with lead in them!!!
Also, Pulling a weapon does not mean you have to use it...It is a deterant that could save your life....if a bad guy sees a red dot on his chest...chances are he will run and you should run(as fast as you can) the other direction!!

Go to Charuto's school. Train ground skills.

Move to a state where you don't have to be a celeb to get a CHL.

Shoot first, and keep shooting until your clip is empty. Reload & repeat.

Dead men can't give their side of the story.

My BS-O-METER hasn't read this high since Voss was posting in this forum.

Furthermore, if this were a true story, you couldn't have handled it more poorly except for perhaps dropping your drawers and bending over.

I knew it.

Dammit Voss!

He's like a case of Chicken Pox, only he keeps coming back, again and again--which, I guess, would make him nothing like Chicken Pox at all.

Either way... Dammit!

Puny 15 year old kid, with a sore throat, fights off two large assailants while on his way to spend the night, with his girlfriend, at her house, while her parents are there....

Yea, it just reeks of truth.

Hey Voss, is that a scorpion in your pocket, or are you just happy to be back at the OClub?

It's not any one of the elements that I find to be implausible, it's the combination of the whole.

It's voss. If not Voss personally, then a disciple in spirit.

Ok, so he added a ton of self-promotion... Like you said he's a 15 yo typing on the internet.  I say you're jaded because you're comparing (what my gut says is most likely anyway) a kid's first adrenaline rush and the huge ego boost that follows to some full blown maniac like Voss.

See Moot, for me it's a very basic equation...

Would you rather be cynical, or gullible?

Personally, I'd rather be a cynic, and draw the line of plausibility somewhere outside of the story as presented above. That way, I risk not believing a narrow band of stories of questionable plausibility that wind up, against the odds, being true.

15 year old + 2 larger assailants + heroic victory over such assailants + young girlfriend waiting at home, WITH parents = Voss

Next week he'll be defusing a bomb at school

The week after he'll be admitted early to the Airforce

The week after that he'll be flying a mission to the Middle East to rescue his dad, with Lou Gosset Jr. as his wingman.

Cynic or gullible?  Neither.. that's like a choice between the dark side of the moon, and the dark side of the moon.
You're making a bigger deal out of this than it is, you're jumping the gun.  I don't see how the anecdote has to lead to the ones you're expecting, nor how telling it with as much hyperbole as he has is anything abnormal considering the source.
Write me off as agnostic.. until better evidence is available. In the mean time it's just a lot of speculation.

Moot, I'm also 85% kidding...

I don't care enough either way, and am bored enough that another energized Voss sighting/speculation in the O Club might just add an iota of happiness to this day.

I do think that it's ironic that  guy who calls himself Serenity is walking around with a concealed deadly weapon in his pocket.

The story seems plausible to me. The situation described happens every day of the week somewhere. Walter Mitties always add a little something too implausible which gives them away. Having said that the internet is full of good story tellers.

Having been in a similar situation at a similar age. My best defence was my ability to run fast. Unless surprised, it's still the best defence. The second best defence is to read the situation early and move off. Streetwise.

Two against one is usually no contest. Although I did fight off two kids who attacked me in the mistaken belief I had hit their friend. Very noble of them. I almost admired them in a way as I planted one with a swift kick and threw the other to the ground when he jumped on my back. In the exciting internet version. I finished them off with a few swift kicks and sent them on their way after forcing them to apologise for their mistake. In the real world I used the opportunity to run like hell until I made it to my back garden from which I lobbed rocks at them.

Pulling a knife only escalates things because it is very likely that they will have knives too or worse take it off you and turn the tables.  As for the gun suggestion. When fifteen year olds start carrying concealed guns. Then I will be very worried indeed:eek:

If it's true well done. If it's not, then good story.

This story, if it's true is certainly embelished, just like his stories of the "uber Spit 16", which by the way, we're still waiting for those films.

He was on his way to his buddy's house after school to watch some porn when he was jumped by a couple classmates.

He had his pepper spray on him, but he couldn't get it out in time.

LoL. Frickin' algebra thieves!:furious

I got jumped and mugged by a bunch of Mexican punks outside a bar once. I used the "I'm to drunk to know what's happening" defense that got me through the ordeal pretty well. Hey...WHAT THE HELL, HEY Stop that... Where'd they go...?

Later, after the rambling police report, I tried to use my heroic encounter combined with my obvious intoxication to hit on the two bisexual groupies that were at the bar watching my friend's band play. Alas, it was no joy.

One thing I have yet to hear mentioned is the law of porportionality.  That is that is you defense porportional to the attack.  In most cases two unarmed guys attack you and you use deadly force against them, you'd be explaining that to a jury of your peers.  Your response was not  porportional to the threat recieved.  I think you did the right thing here.  Yes they got away and that sucks but that's better than you being in jail right now on capital murder charges.

I addressed it with: "Furthermore, if this were a true story, you couldn't have handled it more poorly except for perhaps dropping your drawers and bending over."

I didn't get into specifics because, were this fantasy based on any truth,  the author made enough idiotic blunders that I didn't bother enumerating them.

edit: I am amazed at the ignorance/stupidity of those who said he made the right decisions or "good job".  Not referring to you Gunslinger, as I think you were referring only to the dummy's last second decision to refrain from using deadly force.

