BATON ROUGE – Governor Bobby Jindal today signed the Sex Offender Chemical Castration Bill, SB 144, authorizing the castration of convicted sex offenders.

Governor Bobby Jindal said, “The Sex Offender Chemical Castration Bill is a good bill, and I am especially glad to sign it into Louisiana law today, on the same day the Supreme Court has made an atrocious ruling against our state’s ability to sentence those who sexually assault our children to the fullest extent. Those who prey on our children are among the very worst criminals imaginable.

“Not only as the Governor of this great state, but as a father of three children, I believe that sexually assaulting a child is one of the very worst crimes and I am glad we have taken such strong measures in Louisiana to put a stop to these monsters’ brutal acts. I want to send the message loud and clear – to the Supreme Court of the United States and beyond – make no mistake about it, if anyone wants to molest children and commit sexual assaults on kids they should not do so here in Louisiana. Here, we will do everything in our power to protect our children and we will not rest until justice is won and we have fully punished those who harm them.”

SB 144 by Senators Nick Gautreaux, Amedee, Dorsey, Duplessis and Mount provides that on a first conviction of aggravated rape, forcible rape, second degree sexual battery, aggravated incest, molestation of a juvenile when the victim is under the age of 13, or an aggravated crime against nature, the court may sentence the offender to undergo chemical castration. On a second conviction of the above listed crimes, the court is required to sentence the offender to undergo chemical castration. 

This bill also provides that a court may instead order a physical castration instead of the chemical castration. Convicted sex offenders who undergo castration must still serve their full sentence, as their treatment will not affect their sentencing. Under the bill, if a convicted sex offender fails to appear for their chemical castration, they will serve an additional sentence of three to five years.

In the recently concluded regular session of the legislature, Governor Jindal also supported the passage of SB 143 to prohibit a sex offender from wearing a mask, hood or disguise during holiday events and from distributing candy or other gifts on Halloween to persons under eighteen years of age; SB 517 which provides for the lifetime registration of sex offenders; SB 510 to double the minimum sentence for computer-aided solicitation of a minor; HB 770 to prohibit the use text messaging by sex offenders; and SB 514 to increase the minimum sentence for the molestation of a juvenile by five-fold.

I saw this on the news this afternoon. It's actually something that is controversial, yet I somewhat agree with. If someone is molesting children, I figure a fireingsquad would do just fine... I don't think congress would agree with me though.

I'd love to get into this topic.....but also understand kids read this board......so I can't get as deep into it as I would like.  I'll just say...it has a lot more to do with violence that it does sexual urges.  nevertheless....I wonder how much it will cost the state to do this......cuz I know this dominatrix in NY who.......... ah...nevermind.

I'm sure it's gonna cost a bunch. Though I wonder if it will actually stop or lower the number assualt victims in LA relative to the rest of the U.S......

Sexual Assault Numbers
In 2006, there were 272,350 victims of sexual assault.
Every 2 minutes, someone in the U.S. is sexually assaulted.

Seems we gotta keep the kids and young-adults informed to the dangers as much as possible nowadays.

If someone raped your kid would you really care?

Personaly I'd like to see child rapists have their "things" locked in a vice and smashed repeatedly with a roofing hammer until they fall off, then toss them in the general population of a maximum security prison for about 10 years to "think" about what they did.

I don't give two chits about their rights.

How is sexual assault not cruel and unusual?

Funny how our standards have changed.
200 years ago one of our common methods for obtaining information from someone was to tie them nude and sreadeagle to a tree attach a leather pouch to their genitals and slowly fill it with rocks.

Less then 200 years ago Hanging and whipping/flogging wasn't considered cruel or unusual
Less then 100 years ago electrocution, and making little rocks out of big rocks.
Less then a year ago it was argued that lethal injection was "cruel and unusual"

Seems the farther we go. the more mild the things are we consider cruel and unusual.

How much farther do we have to go when any punishment at all is considered cruel and unusual?

Personally I think Chemical Castration is less then adequate punishment.
Plus it takes all the fun our of castration by rusty butterknife.

That's why I thought cruel and unusual was a relative statement, not absolute.

from what i've seen/read
with rapists, sure. pedophiles its more about sex though.

depends on how hot the teacher is.

If shes really hot then castrate the boy for opening his mouth and ruining a good thing LOL

Good point... How effective do you think this law will be to the offenders in La? That's really why I posted this... I'd really like to see the budget on this bill to see if the Money spent on it, will be applicable to the drop in assault rates. Will it drop the rate in La? Will it do anything? I suppose time will tell.

Its not cruel punishment but it is unusual punishment. I doubt it will hold up under a constitutional challenge. Its really simple - life , no parole. Not excessive for preying on a child and not unusual. Yea, I know life without parole doesn't make headlines. The more creative sentences become, the more likely they will be tossed as unconstitutional. A lawyer SHOULD know this.

If someone commits a crime, chances are they have violated someones civil rights.
Now they want to whine about there own civil rights being violated?  Excuse me if I don't seem sympathetic.

If someone robs a bank, is not their right to own a gun taken away?
If someone hacks the pentagon, is not their right to own a computer often taken away?

Personally I think it would be more cost efficient to shoot the the sex offenders.

It may not prevent future offenders, but it sure does cut out the repeat offenders! :aok

Why when someone murders someone are they sentenced to 10 or 20 years? Are you saying the victims life is only worth 12 of the scumbags?
Are we still trying to pretend that we are rehabilitating the prisoners?

A new rule for parole boards or judges should be that upon the convicts release from jail.. the convict lives with the judge or parole board member for a minimum of 2 years.

After all, they are safe enough for my community, why not the fancy gated judges community?

On a personal level, I'm all for it.

I just don't see how this is ever going to survive a judicial review.
