Title: Apple vs Gawker
Post by: Chalenge on April 26, 2010, 09:50:55 PM
I really thought this was a case of Apple publicity but it just turned very nasty today.

Gizmodo (Jason Chen in this case) computers seized by police:

I thought it was funny, didn't they ring apple initially and get denials? And apple have the phone back already?

Apple is the new Microsoft.

I have not read the entire story but I have heard accounts through the tech shows.

The way I have heard it told the person that found the prototype called Apple tech support (not a good way to handle it) and then tried to find someone that might pay well for it (worse). Gizmodo paid $5000 for it and then did a tech review almost as if it was an unboxing. It might seem to him like a golden egg but it seems creepy to almost autopsy a device that was acquired this way.

I think everyone went way too far and now Apple just looks bad... almost evil in fact.

I certainly disapprove of Apple's policy of vigorous concealment. However, Apple had every right to prosecute thieves.

Maybe so but I think seizing the computer breeches the first amendment because Gizmodo is an internet journalist. Pressing charges and arrest... okay... but seizing his jounalistic property is not so clear.

This is going to get interesting.

Wow the plot thickens with apple sitting on the REACT force, and also trying to raid someones house themselves LOL. Steve Jobs is making Bill Gates look like an angel.

Actually this is probably significant for the judge who signed the warrant since he's going to get sanctioned or worse. It is perfectly legal for a news source to acquire information "illegally" as long as they don't actually commit a crime themselves. Had they offered a reward or otherwise instigated an actual theft then they would be in harms way....but appellate level rulings in 9th circuit clearly protect 1st amendment rights under exactly the scenario at hand. Will be curious how seriously they slap the judge on this one.