Thats 100% true. If you want, I will go down and request a copy of the police report filed. I dont know why, but I actually care what you folks think of me, and hearing all of you call me a liar... well, it hurts. Until then, the best I can do is give you some pictures of the injuries. Enough of you have seen my picture before to recognize it, so there  should be no problem authenticating. The camera seems to downplay the already barely noticable black eye, and dont ask how I got the cuts BEHIND my ear. My girlfriend noticed them today in school. Anyway, these guys werent the biggest in the world, as I said, only one threw the punches. The other stood back watching, and eventually grabbed my stuff when I ran like hell across the street to call the cops.

It's one thing to ask for advice, but to seek validation from an online forum?  You're getting into undeniable nerd territory.

Unplug from the internet, pick up surfing or windsurfing, something like that.  You have all those activities around you, and yet you get upset when people you've never met insult you?

Serenity, do you by any chance study martial arts?  Reason I ask is that kick you delivered to the mugger's ribs kinda sounds like a back kick.  Very powerful kick you can deliver with your back to an assailant with him coming in on you.  Grabbing a rail and kicking from this position would possibly work to get someone off you and could break ribs, etc.  Then get the heck out of there fast.  All that part sounds like you did the right thing.  Leaving before they got there would have been best.  Sometimes that's not an option though.

I'm using the term "you" now to refer to anyone. It may be possible you could get in trouble if you hurt these guys and it was discovered (if you were sued) you study martial arts.  I don't know.  I have heard that if more than one attacker is involved, you can use any force necessary to defend yourself, so if you did accidentally kill someone in that situation it seems a reasonable case of self defense.  There again if the kick or punch killed someone, that is different than pulling out a knife or gun and using that.  Your age would likely be taken into account and whether you were physically able to run or fight.

Anyway, now we know what a Hawaiian punch is.  Fortunately you weren't hurt.  At your age, if you left them unconscious and got the heck out of there, that would be understandable.  Dealing with two is different than dealing with one.  I would have gotten out of there asap.

That little bit of hesitation is very common, and is why he got the punch in on you.  This is not the time to think.  I'd say you did what you could after that without having to use the knife.  Good for you.

Hehe, I knew a fellow whose mom gave him a pistol to start carrying with him to school when he was 15.  She told him, This was for self protection to be carried all the time. She was a school teacher and knew what some high schools were like.  I don't think he ever carried it to school though.  He was too smart to do that and probably didn't have too anyway.

2 years Judo. I'm not real good at it though. I carry the knife for self protection myself, I'm a white guy in Hawaii, I'm used to getting jumped. But this is the first time I have actually lost something in the scuffle. Im normally able to hold them off, as I can take a hit a lot better than they expect, and I get the jump on them in the moment of surprise.

Neubob, get a life. If all you have to do is stock some kid around all day, you need a life. Collect stamps, get laid, anything. But you have too much time on your hands.

Sorry steve. I opted to press charges, so until it goes to court, its sealed tight. My parents cannot even get a copy of it. And seeing as I'm a minor, its 'privelaged', so even if it DOES go to court, it will be tough to get a copy of. I tried today to get a copy, and thats what I was told.

That story has so many embelished holes in it, you could use it as a colender to drain a pot of cooked pasta.

Any U.S. Military college will probably require one to go thru a psyhcological exam ... hopefully by the time you reach the age to enter the Air Force Academy ... you will have matured and stopped making up stories like this one.

You know Serenity prolly made this all up, but he is a kid, kids do stuff like that.

What’s really sad is the adults in this thread picking on a 14 year old. You would think they would act in a more mature manor, but I guess that’s to much to hope from some of these "adults".

So he should be rewarded for being a liar because he's only recently acquired pubes?

Bull****. I think that those of us who are busting his balls are doing him a service by treating him as an equal (which, I admit, may not be all that flattering).

Being a member here, while affording one the right to ridicule, also opens one up to any form of ridicule, at any time, for any reason. If that were not the case, I don't think many of the people here would bother staying members.

Also, it's 'manner', not 'manor'. Unless the 'mature' you were using as an adjective was describing a big spooky house with creaky floorboards.

See, Mash, herein lies Serenity's brilliance...

Already resigned to the fact that a mugging was inevitable, he concluded that his best chance to catch the dastardly scoundrels after the fact would be to get one of their fingerprints.

Viola!

Picking on someone?  This implies that any such criticism is unwarranted.

I guess in some nutjob societies it's ok to fabricate and lie simply because you are 14.  I've never been there, though.

Because, what if I was wrong? Often times I think the worst of people and follow stereotypes. Just because I had a gut feeling something bad was going to happen, doesnt mean i'm going to reject what on the surface is a friendly gesture.

Why did I take two blind side punches and still remember? When was the last time you've heard of a guy getting punched in the cheeck and forgetting things? Now, if they had aimed for my stomach, I have no doubt I would have dropped with the first punch, but again, he is stupid enough to punch SOLID BONE. Any idiot knows better than that!

