Saw this on a Railroad BBS.
"April 3, 2008
PHILADELPHIA - A judge upheld a $24 million award to two teenage trespassers who were severely burned when they touched overhead catenary while climbing on top of a freight car in Lancaster, Pa., the Associated Press reported. The jury assigned 70 percent of the blame to track owner Amtrak and the rest to Norfolk Southern.
U.S. District Judge Lawrence Stengel said it was unreasonable to leave the freight cars parked under catenary for four days in a populated area with power turned on and no warning signs posted. He also wrote that graffiti should have tipped Amtrak off that somebody was trespassing on the cars.
"If these boys had fallen off a ladder, … end of discussion," said plaintiff attorney Joseph Ruda. "But it's another thing to say that they should be electrocuted for climbing on top of a parked train."
Amtrak and NS intend to appeal the judge's decision."
These kids are getting money because they were tresspassing. why does that not make sense at all.

....
i'm.....just speechless....

Damned McDonald's couldn't keep a lid on a hot, scalding cup of coffee...
-
It's always someone elses fault.
-
This kind of crap just pi$$3$ me off to no end! I hate this lack of responsibility that is rampant. The defendant's ought to be able to counter sue in this case just because they've had to spend time with stupid people. :furious
-
This is a good argument for eugenics.
-
Time for that Tort Reform
Let's clamp down on those lawyers getting rich for polluting the courts with useless cases. (You know, like John Edwards, etc)

When the revolution comes, activist retard judges will be the first up against the wall.
-
Funny how it's always the lawyers that are first to go up against the wall in any good revolution isn't it
-
Someone should assassinate that judge with one of those huge 50 cal rifles.

Wow. Not only advocating the murder of a public official, but the specific modus operandi.
Perhaps he (she) could be impeached, or maybe the judge's position is one achieved by election.
-
What most of you seem to miss is that a jury awarded those criminals, (yes they are criminals) the 24 million dollars. The dumb donut judge just upheld their "award". So not only is the Judge a tool, but so are the twelve, eight or how ever many people sit on a civil case in PA.
It is evident that we make laws to protect the dumb ones, and I say that it is time that we let nature takes it course. Do we really want people like this procreating?
It is starting too look like the movie "idiocrocy" (sp) was more prophetic than comedic.

U.S. District Judge Lawrence Stengel another ignorant individual placed in a position where he can play God.
-
Sigh.... Darwinism failed here.
-
This is crap, and I can't believe the judge applied the law in this way. Is he saying that if there had never been a previous case of trespassing within a mile of this occurrence then Amtrak/NS would not have been at fault?
======================
Under Pennsylvania law, the duty owed by a possessor of land to a trespasser is to
refrain from willfully and wantonly injuring the trespasser.
In this case, the defendants intentionally parked the freight cars, intending to leave
them for several nights, under energized power lines. Furthermore, Amtrak knows of the
danger posed by humans coming in contact with catenary wires and trains their employees
accordingly. Amtrak also knows that the area within a mile in each direction of the site of
the accident had been trespassed sixty-nine (69) times during the three years before the
accident. Of these trespasses, at least thirty-three (33) involved juveniles, with at least
seventy-eight (78) juveniles mentioned. Although the defendants did not have a duty to
anticipate the plaintiffs trespassing onto the Amtrak right of way and climbing to the top
of the train, there is a genuine issue of material fact whether the act of parking the freight
cars on that particular tail track would lead a reasonable person to conclude that a high
probability of harm existed.

i am always amazed at how many stupid people there are in this world.
my little riding mower has warning stickers all over it, "don't do this, don't touch that", my big 60 year old IH farm tractor has no warning stickers at all, i guess people were smarter back then.
-
Guess they need to be more carefull picking the Jury. Getting dumb people is always a chance.
-
Calling it now ----> our continuing to reward dumb people for doing dumb things in our litigious society will lead to its end
-
Anyone know where I can find more of those trains....I could use extra 24 mil....
-
The funny thing is, they call these 'Frivolous' lawsuits. What's so frivolous about 24 million dollars?
The kids' parents' shoulda been made to foot the bill. What utter wastes' of breathable air.
-
Keep this in mind too, Amtrak is government funded. So who really payed the bill?

It looks like it shouldn't be too hard.
On Friday, May 29, 1981, the nation's press reported an $8.5 million settlement paid by Consolidated Rail Corporation (Conrail) for a sixteen year old San Jose boy, Steven Throop.
Thirteen year old Steven suffered severe electrical burns on July 4, 1978 when he climbed upon a boxcar parked on Conrail's mainline in Washington, D.C. The accident happened within yards of the National Air and Space Museum and the Smithsonian Institute.
Accidents like Steve Throop's are not new to Conrail, a quasi-federal corporation created to handle freight by the authority of the Regional Rail Reorganization Act of 1973.
On average, 24 deaths/major injuries per year have been suffered by children as a result of Conrail's overhead electrical catenary system and the failure of the Federal Railroad Administration to demand appropriate warnings and fencing systems.
-
warning signs can't stop stupidity.
-
Pretty soon folks who make power tools like drills etc, will not supply a power cord due to the risk of someone wandering into a pool of water. "Power cord not included do to risk of injury or death. Plugging in this device is the sole risk of user."
-
I think we need to outlaw warning labels. It's time we cleaned out the genetic gene pool with some heavy chlorine.
If you're not smart enough to know that you don't grab onto electrical wires that feed trains... Not only will no help be given, but your family will be broadcasted publicly to humiliate them for raising a handsomehunk.
-
Shame they didn't hold on for a bit longer...

Yeah. They should have just voted Hitler out too.

QFT!
donkey
You guys hear of the one where a robber climbed up on the roof of a house in order to break in, fell through the roof and landed on a knife that the house owner had left out on the counter. He cut himself, and sued her and won! God I want in on the first shots on these dumbarnoldes.
-
We have enemies within as well as outside of our borders. Insane rulings by insane judges do nothing to progress our society. Why do you think the founding fathers made sure that we be allowed to have guns? To blast our government when it becomes too tyrannical.

Heard that one too...Always' thought it was an urban legend.
-
Yeah. They should have just voted Hitler out too.
Let's see... Hitler balanced with a U.S. District Judge.
a world war balanced with a stupid court decision.
60 million deaths, a racist holocaust, and world domination balanced with an appealable 24 million dollar award.
You're right.. your comparison is fair, just, and well thought out. You have convinced me that your point is valid.
-
ahhhh good to be 15 :devil

How about a person with the political power to affect millions of people making unjust and unfair decisions. Seeing the similarities yet?

I couldn't find it on snopes, it might just be true :)

Not one.
1st rule of losing arguments:
Be the first to bring up Hitler.
-
You are an excellent example of how subtle brainwashing can cause a person not to see huge social injustices.
-
'cos we all know that judges secretly wish they were Hitler right?
-

God help me I am a twisted SOB, but I hold a judge issuing a ruling that kills no one on a different scale of social injustice than someone who plans and executes the burning of Europe, the murder of 6 million people, and the enslavement of countless others, but thats just me.
