State: Girls Gone Wild Filmed at Least 35 Minors in Panhandle

PANAMA CITY, Fla. (AP) - The "Girls Gone Wild" staff filmed at least 35 girls exposing themselves during spring break in the Panama City Beach area, prosecutors said.
State Attorney Jim Appleman also said during a hearing Wednesday that additional charges are possible against the producer of the videos, who was arrested in April on racketeering and drug charges after parents complained to police he told underage girls to say on camera that they were 18.
If convicted of all charges, producer Joe Francis could face 30 years in prison. Kiddie porn crime don't pay.
"We'll be able to prove our case," Appleman said during the hearing before Circuit Judge Michael Overstreet. Francis has maintained his innocence.
The video series that Francis created has made millions by filming college-age women revealing their breasts at parties and spring break sites.
Appleman said he is leery of turning over to the defense the tapes, which include the alleged minors performing sex acts, because it would be illegal for him to give contraband to anyone. Whoa, wait a minute. Did he just try to justify the secrecy of his evidence? How can the defense respond to the charges if they can't examine the evidence against them?
Defense attorney Jimmy Judkins argued that the tapes "contain a wealth of evidence that will exculpate Mr. Francis and will disprove the government allegation that Mantra Entertainment is a criminal enterprise."
Another defense attorney, Aaron Dyer of Los Angeles, asked that all "flashing" scenes on the tapes be declared legal. If all the scenes are legal, then there can't be a crime. Catch-22!
"It doesn't become child pornography when you're just dealing with nudity," Dyer said.
Overstreet rejected Appleman's argument, but will allow him to argue that the tapes are more obscene than similar materials accessible through retail outlets or online at a future hearing.
Francis' company, Mantra Films Inc., has disputed the charges, saying its crews always ask young women their age and film only those who say they are 18 or older.
The charges are based largely on about 175 hours of tapes Bay County sheriff's deputies seized during a raid at a condominium rented by the "Girls Gone Wild" staff. I've read somewhere that the GGW staff entices the girls with drinks, rides in limosines, and trips on the corporate jet.

I got a better idea. Put some movement sensors in the producers pants and show them videos with 16-year old girls taking their clothes off. If the sensor notices movement, immidiate execution would take place.
I would pass that test. Honest.

I for one am glad that any endeavor can be stifled through lawsuits! I think the constant barrage of lawyers taking people to court makes our country better.
All of you who support this suit, hurray! I really like the fact that this just reinforces the ideal that I can sue someone for doing something disrespectful like protesting something, looking at me a certain way, or even something as vile as disagreeing with me!

So let me get this straight.
This guy wanders around with a video camera. He finds parties.
At these parties are potentially underage girls, drinking illegaly, taking drugs illegally.
The girls expose themselves and say they're 18.
Later the parents complain that the girls were filmed illegally and therefore its kiddie porn.
Fine, if they prosecute him I hope each and every underage girl is also prosecuted for underage drinking and illegal drugs use. And that each and every parent is examined for their role in their childrens use of illegal drugs and underage alchohol consumption.
The real worry is, this guy only took piccies, what happened to those girls later in the party?

I took a trip to Cancun 2 years ago for my Birthday. I didn't even think about it being Spring Break. The stuff I saw happen at the GGW party had NUTHIN on what I saw at Coco Bongo and Senoir Frogs. What happens in Cancun stays in Cancun...thanks to Trojan.

How does that serve any justice? Why can people lie their ages and get away with it and is not even considered anything worth to mention in courtroom? The girl who lied her age should be prosecuted for fraud and possibly for staging a crime. What is the responsibility of underaged invidual to make others aware this important legal factor?

They are not adults so they have limited responsibilities. It is the responsibility of the adult to verify the minor's age.
Now, if they showed fake identification, screw 'em. There have been recent civil lawsuits where bar owners are suing underage drinkers who present fake indentification in order to recoup fines and court costs imposed on the bar owner.

Yes i understand if it would be 10 year old showing the tits and presenting to be 18 year old. I dont think ID is the crucial point, it should be considered as an spoken agreement, which is already considered as worthy as black on white in courtroom. Thats if you can prove that there was said agreement and in this case its on the tape. Were talking about tits here not some HC porn, in which every ID check should be absolutely necessary.
Its unfair to force regular people to check out things that in real life sudden situations just usually cant be checked, like ID. Visual age verification is ofcourse impossible, when 14 year olds wear makeup and dress like 19 year olds. This will be growing problem as digital cameras are very soon going to be everywhere and in everyones pocket.

I agree, but these weren't regular people. Joe Francis is the owner of a multi-million dollar video production company.