And as to the lack of a police report: Are any of you police officers? Do you KNOW any? Ask them if the police would release a report of a crime against a minor, when the victim has opted to press charges, but before it has gone to trial. Unless Hawaii is a wack-job state in withholding this, I'm pretty sure this is what they would tell you will happen.

Oh, and by the way. I've provided pictures of the damages to support my claim. Can you offer ANY evidence whatsoever that this is a lie? Didn't think so. So be prepared to provide proof before you make these claims.

Under a second? You sure about the time elapsed here? Hand into pocket, grab knife, hand out of pocket, deploy knife blade?

"I was ready to deliver a lethal blow, and would enjoy it SO much. But then my concience kicked in."

A lethal blow, with a 5" blade? 'Just like that'? Where'd your proficiency come from exactly?

Why would you 'enjoy it so much'?

As for your conscience kicking in, you must be a wired-in-the-brain killer. In the midst of a 2-on-1, both guys bigger than you, both islanders (the rough-tough types are uniformly nasty), you with a deployed blade an inch from one of their throats (and he just stood there, huh? didn't jump back, jump and tackle you, etc.?), and some non-caveman-vs.-sabertooth higher brain function actually takes control of the show for a few seconds? Kid, you're a replicant. :)

"knowing that while I would have NO problems leaving them both unconcious"

The 'knowing' has me a little worried. Especially for a  2d year judo student.

"I might just get annoyed enough to USE the knife"

So your conscience has it under control when the knife is out, and you're all set to kill the dude, but you're worried that once it's back in your pocket, with both of them out of the fight, you might pull it again and get all chechen on their asses?

I'd say don't go USAF. I wouldn't want you dumping a 500 lb.'r on a bunch of dead jihaddis because they shot their AKs at your jet...while I'm busy poking around amongst them.

I mean I know Eagl is a whoopeeed Dyed-in-the-wool Killer, be he's a Professional and I don't think there's an ounce of chechen in him. :) (Heya Eagl :))

"Id swear I felt a rib crack"

Tell me, what exactly is the sensation of 'feeling a rib crack' when you kick a guy while you are wearing shoes?

"A quick slash to his throaght, and plunge it into his back... he'll be no concern and it will be so much fun!"

A quick slash...to his throat...with a 5" folder. A plunge into his back...with a 5" folder. Someone get on the phone with the knife design guys. They are putting a few un-needed extra inches on all those combat/fighting knives.

Again with the 'fun' comment. You are a genetic killer I guess. I know a guy who has had to actually kill someone with his hands within the last few years. He had over 100+ lbs. of muscle on his enemy (and that's a low-side guesstimate), far superior training, had been in combat numerous times before it happened, and when he was giving me the scoop, 'fun' was about the furthest thing from his tone of voice.

Ok, all slagging aside...you don't know me from Adam. And you're nowhere close to that POS voss. You're a kid who made up a story about a fight, to make you look like a badass. You're 15? No harm no foul.

I am worried about your attitude though. Let me explain why.

When I was 15-16, I gurantee I would have kicked your bellybutton 6 ways from Sunday. I fought full contact, had a very strong boxing background, I (thought) 'knew' I was good, and it felt good. I fought all the time - on the mats, and in the ring.

And then I ran across some real street kids, and did knock one of them out (which surprised them, because I was really drunk, and stupid because of it, and stumbled on them breaking the law, and was too f*cking clueless to read all the signs they gave me to "F*cking leave now, drunk stupid rich white boy"), and then the oldest of them did have a knife to my throat after I'd been tackled and pinned by 3 or 4 others...

AND

...they had me cold. My clueless non-streetwise friends had cleared the alley, had no clue I wasn't with them anymore, and the oldest of the street fighter kids (he was probably 22? We were all 17 and therefore invincible) had this knife to my throat, I was helpless, and he didn't kill me. Told the others "Let him go and let's get the f*ck outa here".

So take it from me, your attitude can get you killed. I had more skills, and more muscle to back mine up, and my attitude was more "I am a badass because I fight more than anyone I know and I do it well" as opposed to your "I need to make people think I am a badass" and I still wound up pinned with a knife to my throat in a dark space between buildings off of El Camino Real. I swear to the gods that guy is one of the top 3 people I'd like to meet again, because that's the only time in my life that someone hostile has had me 'dead to rights' and they basically opted to not kill me. I'd love to meet that guy and say 'thanks for showing mercy on my stupid dumb 17 years-old arrogant punk ass'. I'd buy him a case of beer a month for the rest of his life. No joke.

I'll tell you one other thing that will make you 100x the man at 15 that voss ever was - come clean. Just tell eveyrone it was B.S. and you're sorry. You're 15, nobody's gonna really bust your balls for it that bad, and in 3 or 4 years you're not going to know any of these guys anyways. But it will show character.

Trust me.

As for you guys making the voss comparisons - remember exactly what voss claimed. No comparison in my book.

Can't wait to try AH again once I get a life and a comp. setup to handle it.

-Mike/wulfie

I have VERY fast reflexes.

"I was ready to deliver a lethal blow, and would enjoy it SO much. But then my concience kicked in."

