homeowner assoc.'s suck.  and this is a particularly stupid issue for them to take a stand on.  


but you sign a contract when you move into an area with a homeowners assoc, basicly agreeing to take their rules as law.  
the guy signed a contract, he's screwed.

a contract is only as good as the courts say it is.

during the 91 war , i had a co-worker in the same situation, he hung a US flag outside his condo, the homeowner assoc told him to take it down, he told them to try and take it down. the homeowner assoc backed down and the flag stayed up.

"Condo Commandoes" are such a major pain there is even a seperate branch of law that deals with their pettiness.

I'd never buy anything with a Homeowner's Association. I want to be able to barbeque anything, anytime, I want to be able to work on my own car in my own driveway, I want to be able to let my grass get a little long, choose whatever color I want for my home, and fly any flag I want, whenever I want. Most of all, I want my home to be my castle. A place where I am King, a place where I can get rid of unwanted guests and their unwanted input by simpy saying: Get off my property.

Well face it this is Fla.They cant even vote right.This is also the state that wont allow you a teachers licence unless you speak fluent Spanish.Gotta be PC ya know......... I just hope that chunk of land breaks off and floats down to cuba.

Just a wild guess here, but something tells me this Judge is not a Republican, so I don't think that you can blame this one on the the Jebster.  Besides, she is elected not appointed.

Sounds like a bad deal for him and his flag.  If I were he, I would go paint a big bellybutton flag in the street in front of the president of the homeowners assoc. one night.

actually if you read the article more carefully, the city's ordinance allows a 21 foot pole.  they don't actualy say if the homeowners assoc allows any pole at all or exactly what their reg's are.

You need to get you facts straight before you spout off, speaking Spanish is not a requirement for a teaching license.

Yes, there was a voting problem but it was not a language problem. (how many languages do you speek). The problem was primarily one of age and understanding, this has been solved, how are you doing on your bigotry?

BTW scooter if you dont speak spanish as a teacher in Orlando, where I lived for 5 years,  you will find it hard to get a job. In some places impossible because most of the "students" in the area speak only spicaness...

Been to Texas or Cal lately, pardon me but you prejudice is showing. Having been in the education system and my first wife was and educator has allowed me to socialize in a group that has several teachers and professors. The statement that it is a requirement for a teacher’s license to speak Spanish is an outright lie and shows a profound lack of education itself. As an American your statement, I find offending, we have many from our state serving (Is I once did) and dying for this country in the milatary  and many come from a Spanish background.

 I am sorry you had a problem finding a job when you lived in Orlando as a teacher, and it is my hope you found a place where your intolerance toward others to be an asset. If you are still seeking work may I recommend perhaps employment in the prison system as you seem well suited and your "influence" would not do so much harm" I am glad you will not be "educating" any of our students.

By the way what tribe of Indian are you from? I assume your people have been here forever and your ancestors didn’t come from another country.

DrDrea my wife is a high school english teacher in Broward County Florida. It is not a requirement in Broward County or West Palm Beach County to speak fluent Spanish to get a teacher's license. It is also not a mandated from the Florida Government. However, in Dade County (Miami) while it is not a requirement they do prefer it and it gives you a leg up in getting hired over other teachers applying for a position who don't speak spanish.

Actually in the case of Dade County and its starting to be this way in Broward County .. more and more jobs (government and non) are listing it is as a preference for getting hired.

Im not an educator, I had to deal with the school system because my son was in the "system".

I have a brother who lives in Houston TX....... Yes I have been there......... I have also lived in Saudi Arabia and Tehran Iran....3 years in Saudi--2 years in Iran. While I lived there I made the effort to at least learn enough of the language to get around..

I dont like living in MY country where "only" 13.something% of the population is spanish speaking but a VAST amount of my "tax" money (and yes I'm a payer unlike around 8% of said pop) goes to government paper work that is in spanish.

Typical smucks throw around the "prejudice" word along with the "rascist" word anytime they feel they need to justify some lame reasoning.

