I'm thinking that this case creates the breach in the wall..giving those who take it to court having less of a chance to win their cases as defendants.

Actually, this is completely incorrect.

"Thief" can be aplied in this situation, it's just a matter of what penalties are associated and how it is persued.

that Girls Mother did that totally wrong ..... they should of gotten a lawyer and let it go up thru the court system....
(different laws apply to a minor ect)

so the sleazy Riaa scares its 1st victim into an outta court settlement .

its the record industry's own fault anyhow ... hell they charge outrageous prices .... they knew the cd format media was gonna get copied ... they had there chance to set up a file sharing network (and were told to do so many times)

now they resort to 12 year olds and scare tactics...wow im impressed....

I think i'll go dl music from a international source... muhahahahaa

I know it was a civil lawsuit... I was being sarcastic. :p

If it was theft then criminal proceedings would surely be pursued - civil proceedings might come in addition to that.

Breach of copyright and theft are two entirely different things.

This is an important distinction... the girl's future ability to board planes in the US is at stake.

She is a thief though.  Whether the law defines it a such or not is another matter.  She took something without paying for it, and is therefor a thief.  Trust me, I'm a thief too, I know.
