Specificly he said that file swapping software had legitimate uses and thus was legal, even if some people use it for illegal, copyright infringing, purposes just as some people use VCRs for illegal, copyright infringing, purposes.
In effect the companies producing file swapping software and law abiding customers of file swapping software cannot be punished jsut because there are some criminal uses for file swapping software.

That's true. But it's a bit hard to swap anything if the software makers are sued out of existence. Killing the software, would more or less win them the battle.