Id say having your wind-pipe sliced open has a tendency to be quite lethal.
Why would you 'enjoy it so much'?
Because when someone tries to cause me pain, I take a LOT of joy in delivering to them even MORE pain.

The SOB was too stupid to notice it. And as for my concience, I dont know why I took the time to think. I normally just react, and don't care about the consiquences. But, for some reason, this time I thought ahead to the results of my actions. Who knows, maybe its just a little maturity finally rearing its head.

"knowing that while I would have NO problems leaving them both unconcious"

The 'knowing' has me a little worried. Especially for a  2d year judo student.
They obviously had no clue how to fight. Thats what makes me so confident. Anyone unable to incapacitate someone smaller than them in two blind-side punches obviously doesnt know what he is doing.
"I might just get annoyed enough to USE the knife"

So your conscience has it under control when the knife is out, and you're all set to kill the dude, but you're worried that once it's back in your pocket, with both of them out of the fight, you might pull it again and get all chechen on their asses?
By that I meant if they continued attacking me. I have a nasty temper, I'll be the first to admit it.
I'd say don't go USAF. I wouldn't want you dumping a 500 lb.'r on a bunch of dead jihaddis because they shot their AKs at your jet...while I'm busy poking around amongst them.

"Id swear I felt a rib crack"

Tell me, what exactly is the sensation of 'feeling a rib crack' when you kick a guy while you are wearing shoes?
Um, what used to be a solid rib-cage giving way under your heel?
"A quick slash to his throaght, and plunge it into his back... he'll be no concern and it will be so much fun!"

A quick slash...to his throat...with a 5" folder. A plunge into his back...with a 5" folder. Someone get on the phone with the knife design guys. They are putting a few un-needed extra inches on all those combat/fighting knives.
Um, you can kill someone by stabbing them with a pencil if you do it just right. There isnt more than 5 inches of flesh between your skin and your spinal cord, nor is there more than 5 inches between your skin and your corroted artery. 5 inches is more than enough. Longer knives just mean you dont need to aim as carfully, they penetrate farther, and so you can cut into any part, not just those closest to the surface.
Like I said, I have a nasty temper. 15 years of being treated like nothing because of the color of my skin has given me a VERY nasty attitude. I can take verbal assaults, but if you want to make it physical, I WILL enjoy every blow, every cut, and every scrape I deliver to you.

I had more skills, and more muscle to back mine up, and my attitude was more "I am a badass because I fight more than anyone I know and I do it well" and I still wound up pinned with a knife to my throat in a dark space between buildings off of El Camino Real. I swear to the gods that guy is one of the top 3 people I'd like to meet again, because that's the only time in my life that someone hostile has had me 'dead to rights' and basically opted to not kill me.

I'd love to do that, but this isn't B.S. And I know my attitude will probably end me up in a very bad spot, and probably even killed. I'm more than aware of that. But my attitude isnt that I'm badass. I know I can be beaten, EASILY. But in this case, I wasn't the underdog. They were clueless idiots who expected an easy victim and were surprised. The only thing I have on the guys here is that I react quickly, and powerfully. I dont waste time bragging about how tough I am, I don't try to act tough. I'll put everything I have into it, and not waste time being cool about it. And, I just don't fear a lot of things. I know I'm going to get hurt. I'm not afraid of it. I know I'm going to die eventually, I'm not afraid of it. Again, if they get two good punches in and cannot even cause me the slightest pain, I KNOW ive got nothing to worry about.

Trust me.

As for you guys making the voss comparisons - remember exactly what voss claimed. No comparison in my book.

Can't wait to try AH again once I get a life and a comp. setup to handle it.

So, not only do you wear his shirt, but now you've co-opted his persona! Astounding.

Serenity doesn't get mugged... Serenity allows large men to handle him in a rough manner because he's THAT comfortable with his masculinity.

You haven't taken this oath yet but I'm sure you know it's significance.

Yes, and I have yet to lie. I'm still waiting for a shred of solid evidence other than Bob's speculations showing that I am lieing. And bob, I didnt say I allowed it. I just said I wasnt afraid of them, because they OBVIOUSLY couldnt hurt me.

And Steve. When the police take a report, they ask "If the criminals are caught, do you want to press charges?". They ask, because sometimes people don't want to go thrugh the work of actually pressing charges. I said "Yes, I do want to press charges". Them asking this question doesnt require the criminals to be caught first. In fact, there is a segment ON the police report asking if you would be willing to press charges.

Let me help you for the sake of future lying.  If anyone who knows even remotely how to deliver a blow punches you in the cheekbone"blindside", you'd most likely  be concussed and have broken  facial bones to go with it.  You need to get over your "solid bone fantasy"

Oh ya, about that solid bone fantasy. The Zyogmatic, or cheek bone, is actually perforated to allow for the passage of nerve/vessels.

Well since you asked, and you "knew" you were going to be mugged: The only intelligent first move, since you had no-one else to protect, would have been to retreat/do your best to avoid the confrontation. Your failure to avoid the conflict was your first of several foolish moves in your fictional story.

Did I not say he obviously had no idea what he was doing? While the cheeck may be perforated, it puts up a lot more resistance than say, the gut. Theres no part of the human body impervious to damage, but I'd say the cheeck is pretty solid compared to the rest of your body.

yes but you're fictional story has so many irregularities.  for instance, you expect us to believe that a guy continued to throw punches at you after you put a knife to his throat.

