Every time I run a patch it does fail for aceshigh9.exe
and gives that message. "Patched Failed for the following files:
"....\aceshigh9.exe"
It doesn't hurt anything but I thought I'd mention it.

It is hurting it. It means your DX9 version is not being updated. This is not something we have control over.
If you are running any anti-xxxx software, such as AVG, Avast, Norton, McAfee, and/or Kaspersky, they are all known to interfere with Aces High III, at one time or another and corrupt patches.
Also, if you are running the game off an SSD, then the SSD itself could corrupt the patch installation due to some SSD's having a firmware bug we happen to hit.

Oculus does not ship with directx9 version.

That's what I was thinking.
So, I was thinking Oculus version installer shouldn't ship with the error detection for the directx 9 version either and so I shouldn't be getting an error for the directx9 version and it should always fail to patch the directx9 version by design.
And really I should have posted this in the bug area and not the technical support area. My bad.

Yes, the DX11 version is the only one with VR support, but that has nothing to do with the patch failing on the DX9 version. Whatever is causing the actual failure of the patch could impact other aspects of the game.
