I'm going to pull the trigger in a couple of weeks as soon as I'm done my research but wanted peoples opinion on either card?
I have budgeted around $400 for a new card (less is best) and I do play a lot of FPS (i.e. Battlefield 4) and I have been running nVidia cards for the past 7 years after a couple of bad Radeon cards and RMA's that said enough.
So, I have heard good things about the nVidia 970 but also that the 290 is a slightly cheaper and a good card as well.
What would you do?

EVGA or Gigabyte 970 and I would not even hesitate to look elsewhere.

The 970 blows the 290 away. AMD has a 290X, which is roughly on par with the 970, but it costs more than the 970.
At this point, I'd go for the 970, or wait for Nvidia to release the 8GB 970 and 980 Ti, which should drive the 4GB 970's price down slightly and by extension, the 290X's prices.

They are quite nice....I've yet to find a game I cant run full detail. DCS World is close, but it seems to be more of an issue with being CPU intensive (I have to do some testing to confirm). Keep in mind I run triple-screen, so I don't really get the full performance boost from SLI (for the games that really support SLI that is).