 Thats like saying I should not tell the guy next door  to keep his dog out of my yard because he is crapping in it. I dont own a dog but by you reckoning it would be prejudice to tell him this.

I dont have anything against anyone coming to this country to live and work.... I'm in construction so a majority of the people I work with are latinos. I am not going to learn spanish so it is up to them to learn to speak the language of this country.

 By the laws of the federal government anyone in construction have to know "english", so by those laws anyone NOT speaking english should not be hired.

I find that most latinos are hard working and good people and dont mind living next to them. I want anyone to come to this country and have all the benefits that my forefathers and I  have worked for, by contributing to all the good and bad that this country is.

Ghostdancer is absolutely correct regarding language requirements for teachers in South Florida. ( to your wife Gd, for doing a difficult job)

The population is obviously far from being homogenious in South Florida, but if you want a semi-tropical environs and a warm ocean gateway to the Carribean, you have to give up the Main St. USA concept. Brown people are all over the place down here, and I don't mind.

Maybe I should'nt say this, but of the Cubans, Brazilians and other South Americans, the Haitians, Jamaicans and the other reggae curtain countries, the Asians, the Europeans, the New Yorkers and people from all over the USA, and all the rest, the only ones that get on my nerves regularly are the New Yorkers.

since when?  I've never heard of this law.  
I've had a few jobs where 3 of us where working in an area(2 working 1 fire-watch), and you hear the firewatch yelling in spanish at the rusian who's blowing his fire down on the guy who speaks english (me).

the upside is that when I worked the shipyards, I could say "get your own fluff'n tools" in about 4 or 5 languages

You better check the laws then bud --it was written while the hoover dam was being built, because  to many non-english speaking workers were getting killed. The law is still in force today, just not enforced.

Like I said when I tell someone to get their own tools they better understand english or they will get another job----I dont have time when I'm running a job or machine to teach it either...

I have a friend who is a RN in Orlando. She did home health care for years down there. The reason she quit was because of the attitude a lot of people have down there.
The final straw was from a clients daughter. My friend had gone to see one of her  elderly patients, this patient didnt not speak ANY english, even though she has lived in this country for 18 years. This clients daughter had to come to the clients house to translate for her mother. Apparently one day it was to much of an problem and she couldnt come. My friend had to leave without being able to understand what her patient was telling her. My friend saw anywhere 4 to 10 patients a day and couldnt wait for someone else to come and translate. The next time she went, the clients daughter got in my friends face and screamed at her that she didnt have time to come help her mother and why didnt my friend learn spanish. The daughter said it was my friends fault for not learning the language. What was really bad about it was that my friend had started taking spanish classes 2 weeks before this happened.  The next day she went to work and told them that she was not going on anymore HHC jobs and she would break in another RN... She gave them 2 weeks to find someone to take her place. She left without anyone taking her place because no one wanted the job.

Now because of the stupidity of one person how many were actually hurt? Several I am sure.


Very few of the latino community support the people learning to speak english. The main reason is the few that do can control the many that dont. I see it all the time, from the people that sell illegal SS cards to the ones that cash pay checks for a nice percentage.

These people are being taken advantage of more by their own ethnic groups than by any American and its stupid people that help them by saying someone shouldn't learn the english language..

My people are hired and payed a competitive wage, but they must be able to understand enough english to get  by. You might point a finger at me and say I'm prejudice because of the language restriction but rest assured, I am not contibuting to the problem, stupid people who say that about me are.

 When I go home at night I dont want the guilt of having someone get killed on my job because they didnt understand someone telling them to watch out or get out of the way. There are enough bodys buried under multi-million dollar projects without adding more from stupidity alone...........

While I agree with you in theory, in day to day Fact, there would not be a lot of construction done around here if everyone had to speak english.  Quite the opposite is true; if you want to have a supervisory role in the construction industry in Texas, you must know spanish.

It is an important issue.  

