Title: Fox News loses
Post by: Erlkonig on August 22, 2003, 05:44:38 PM
Haha, Fox News sucks.  This is a victory for all Americans who oppose frivolous lawsuits and the attempts of corporations to quash speech they don't like under the guise of protecting intellectual property.

http://www.cnn.com/2003/LAW/08/22/fox.franken/index.html

Quote
U.S. District Judge Denny Chin, after listening to about half an hour of oral arguments, said the lawsuit was "wholly without merit, both factually and legally."

...

"There is no likelihood of confusion as to the origin and sponsorship of the book ... or that consumers will be misled that Fox or Mr. O'Reilly are sponsors of the book," he said.

As for the trademarked phrase itself, Chin said that it was "unlikely a valid trademark. ... The mark is a weak one as trademarks go."

To the tune of "Love and Marrage"

Fair and balanced,
Fair and balanced.
Empty slogans, rabid views, and shrill rants.
Fox calls critics liars.
O'Reilly's filled with angst and ire.

Fair and balanced,
Fair and balanced.
Words that don't describe the Fox News talents.
Yet, Fox says it owns them.
Sued Penguin Books and wit Al Franken.

Try, try, try to criticize them.
Face litigation.
Try, try, try and you will only get
Big aggravation.

Fair and balanced,
Fair and balanced.
Words that don't describe the Fox News talents.
Don't you try to use them.
You can't say fair,
Not on a dare.
And balanced. Fox is on a mission.

Try, try, try to criticize them.
Face litigation.
Try, try, try and you will only get
Big aggravation.

Fair and balanced,
Fair and balanced.
Ranting righties spouting wingnut madness.
Truth is rarely heard there.
Opposing views,
Authentic news,
Dissenting voices -- Not on Fox air.

You got a be a genuine moron to have any compulsion to read frankens crap.   Unless you just like abusing your intellect and wasting your money but hey, your liberals and that pretty much paints the picture.

Actually I'm not a liberal, and I probably will purchase and read Franken's new book...though I might just check it out from my local library instead.  So, really, did Franken violate your sister or something?

Yes, we "morons" love to read and try to get all sides of an issue to help make an informed opinion.
Yeah, such a stupid thing to do to actually read books from those people/ideas we happen to disagree with

Franken's book will be a great bathroom read.  One  day, you may forget to check that you have toilet paper.  You'll be grateful you bought Franken's book then.

Yeager, you trying to say that your view is the only true view and no other view has any validity? That sounds a bit narrowminded. If you only look at 1 side of a subject you are not getting the full picture. I have not read any of Lies and the Lying Liars Who Tell Them, but I will guess from the title that it will be about the news media. Franken has been inside and around Washington news programs, writers, reporters, ect., enough that he has a perspective on how a story gets on air. I'm sure he has more experience than say, the average BBS poster. Wouldn't it be interesting to hear whats happening to the news before you hear it? If only a portion of Franken's book is actual, you get a broader view to form an opinion instead of being a lemming.

Heh  :)

And the pages also work great as kindling for the chimney fire if the book turns out to be awful.

If you think that reading frankens latest masterpiece is somehow going to give you a broader more informed view of the media and american politics then your pretty ignorant to begin with.

The guy is not brilliant, he is not even above average.  franken is a moron.

Did you read his book yet? So you *know* everything he is going to write?
Truth be told, I wasn't going to even read his book until Fox made such a big deal of it. Now, I'll probably pick up a copy to see what the fuss is about.
I haven't read any of his other books so I don't know him.
I won't make a comment on his book until I've read it though.
To do so I would be making ignorant comments of something I wouldn't (his writing content and style) know of.

How many Harvard degrees do you hold? You may not like his views, but you cannot question the validity of his education and credentials.

Harvard degrees are paid for.  You have the money and you get the degree.  Plenty of idiots have graduated from college.

If you go out and buy this guys book just to "see what the fuss is about" then you are being robbed by franken.  The guy has planned this whole scam out and anyone that buys this pulp fiction for any other reason other than cheap entertainment deserves to be ripped off (mostly liberals will buy this crap and you know the double irony wont be lost on franken).

The guys career has been floundering these past few years, deservedly so, and this whole fox suit affair was likely planned over cheap dinner with cheap wine as a lark that obviosuly has merit.  franken has found a way to get morons to buy his crap.

Franken comes from a middle class Minnesota family and had a straight "A" average in school prior to Harvard. He worked his way thru school, so if he had any money connections they were well hidden. So, by your account he is in cahoots with Fox? He talked them into suing him? Starting to sound like sour grapes.

yeager has a serious inferiority complex. no wonder he has to use someone else's name for a handle.

but seriously if you dont cover both sides you end up being an ignorant ****-tard. I force myself to watch fox news and cnn in an attempt to see both sides. I'll read transcripts from Rush and i'll read frankens book. dosnt mean ill agree with either. And yeager are you really that ignorant that you truely believe someone that came from a middle class family bought his way from havard.
If you do you need to get out more, date outside the family gene pool.

Allow me to clarify: In frankens case, it does not impress me.

By all means, higher education is absolutely preferred.  I just dont believe a harvard degree automatically exempts franken from being an idiot and moron.

Be honest could you really read the entire book?

Excerpt from 'Lies' (http://www.usatoday.com/life/books/excerpts/2003-08-21-lies_x.htm)
By Al Franken
Introduction

God chose me to write this book.

Just the fact that you are reading this is proof not just of God's existence, but also of His/Her/Its beneficence. That's right. I am not certain of God's precise gender. But I am certain that He/She/It chose me to write this book.

Title: Fox News loses
Post by: Chairboy on August 25, 2003, 09:40:00 PM
Additional excerpt:

"Look, God, I'm flattered, but I think you got the wrong guy. The kind of book you're talking about would require months of research."

And God said, "LET THERE BE GOOGLE. AND LET THERE BE LEXISNEXIS."

"Very funny, God. I use Google all the time."

"YES, I KNOW," God said. "FOR HOT ASIAN TEENS."

............. but I'm afraid I'm going to have to ask you to remove it.

Two reasons. First of all, that image is heavily copyrighted. The (former) lawyers for Fox tell me I have one heck of a case.

Secondly, we went through our files and we haven't received payment of the $12.99 membership dues to the Nash fanclub, entitling our members to the unique benefits including but not limited to the use of that image as your avatar. We're sorry. Have a nice day.

Yeager posted Nash's pic in his avatar?

Then, the thread degenerates into ad hominem attacks based on pictures?

Actually, what you missed was Yeager going on a post crazy rampage as he posted the same pic of Nash repeatedly with different "taglines".  For what purpose, who knows?  It was pretty obvious, though, that he had lost his mind...at least temporarily.

After coming to his senses, he deleted about 12 of his strange posts from this thread.