Well, I had somewhere to be. Now, it would have been inteligent to leave and return home, but the next bus wouldn't come for over an hour, and I didnt fancy spending the night at home. And once more, what if I was wrong? They were showing no OUTWARD signs. I had a gut feeling, but the one that knocked me was being perfectly nice, so while I didnt let my guard down, I also didnt see a reason to inconvinience myself unless I started to notice some hostile act.

Other than being a dumb thing to do?  You don't shake strangers' hands.  You don't accept candy from them either.

Seriously unless I'm expecting to meet someone or am being formally introduced I'm not shaking your hand.  You will get a head nod, a "how's it goin?" or at least an adknowledgement that you exist via eye contact.  I won't be touching you.  I won't be letting you touch me.

A little judgement goes a long way and also since it's been done to death on internet BBs' it is not our job to prove your story.  It's yours if you don't want to be put under the microscope.  These things can be tracked and researched.  If it happened it happened but your overglorification of your story puts it closer to the BS bin.  Just the thought of some skinny kid going up against a couple big hawaiian dudes and winning makes me giggle a bit.

Only one punched me. The other was 4 feet away, so I wouldn't consider him an immidiate threat. He was hanging back, so I wasn't worried about him.

As to the knife, once more, he didnt notice. The time elapsed between my pulling the kife, and thinking better and putting it away was mere seconds. This wasn't a prolonged struggle, after all, it consisted of my taking only 3 punches.

Well, ive been raised differently than that. If someone attempts to shake your hand in a friendly gesture, you return it. Thats just how I was raised. I wouldnt take candy from him, but if he offers a handshake, I return it.

I'm not asking you to prove my story, but if you want to insist it's a lie, prove it is. If you just dont beleive it, then say you dont beleive it. But unless you can PROVE its a lie, dont come calling me a liar and telling everyone else to take it as a lie. I never said I won. I just didnt lose. I would call it a draw, as I walked away unharmed, but lost a few posessions.

I'm sorry.   I'm 34, and if "your gut tells you something is askew", you should listen to it.   I took 20+ punches to the face my senior year of HS in 1991.     When I came to, he had two split lips, cuts on both cheeks and a left eye shiner.   I had a couple of light bruises on my right cheek.   Yer preaching to the choir on this Serenity.    The kid was taunting and swearing at an Arabic kid that barely spoke English (he was actually a nice kid and was in 3 of my classes) and did not understand what the dolt was saying.   This went on for a couple of weeks and I had enough.

If I'm walking alone at the age of 34 and someone stranger just happens to want a "handshake".    Um, red flags are going up.    You got sucker punched, bone or not.

Ouch, 20+ to the face? Okay, that WILL hurt, lol.

Yeah, red flags were up, but as I said, I was raised differently. For the most part, the people out here are REALLY friendly. Its nothing like the mainland. Just about everyone out here is related somehow, and if someone comes up and starts a friendly conversation, and shakes your hand saying "Have a good night", you return the handshake. Up until the sucker-punch (Yeah, I know I got sucker punched) they were real polite, so I saw no reason to be the impolite one and refuse it. Now, I still had the red flags in my head, but until they justified it, I thought I might as well. I was wrong, and it was stupid to shake his hand, but at the time it seemed perfectly logical.

While my friends are a little on the zany side, I doubt they'd consent to knock you on your arse without a safety net.  :aok

Although, if they read this thread and see what a goob you are, they might change their mind. I'll see what I can do.  :)

This is quite possibly the most ignorant post that I have EVER seen on the BBS.   There are some doosies, but this one takes it.

I'm no Med student.    But, using the cranium sometimes has an advantage.   But you are off of your rocker if you think the "zygoma" will not break (either the guy was "big, but a pansy" or he glanced it).   It helps hold your eyeball in the socket.    You need to shelve the bravado Serenity.   My prediction, you haven't learned a thing from this past encounter.

If you think you are "impressing" us, you are incorrect.   Most of us are older, and were involved in worse situations.

Like I said, until this goes to trial, (Which it won't, because they really didnt bother looking for the guys) the police won't release the report.

And mac, you just crossed the line. Say anything you want about me, but leave my girlfriend out of it. If you had an ounce of maturity in you you would keep this to the subject at hand. But you dont.

I'm not trying to impress you. I'm just saying, I have NEVER been hurt by a blow to the face. So either they just arent punching hard enough, or theyre hitting the wrong spot or something, but ive never been hurt by it.

Police will release a copy of a report to a victim, even a juvenile. They routinely release them to the press just with the ID blacked out. The basic info is still visible regarding the basics of the situation other than the ID of the juvie. The parents of the juvie can get a copy as well since they are the guardians of the victim. Basic simple procedure.

I'm not trying at all, to brag about that fight.   I stuck up for someone who was oblivious of the situation and the "ignorantee" paid in spades for it.   The Principal lightened my Suspension when other student's stood up and approached him at what had been happening.

I hope you have enough Common Sense to NOT do this again.   Yer 15, you think you know everything, but you don't.   We were all that age once.

