Title: Lawsuit Challenges "Right to Link"
Post by: Saxman on February 17, 2009, 08:50:23 AM
http://www.slate.com/id/2210636

A major lawfirm sued a small start-up company for trademark infringement over the smaller company's use of links. The judge, who was overtly hostile to the defendants, disregarded multiple requests for dismissal, forcing the start-up to settle rather than face trial against a significantly larger and richer firm.

Never mind the "Free Speech" implications of the suit, but this is an absurd case of financial cyber-bullying.

Now I'll probably get sued for linking the Slate article.

Depends what they did with the links - if they were giving a 'service' using files hosted by an another company and without a separate agreement to do so, it might spell trouble.

Nope. It was just a link to the other company's site.

The argument was that it was "deceptive" and implied a relationship between the two companies.

I would think that they should ask first. I mean would you want a porno site linking to your church site.

Nah true christians want only violent, genocide and homicide sites linked to them to maintain true christian spirit. Same goes for muslims.

Nipples are a no-no.
