Calloway would attempt to have that evidence suppressed for lack of probable cause, but was unsuccessful.

You...have...got...to...be... kidding...me.  Lack of probable cause???

I love how perps play the victim role.  Awesome.

You're kidding me, right? I would have thought they impounded the plane as a crime scene then scrubbed it clean after it was released.

BTW, I watched a dramatization of this flight a few weeks ago on National Geographic channel. It was much worse than the CVR makes it seem, if that's possible. The co-pilot was doing some extreeme aerobatics during the fight. That was after he had been whacked in the head with a claw hammer. Go NAVY!!

Keep in mind that the manuvers he was doing was with a plane that was fully loaded with cargo and fuel....truly amazing.

The plane was in service not long after the event.  I never really gave much thought as to why it wasn't impounded as a crime scene.

I worked at the Memphis hub at the time of the incident and that was a very dark day.  The theory was that his plan was to take control of the plane and crash it into the Memphis facility.  That would have been a massive blow to FedEx had that happened.