In the future, if it's dark, and the same situation appears.    1.) Get yer exit avenue noted.   2.) maintain distance while being friendly.   3.) don't shake hands with someone you don't know, with little public around.   By giving him your hand, you are now on the defensive for as long as he sees fit.    My uncle taught me some Aikido when I was younger and I have used in the past.   I haven't been in a fight since that one.   Only time I would ever now, is if my family's life/friend depended on it.

Wrong spot.

1.)  Zygoma.    I know folks who took awhile to heal this one and it hurts every time you blink in some cases.

2.) Mandible (Lower Jaw).   Another doosie.   These hurt because your jaw is out of place, and now needs to be re-set.   This one hurts like a MF'er because you need Food and Water.

Only broken bone I have ever had was when I was 1.5 years old.   I broke my right collarbone.

I spoke to the PD down there. I spoke to Jenny in the records department just now.  You can reach her at  808-529-3111.

Jenny told me that they never give out copies of reports but that a person can obtain a verification letter, even if the victim/filer is a juvenile. She told me that there is no such thing a sealing a juvenile complaint.

So, you may want to just give it up.

I don't know if you're interested in this Serenity, but JKA is a good organization and many of the instructors teach at universities, so they're on the up and up.  I looked this up to see who in your area teaches Shotokan. 15 is the ideal age to start training.  Sounds to me like under your circumstances you need formal training for self defense purposes.

BTW, I believe your account but I think you were lucky the way it turned out.  Why others don't believe it I don't understand.  From what I read there was nothing all that unusual pertaining to the attack.  And the truth is, no one knows what they are going to do in a situation ahead of time. They are correct about the cheek bone though.  Bone breaks bone ya know.  It's a matter of which bone is stronger when bones collide.  That judo training helped you in this situation I believe.  Keep on training if you can.

Good for you, Serenity.   When I was about 18,  i had to hitchhike back and forth  to college.  i carried a dagger type knife around my neck on a leather thong.

i remember one time being waked up by a trucker telling me i was sleepng for 4 hours straight.

i remember fingering my blade and thinking... well duh.

It's not about solid bone. Doing soft tissue damage with a punch should be the last thing you're thinking about when you're defending your life.

What you should worry about is concussion to the cranium. Rattle the head well enough and your opponent will lose consciousness. The biggest risk about striking the jaw is that they guy you're hitting will be quick enough to roll away with it. Otherwise, the jaw is a perfectly good target to aim for.

Here's a little quote (not the best source, but at least in this case, factual)

"the button" (http://www.brisbanewingchun.com/articles-ejnk_strategy.html)

"A well timed strike to the jaw either 'on the button' (chin) or to the side could be the equalizer in determining whether you are a victim or a survivor of a street encounter. Again, Hung Suen Wing Chun employs the strikes with the fist, palm or elbow to achieve this end result. The fist could encompass any rear cross or lead or rear hook or uppercut. The palm strike might be made with the heel or blade of the palm.  Even the elbow can be used to strike the jaw in several different ways including upward or horizontal. The Hung Suen Iron Palm hand conditioning training drills ensure that any well timed strike to the jaw puts your opponent `to sleep'."

Of course, your 2 years of judo would have taught you this concept... And if that didn't, a couple episodes of UFC  will.

Anyway, Serenity, you got out. These guys must have been really sloppy though, because a proper PUNCH in the cheek can easily knock you down and give you anice percussion. And your cheek is only inches away from the upper side of your head, where a good punch will send you to the dreamland.
A knife you should not carry, since you will not use it. How about a foot of 1/2" hosepipe in your bag instead. Excellent for crackingh ribs and armbones :D

Serenity, whether you made it up or not means jack to me, but what I can add that's worth posting here is that you should look into some proper martial arts training. You've got some ideas/habits that will get you in real trouble without fighting skills to match, if your character's what it seems like.

Serenity,

Go to the station with your parent and have them make the request. There is no reason to safeguard juvenile info since you already know who you are. I don't understand why you think this is so hard. It's not up to me to explain anything to HPD. You have parents they are responsible for you, I am not.

If it turns out that he is telling the truth then I will make this change:

Well I must say that this has been an entertaining thread. It appears that the story is non-fiction he should get a B- for it none the less.

Serenity you need to work on sentence structure, and flow if you want to improve that grade to an A.

I still think his story is fiction btw. It might have some grain of truth with a liberal amount of embelishment, but still fiction.

I don't know if the story is fiction or not.  What I'm saying is some folks sure don't mind jumping up and making declarations and trashing others without facts to go on.  If you are man enough to trash a mans character you should be man enough to admit you are wrong and set him right if the facts don't go your way.

You buying him dinner if he comes up with a police report?

I decided on butter popcorn and beer.

Actually it's a third choice. There has always been the possibility he did get into a fight or even beaten up. His pix sure don't show much in the way of injuries. Certainly nothing indicative of an extended combat even one on one much less 2v1. What went over the top was his "narrative" of the situation and all of his "descriptions" of what happened. We all know how easy it is to make claims over the internet, particularly when there are no witnesses or media.

This one reads more like creative writing vs reporting.

