I had something similar happen to me.  I caught it as soon as I got my credit card statement.  Someone had gotten my credit card number and expiration date and had set up a couple of adult websites using free Hotmail email IDs and a string of aliases (and various other folks' credit card numbers so that it became a tangled web trying to match IDs to emails).  The company that set up the website revoked access immediately and refunded the money to my credit card bank, but I went ahead and cancelled the account with the bank and got a new one issued just to be safe.

Bit of advice: pay cash for restaurant tabs.  Some of those food service workers have 2nd jobs, if you know what I mean.

Here's what I ALWAYS do when using a card. when they give you the slip to sign, find the CC # and ink out the last 4 digits AND the exp date. BOTH SIDES OF THE SLIP.. i ink the toejam out of it to the point the paper is ripped., F em.

sometimes the slip has an XXXX XXXX XXXX 1234 for the cc #.. I still X out the last 4. once the transaction is done THEY DONT NEED THE CC NUMBER ANY MORE in fact, if there is a problem there is always a reference number on the slip they can refer to.

 I get dirty looks from the empty headed cashiers.. screw them too.. I work in the industry.. you know where the old slips go? into the trash can in the alley.. you can't stop people from stealing #s.. but you can keep them from getting YOURS.

The alogorithem to check if a CC number is valid published, isn't it? (otherwise CC programs that check the number couldn't do the computation). I think it's actually very easy to check.

So just feeding lots random numbers to the check will quickly result in many numbers that pass any quick test. If such a number actually is used for a CC it won't be noticed until someone has to pay the bill.

I don't think spying is required to get a number...