What rights did he sign away when he moved there?  What rights can Wal-mart make you sign away if you want to work there?  What rights can an HMO have you give up in a contract?  

You may disagree with the Judge, but his is actually a 'conservative' position on the issue.  Maybe you need to join the ACLU :)

I live in the southwest (AZ) and personally this is all a mess.

You speak of being racial to particular a culture, I say its patriotic.
This may not be so in other regions of the united states but in the regions of the southwest,south and southeast I ask you this,
"When are you going to take your country back?"

In example, The job market is nill in the Sw due to the amount of Illegal workers crossing the borders, they get paid below minimum wage but none the fact they take jobs and we are letting them. And who suffers? Americans do! citizens who cant find a job because Mr.Martinez will work under the table for 2 dollars less than minimum wage!

Now say someone sat at the desert border (non goverment conroled) with a rifle and took out anyone who tried to cross Illeally.What would happen? I'll tell you the goverment would prosocute them for murder. Why? Becase supposedly these people have rights...there is something wrong here..They have none they are not a citizen of this country and they have none! I'm a citizen and I have the right to happiness but I cant because the goverment is giving the same rights to the people who are not entitled to it, Just because the can run,swim or jump over the border!

Another thing to those who are here legally.What is this I hear about Bi-lingual education? How did they become a citizen if they can't speak english!? Last time I checked the prominet lanugage in american is english..and last time I checked the sw is a part of america. Give me one good reason why should we adapt to them?! They came here! We didnt go to mexico or wherever they may originate and said "Cmon to America you will like it here!" Now you see it everywhere everything in english has a spanish translation right next to it. Canada may like it that way but this is my country. Hey I got an Idea why dont we all go buy residents in Germany and complain and demand that our children be taught in english in THEIR school systems, that sounds like a grand idea!

We are being invaded for years now we have! and we have let it happen if it continues your children will tell their children(In spanish ofcourse) about a day long ago when we spoke english and was taught in it,That it was the majority spoken language in the desert. Yes, he is the problem, but do not forget, that when "Mr. Martinez" shimmied under the fence, rode in the secret compartment in the trunk, or walked / swam across the Rio Grande (take your pick) he broke the law, and is just as guilty.

I have no problem with who emmigrates to this country, but I do have a problem with illegals.  If you want to be here, either come legally or be fortunate enough to be born here.

As long as their are American businesses (or Senators for that matter ;) ) will to hire illegals for $2 an hour, there will always be those who harbor ill feelings towards our Friends from the South.  Point the finger at the American that hires them for they are too cheap to pay  minimum wage to those who are in this country legally.

I do not disagree with you, but like drugs they would not come here if there was no work for them.

Do you think they would walk, run crawl here just to starve?

We  the people in this country want cheap labor and that helps us make a buck. If no one would hire them with out proper INS papers I really think the problem would stop. If the laws for there hire were stiffer perhaps company’s would think twice. Just realize that costs would go up quite a bit especially in home construction. I run a home construction company and many of the subcontractors labor are illegal but people want cheap labor and the white boys here don't want to hot tar a roof in 100+ temps.

I see no real end to this any time soon.


By the way they are real good folks, with strong family values. I really enjoy trying to learn their language, they know mine much better then I speak theirs. I work with them almost every day but they work for my subcontractors, I really have no other options as there is no one else to do the work, and the make good money most average over 12 bucks an hour and up.

No one in the construction industry makes min. wage. in Fl. the demand for work is sky high and not enough bodes to fill the positions.

Everyone needs to remember that this has been a discussion in this country for over a hundred years.  Everytime a group has come to this country they have faced prejudice and have been given a hard time. Look at the all the european imigrants,  the far east, the indias and africa.  This country has always had imigration. The one thing that leveled the playing field for them all has been the fact that their children, at least, had to learn the language. In the latino culture though the attitude is that we need to learn spanish..... How many times has some looser congress person (usually of latin decent) tried to have the spanish language declared the national language of America?

