Title: Bill S.978 Getting Rid of Video game content Videos
Post by: stealth on July 04, 2011, 06:01:45 AM
Well since I'm just a kid and can't explain things very well to normal human beings just watch this.http://www.youtube.com/watch?v=ib7-vSrp6y8 (http://www.youtube.com/watch?v=ib7-vSrp6y8)

This Bill basically states that any video game shown on the Internet like Youtube. Would be illegal and be put in jail for 5 years or large sums of money. Yeah I know you don't understand so just watch these. That means basically all Aceshigh Videos would be torn down unless I contacted Hitech and got a document stating I could post AH videos on the internet. Same thing for any other Game Company's video games.

 What the bill Meanshttp://www.youtube.com/watch?v=ib7-vSrp6y8 (http://www.youtube.com/watch?v=ib7-vSrp6y8)

Another Video more descriptive of what it means.http://www.youtube.com/watch?v=hytigOSjJxc (http://www.youtube.com/watch?v=hytigOSjJxc)

The Billhttp://www.govtrack.us/congress/billtext.xpd?bill=s112-978 (http://www.govtrack.us/congress/billtext.xpd?bill=s112-978)

Act now against this Billhttp://act.demandprogress.org/letter/ten_strikes?akid=700.450896.5hVZPC&rd=1&t=1 (http://act.demandprogress.org/letter/ten_strikes?akid=700.450896.5hVZPC&rd=1&t=1)

Side Note:Thousands of Dollars if not millions are raised for charity by just doing COD or minecraft livestreams on youtube. Just imagine how much money will be taken away from charity communities

it would be a very simple fix really, for HTC, if they wanted to allow Aces High Player made videos to be posted on YouTube

just make a boiler plate document that the masses could download or have it automatically mailed to each of our accounts email address........ that is if this stuff ever comes to pass but I doubt it will

Just looks like it extends existing copyright infringement criminal codes to online content and not just physical things such as "phonographic records."

I see nothing in that bill that would punish fair use on sites like Youtube.  Section 506 of Title 17 specifically defines criminal activity as copyright infringement meant to generate profit (i.e. making pirate copies of CDs and selling them as "originals") or meant to financially hurt the copyright holder (i.e. making a bunch of CDs and distributing them for free in order to cause a competitor to lose sales).

All the bill does is extend those protections to online content rather than physical media.  Think targeting BitTorrent rather than Youtube.  I didn't see anywhere in the bill where people would have to receive "written permission" to use footage for noncommercial use; that feels like it's made up unless I missed something.

Just for information, although this targets the online community the interesting part is that it is nothing new and has been around since the 70's in various courts. Fact: Walt Disney, Universal, and others won a lawsuit which prohibited ALL recordable media. Their main target was Sony due to the Beta and the VHS of other companies. Although they initially lost the lawsuit in court the ruling was later overturned in US court and again overturned in the Supreme Court in 1984 thus paving the way for us to even have VHS, DVD's or any type of media recording including online arena. Thus for as long as Walt Disney was alive his movies filmed for the theater were never released on TV except for Cinderella which was released every 7 years on TV for each generation. Interestingly enough this all stemmed from Sony being able to advance technology to record media on a "Paper" tape since immediately following WWII metal was a very scarce commodity and wasn't allowed for use by Sony. Oh, and outfoxing our own

Second, read the First Amendment to the Constitution.

There is no need to get your Underoos in a bunch.  If this bill passes, which there is large doubt it will, the game studios will just change their EULA to allow the posting of these videos.  It is not in the best interest of game companies to support this bill.

ack-ack

This bill is more about positioning for future donations than it is about the actual bill. It has no chance but it really doesn't matter at this point.

Well I agree with Wrongway slightly. Just, because we don't think it's gonna come up as a law. Doesn't mean we shouldn't be consered. My family's a long line of lawyers and stuff and they basically know this won't happen. Plus youtube would loose, I don't know a couple billion dollars if this bill was to go up. It might go up just not the way it's worded right now. Plus watch one of the explaining videos, it awnsers all your questions that I've FAILED to state in the text.(I didn't Dis myself)

Plus I watch like 2 hours of youtube gaming videos a day. You know how much pain I would be in. Only thing left would be RayWilliam, Tobuscus, FreddiewW, FPSrussia and EpicMealtime.

One if these days i might ask permission to make my non-money making vids.
The only profit I get is the enjoyment of making them and sharing them with the community.
Perhaps if I got paid for them I'd be able to spend the money on Sony Vegas 10... :headscratch:

Just watched the explanation. It's not a First Amendment issue. They are making it a copyright issue. It seems aimed at TV and movies, and maybe videos, being uploaded and streamed on the internet.

Quite frankly, if not for streaming media uploaded by individuals I would not have discovered many bands or movies I have actually spent money on.

If they are so concerned about movies and tv on the internet they should make it a quality limit to get people to buy stuff. Low quality streamed, high quality if you buy it.