I would say it has potential as a screen play. Think about it.

He could cast Ben Afleck as Serenity, J-LO as his girlfriend. He could use the pair from Married with Children as her parents.

For the bad guys, he could use Mako for the one that hung back and Steven Segal for the guy he actually fought to a draw with.

This has OSCAR potential written all over it!

He could get the main "character" from Miami CSI as the Officer taking the report.

What do you think?

Just for grins I asked my wife to read the first post and give me her opinion regarding the story. She almost got a sprain rolling her eyes and described it with the phrase "geek with an over active imagination".

Holy sheet, I missed this until now.

From what I can gather, you've never been in a real fight in your life (yet, and you're 15, so that's no insult, etc.). You don't look to be too athletic (again, no insult, odds are physically you're going to be a lot different by the time you are 18-20).

Because of this, listen up for a second or two.

The 'cheek' is not all that solid. When you say 'gut', I'm assuming you're referring to the abdominals, and not a specific target like the solar plexus.

Unless your target is a complete fatass with zero conditioning, the 'gut' will take a hell of a lot more punishment (in the form of blows) than the 'cheek'. The 'gut' is composed of some serious muscle, and unless you hit someone there while they are sleeping, or totally unaware, the damage you do is going to be pretty limited.

'Solid' things can be broken, and if/when they are broken, they tend to cause all sorts of problems. Whatever they support/protect is now 'all f*cked up', and that causes other failures.

Also, as Steve Bailey pointed out - solid bone not protected by muscle a fairly thick layer of tissue can be a pretty good target. It often has nerves (that are 'unprotected') around it, blood vessels, etc. A simple harmless example would be to get one of your buddies to grab your shirt with 1 arm, that arm being extended. Put your thumb on the ribs right under the armpit of the extended arm. Jab those 'exposed, solid bone' ribs with your thumb and see what happens.

Then again, a 2d year Judo student should already know this.

And as for the broken bones causing all sorts of problems, another example might be "How did the guy whos ribcage you crushed with a kick" "get away". People with crushed ribcages don't run very well.

Go actually take Judo, and boxing as well. You'll get rid of some really dangerous delusions, you'll be more confident too. That's why I got into MA/boxing at a fairly young (very young for the era) age. I was getting picked on...a lot. I was getting into fights and could not hold my own.

He could get the main "character" from Miami CSI as the Officer taking the report.

What do you think?

Just for grins I asked my wife to read the first post and give me her opinion regarding the story. She almost got a sprain rolling her eyes and described it with the phrase "geek with an over active imagination".

There is a special hell for people who bring up that CSI Miami "actor".....

Here is what really happened (http://www.ebaumsworld.com/video/watch/38544/)

Just really couldn't resist.  Also, I'm a cop in NJ, and I'm not really completely familiar with the law in Hawaii. The reason that police reports where the victim or the actor is a juvenile,  are not released or are released with redacted information is to protect the juvenile.  Doesn't really apply when the juvenile in question is the victim and is the one seeking a copy of the report.

Sorry kid but your lil BIG MAN threats will overload yer hummingbird arse.

I laff in your face over crap like that.  You yourself over all the last past threads make her out to be a trailer skank.  Her parents allow you to spend the night over?  They bought you a T-Shirt with some sexual innuendo on it.

Thank GAWD my Daughters were brought up well and if some panty waste kid ever showed up at my door resembling a character of your nature, he'd leave with more than make up on his face.

So rant all you want, but don't threaten me behind your keyboard.

The only time I ever punched or used a lot of force in the heat of the moment, the other one had some doctor work to be done.
You are a 140 lbs teenager. Punching you into oblivian is no problem for a proper "puncher". So, if your story is true, ponder on it, feel lucky, and heed to the advices of seasoned AH players :D

What!!??
If they were truly out to mug you, he'd of never let go of your hand and just strong arm you into submission. Remember, you're just a 15 y.o. and rather small/light in stature compared to them. The other one would of been on you like glue as well.
To let you go would invite the possibility that you might be armed and allow you to grab your gun (they don't know you or what you might be carrying).

Guess what? You would still show swelling of the soft tissue covering your cheek 'solid-bone' area. You'd be feeling the pain from the swelling by the time you wrote the account the 'next morning'.

Wait a minute, what training have you had in knife fighting?
Why not cut the guy in the arm?
Even big guys don't like getting cut nor the resulting pain.
You took Judo, right?
Why didn't you just drop the first guy? Judo teaches throws, grappling, and submission.

Wait a minute...you bring a knife and get ready to use it, only in the middle of being attacked by two larger guys (remember you can't predict the future so you don't know what the second guy is going to do), you have the presence of mind to retract the blade and put it away??!!
Why didn't you just warn them by flashing the knife around and also warn them your prowess with your knife fighting skills and your Judo?
Remember the Air Force Academy!

LOL, in the middle of a fight, you're interested in putting your knife away?
You made your retreat? Where was this big guy attacking you at the time?
You call a time out?

Originally posted by Serenity Again, no pain. This guy was pretty stupid, he didnt realise that punching a guy in the cheeck would cause no pain, as it connects only with bone.