3 times that I'm aware of........It came close the last time...It was attached as an amendment to a bill that was going to be passed. Thank goodness a few of our legislators still read the whole thing, they caught it in time and now there is a watchdog group keeping an eye out for these things. Guess I dont have to tell you which state it came from.

I personaly dont think shooting them all is the answer but having b-lingual teaching with my tax dollar is bull........If ya want to live in my country pay the taxes and learn the language.

If a private company wants to cater to a dual-language product thats fine, so is my right to not purchase said product whenever possible.

BTW if there is one ethnic group in this country that has a "right" to complain about anything though it is the American Indian.

Everybody else and their ethnic crap can "put" it somewhere else

Not Florida.  If your pro fly a flag in a HOA (home owners assc)and they have bylaws against such then your wrong...


You say that communist DoctorYo is loony..  well guess again...  this guy by purchasing his house apartment whatever, joined the homeowner association when he closed.. (his realestate agent should have explained this to him) and in doing such must abide by the rules/by laws set forth by such association.. or face civil law..

hence he waived his rights...

Now if the Homeowners assoc was smart they would have say at least 12-24 letters to this guy (1 per month) saying please abide by the by laws.  This moron most likely said screw you assoc(without doing his research) and go %%%% yourself... and in doing such is now facing the legally binding document the by laws...

Now my personal opinion is this case has gone too far; but at the same token if this guy has been hostile since 1999 then enough is enough I would sue him too..

As long as you can provide that you exhausted all other means to get this guy to comply then what other recourse do you have with him, nothing...legally that is..

take his money ... and recoupe the legal fees. I think its a viable tactic... (love muffin  wanted a fight and he got one, now hes losing and is venting to the press)

As usual the media doesn't do their research either and the article is biased for the moron... like his rights are being trampled on when he waived them..

The real losers in this story are the other HOA members caught in the middle, for they most likely foot the bill for legal fees upfront until dust has cleared..

I'm moving out of my condo because I am soooo sick and tired of a bunch of people who have nothing better to do than throw around the little weight they have because they are in a position of "power".

Just before the hurricane hit my wife had a bunch of her family staying with us.  There was so many people in the kitchen cooking non-stop in the summer that the kitchen was really hot.  We couldn't install one of those split a/c units because of the dimensions..so I bought a window a/c unit.

It took only two days for an e-mail to show up from the property manager pointing out the bye-law rule that states no window unit air conditioners.  I was told, in no uncertain terms, to remove it.

Ironically Geoffrey Bird, who will take ownership of the unit soon, checked into the total insured value of the whole development in his due diligence prior to the sales agreement and it turns out the whole development is way underinsured..thankfully the entire devlopment withstood Fabian...(cudos to Mr. Bird, who WAS the developer when they were built).

My point is this:

HOAs or condo boards are greatly concerned by the stupid small issues that crop up, such as this...but in many cases they omit to do the job well that they were elected to do in the first place.

Preventing an American from flying his country's flag on HIS property in HIS country is really, really pathetic and this HOA should be ashamed of themselves.

Just an update --the man won in court, the florida supreme court says that it is his right to fly an american on his property as long as it abides by local law. The court has decided that anyone can fly an american flag....To heck with the HOA.....

The problem has occured because the HOA in a petty way has decided to sue this man for court costs that the HOA incured during the trial. IMO they should not be awarded anything since they lost. Unfortunately the court did award the cost, around 25,000, to the HOA.....It will be appealed but his house will be sold on the 9th of October if a bond is not taken out at the courthouse. The man has a lot of "friends" now and I wouldnt worry about him losing his house, it wont happen. What the HOA has done is piss off several people who will now raise their own flags in the subdivision......WTG HOA lol



 The HOA as not brought into being to nit-pik people to death, the only reason there is and should be a HOA is to insure that property values arent lowered due to junk cars in the yard, lawns and yards not taken care of, buildings being built that shouldn't be there, businesses operating out of the home that induces to much traffic.
