Heller decision tomorrow most likely

The Chief Justice has announced from the courtroom that the Court will issue all of its remaining opinions tomorrow at 10 a.m. Eastern.

That should mean Heller will be issued. Unless they decide not to do so; after all, they are the Supremes!

SC goat entrail watchers are now more certain that Scalia will write for the majority on Heller which means individual right. That will make me happy even knowing there is still much remaining to be done.

Toad, how do you keep such a close eye on the SC? Is there a particular website you go to?

I'm hopeful that the SC will go with the individual right and not get all squeamish and pass it back down to a lower court or something stupid.

There is a live blog when the opinions are coming out. Go to that page tomorrow right before 10 AM Eastern. There will be a little window that will show comments as the cases are issued by the Justices. It's nearly real time.

The individual rights finding is pretty much a given after the oral arguments. The question is will it be just 5-4 or more like 6-3 or even 7-2. Depending upon how narrow the finding is it COULD be 7-2 if it is very narrow. If the finding is unexpectedly broad, then you could expect something closer to 5-4.

The common feeling is that it will be very narrow. Perhaps even too narrow to address the level of scrutiny (how rigid is the right). In DC you have a total ban and that pretty much fails ANY level of scrutiny.

If so, then you need a few more cases to set both the level of scrutiny (though "not infringed" should seem pretty clear) and to set incorporation (does the 2nd apply at the state level as well as federal). Chicago will probably be the site for the incorporation suit since it is almost directly comparable to DC's ban. The scrutiny issues could be decided anywhere there is a magazine capacity ban or AWB or even the machine gun registry, etc. Expect the next lawsuits to be filed immediately after the finding on Heller.

It is also possible, maybe even likely, that the flawed Miller decision will be addresed and put to rest.

CHICAGO AREA GUN OWNERS KEEP FRIDAY JULY 11 OPEN!!

We are going to have a rally in the belly of the beast, downtown Chicago. I know that unlike the recent Daley sponsored gun control rally, you are employed and do not get a day off school and a free bus trip downtown with T-Shirts etc. at taxpayer expense like the CPS students did for that dog and pony PR event. But, all the more reason to make the effort. We have to have numbers similar to the 3000 that showed up for IGOLD this year in Springfield -- an event that the Chicago media totally ignored. They can't ignore this one.

Speaking at the event will be Suzanna Hupp of Texas, who watched her family get murdered in Luby's while she had her handgun legally stored in her car in the parking lot. http://www.youtube.com/watch?v=NbnSrD5O8d4

The time is 11:00 to 1:00. It's best to park in the suburbs and take the Metra in, though parking should be availiable if you drive.

HEHE!!  I never said anything about culpability, just a way to keep your mouth shut until you can have a lawyer with you.  But back to the topic of this thread...  I am looking forward to the Heller decision.  And with the way the current presidential candidates are looking, I am really, really hoping for a full individual right decision....
