If the republicans haven't "tort reformed" his state yet all he has to do is file a wrongful death action against her, it should be a slam dunk. He could then apply the alimony payments to the judgment.
I actually think the judge was right in this case, the prior alimony contract and the child's death really had nothing to do with each other.

See in my case it would be real easy. I wouldn't pay money to a dead person. If that was my kid and my ex killed him, she dead herself.
Somehow though I don't think we've heard the end of this case. He'll get it kicked up to a higher court and a judge with half a brain cell will agree with him. If the judge is really fair he'll also order his ex wife to pay him back child support for taking care of the other child while she was in prison and any outstanding debt he has will be cleared.

Someone has to play Devil's advocate here. Why did she kick the boy? A fight maybe? Little doubt the parent is at fault in some way when there is a physical altercation with a 14 year old offspring but the fatal injury could have easily been an accident.