No, it connects with soft tissue supported by bone. No swelling or pain the next day?
LOL, you laughed in his face...in a middle of an attack...by yourself. RIIIIGGHHHTTT.
Where'd you learn that kicking prowess? Not from Judo.

Quote
Originally posted by Serenity The second guy was just now joining the fight, and once more, I had my knife out, ready to strike.

Wait a minute, in the middle of the second guy joining the attack, you were able to reach into your pocket, extend the blade (so he didn't see that too?), you have a conscience 'moment', you then closed the blade and returned it in your pocket...in the middle of an attack...and he didn't strike you?
What happened to your Judo training in all of this? Your 140 pound frame could throw both of them individually.

Ahh now we can see the possible motives for the 'event'.
1) Messing around and not finish your homework and study for your Algebra II test?
2) Maybe you and your girlfriend did something more than you should, and this is the cover story. (explains not doing your homework and test study)
3) You, like a lot of young ones, just made something up for 'acceptance' from the 'group'.

THAT would make sense the story and your not fessing up to it.  ;)

"This guy was pretty stupid, he didnt realise that punching a guy in the cheeck would cause no pain, as it connects only with bone"
kinda  bothered me.

A buddy of mine tangled with the wrong guy once and was punched in the face.

Shattered his cheek, and broke his eye socket.

One punch.  Fight over.

You trying to tell me THAT doesn't hurt?

(my take.  I bet this really did happen kinda.  I bet he got lightly smacked around by a few locals, and his stuff stolen.  The knife, the broken rib, all the rest is pure rubbish.)

Once again, kudos to all who have contributed to this masterpiece.  My only regret is that I did not have a video camera recording the arrival of every post in real-time so I could publish the entire thread to YouTube.

So, once more, My Precious begrudgingly closed My Precious blade and returned it to My Precious pocket. My Precious hopped over the afformentioned railing, and ran through a busy highway offramp to put some distance between me and them, just enough to call the police. My Precious decided to trust the police to get there in time to apprehend the bast@rds. It didnt happen. The guy My Precious kicked got up, and stumbled away, followed by his friend. On the way, they stopped to pickup My Precious school bag, and My Precious i-Pod, which My Precious lost in the scuffle. My Precious started to follow them, but realised if it came to blows again, it could be said My Precious was following them with the intent to attack. So, My Precious could only sit and watch as they escaped with My Precious things.

In the end, the police have YET to find them, even though My Precious gave a perfect description, and even one guys first name! They got away with My Precious homework, (I'm serious!) and the Algebra II book My Precious needed to study for a test today, as well as My Precious i-Pod. Im fairly certain that guy cracked a rib, and My Precious got out with a stiff neck, a busted blood vessle right next to My Precious right eye, and a cut lip, but surprisingly absolutely NO pain.

So the question is: My Precious KNOW you are going to tell me My Precious did the right thing by simply exiting the area. But, would the airforce academy have looked down on me for killing two guys in self defense? If My Precious HAD pursued them to see where they went, could My Precious be brought up on aggravated assault, or some other charge if it came to blows again? Thanks.

Serenety, don't leave if you truly love the game.  All we're trying to say is that you have obviosly exagerated during your story, your 15 no big deal.  We've all done it; after all I once caught a fish this big.  I'm sure we all feel bad that you lost your possesions; but if you be the bigger man and admit you exagerated you will find that our respect for you will increase.

Wow...some of you guys really spent alot of time on this...amazing. It's the weekend...don't you have honey-do lists or something?

Still, tho, the best part of this thread is AWMac calling Serenity (or anyone, for that matter) a liar. That made me laugh more than any other comment posted, and there were some funny ones. ;)

Also gonna need a nomination from someone higher up, I.E. state senator or governor to get in... Not sure 100% though.
And I don't think the AF will accept you with a felony charge... but there is always the Army.
As far as the story... oh well, he's happy in his world and I will leave him at that.

Man I fianlly got around to reading ALL of this.

OMG!!!!!!!! You just have to kinda love dumb kids these days don't ya??? If for nothing else the entertainment value.

2 blows to the check and it didn't even phase him. LOL yeah right.

I've been studying Muay Thai for 3 years now. I'm 35 years old 6ft tall and 230lbs. I took a shot to the jaw last year in class with gloves on and it dropped me to the mat. The guy I was sparring with pulled the punch too when he realized at the last possible moment I wasn't going to be able to block it. Rattled my world. I don't even remember hitting the mat. I do remember my instructor standing over me with the rest of the class asking if I was alright when I regained my senses. Woke up the next morning with a nice black eye and my jaw hurt like hell for 2-3 days.

That's reality and that was with gloves on. I don't care who you are....you take a shot to the face it's going to hurt.

Just admit you got you got punked, they stole your stuff. It was 2 on 1 and they were bigger than you. It's nothing to be ashamed of as long as you learned something from the experiance.

When this was first posted, it sounded like a bs story, so I didn't bother with it. But as it grew to ten pages I had to find out what was going on. It had gone to grown men calling police stations in hawaii to call the bluff of a 15 year old who is now being compared to voss.

I would say it was 5 minutes of my life that I will never get back, but the pineapple and cracker cartoon trumped the wasted time. Well done.
