Man the ambulance chaser type attorneys would love to get hold of victims of ppl who have posted things similar to what has been said here.

I'm not an attorney because I'm surrounded by them and worked for them most of my life, that said, I've learned enough from them that:

- 'Tis not wise to publicly announce any of these types of intentions in any sphere.

- You, almost everywhere (US) that I've heard of, can NOT set loose your dog with intent to do harm on anyone, anywhere (even on your own property,) at anytime. However, your dog may serve to protect you against an attacker or  intruder. The subtle difference is if the dog acts on it's own. If you chose to command your dog to attack someone you may be liable for damages (med bills, suffering, emotional distress, opportunity cost) and criminally. With that said,  you know a jury will believe you, in most cases, before they believe a perp, but do you really want to be at the mercy of a jury. Furthermore, if you like your dog, you may want to consider the dog's well-being.

- I wouldn't ever use the term "baiting" (because the police are too lazy.) The perps attorney will argue that you intended to harm their client rather and took the law into your own hands, always gets a jury thinking. If you choose a judge instead of a jury, may have them thinking even more than a jury.

- Finally, if you are going to set a trap, you best know the law, you may be at the discretion of numerous jurisdictions depending on where you live. This means consult with an attorney.

Catching them on camera may be your best alternative, unless you feel all the other bases have been covered. If the cops still won't do anything about it at that point (happened to me in an armed robbery, yes cops told me to "get in line",) you could resort to public humiliation, i.e. post pics of them stealing your things/warn other ppl to look out...

GL, don't be a victim of your own trap.

Guess I should probably go to jail for attempted murder by carbon-monoxide poisoning..  Two counts, to be exact..   :lol

You probably live in the city with a bunch uppity deputy dog type cops..  Out here, they play by the book as much as they can..
When they get a little help from us non-criminal law abiding types, sometimes they set the book down for a second, or look the other way....

[quoteprotecting a family is a right that we all know.  baiting somebody to come into your house then shooting him as you proposed is called murder][/quote]
yeah it might be called baiting to a degree, but oops forgot to close my garage door before bedtime, and we had several people over so I parked my vehicles down back.  the perp has a CHOICE of whether to come inside or not, and if he did I would meet him with a very big gun in his face and yes I did feel threatened its 1 am and I was sleeping.  the laws are protecting the criminals not people.

no, dont turn the crap around.  the initial was that a guy was baiting for somebody to come, and then shoot that person.  there is no fear "for my life there".   and the "he had a choice" is just an excuse to commit murder.  plain and simple.

there is no baiting to a degree.  he had intention and motive.  that is murder.  when you choose to twist the laws then you become a criminal too.

okay so what your saying, is............... if I had my garage open at say 1am and was working on my sled project in my basement which I am, and I caught someone in my garage, I shouldn't be worried??  would that be baiting then?? or maybe I am working on my rc plane in the basement, and my garage door just happened to be opened because I am awake??  he has a choice to enter the garage being that I leave my lights on in the garage 24/7 he don't know if anyone is home or awake for that matter.  at 1am theres no way in heck I would go nosing around anyones garage, if I needed something I would knock on the door.  but that's me and not looking to steal something.  points well taken Semp, just that I see no reason at all why I shouldn't feel threatened by someone entering my premises at weeeee hours of daytime, when I have a wife and kid.

no, what i am saying is that you planned to bait somebody so you left out some toys that can be seen thru the open door.  you pick a good hiding spot and when a guy walks in you jump out from where you are hiding and open fire.  that is murder.

it's different  than you forget to close the door so you hear somebody walking in you defend yourself and the intruder is dead.  that is self defense.

so let me refresh your memory of what your were planning to do just to make it clear that you didnt "forget to close the door".

....  So my plan is to park both vehicles down in my field where they cant bee seen and leave my garage door open, put my sled up front and my 3 wheeler out next to the road and sit and see if anyone stops :devil :devil ...

another thing is that you are putting your family in danger with your dumb plan above.  what if the thieves see what you have but decide to come back another day when you arent home but your family is.  what if they actually pull the trigger faster than you?

did you actually think that your plan above is gonna work 100%

I live in the 5th largest city in the US, right smackdab in the the middle of it too.  And whether you like it or not, had your intentional CO poisoning of them resulted in their death then you may have been answering to your state's AG. Your local guys may have looked the other way, but again whether you like it or not, there probably isn't an AG in any state that would have. You guys out in the sticks may have your own versions of justice, and I'm not knocking it, I've lived in a smaller town, but the fact is there are jurisdictions over your municipality/county and you are subject to them.

I don't know what you mean by uppity deputy dog type cops. My county has one of the strictest sheriffs in the nation, but he only runs the jails, investigates crimes with domesticated animals, and oversees the outlying areas of the county. And he does a very good job at it too.

The bottom line is (as I already stated) don't be a victim or your own trap, know the law and your rights.

whats so different about leaving the door open on purpose or forgetting to close it?  yeah I have a new sled, 4wheeler, 3wheeler, lawn tractor, and a boat load of tools, been that way for a few weeks now making room for more toys :devil my garage is attached to my house by a breezeway where we have a smoking room.  Now what your saying is, if I leave my door open and sit in my breeze way all night having butts that would be baiting?  any time the garage door is open(mostly all day in the summer) they would see whats in it anyways and can come back in the day time when I am at work anyways.  an no I didn't think it was going to work 100% I just want to know who the thief is, really had no idea what I would do if I did catch them.  so I looked up Vermont law, and I wasn't going to shoot them, maybe detain them though

§ 2305. Justifiable homicide

If a person kills or wounds another under any of the circumstances enumerated below, he or she shall be guiltless:

(1) In the just and necessary defense of his or her own life or the life of his or her husband, wife, parent, child, brother, sister, master, mistress, servant, guardian or ward; or

(2) In the suppression of a person attempting to commit murder, sexual assault, aggravated sexual assault, burglary or robbery, with force or violence; or

(3) In the case of a civil officer; or a military officer or private soldier when lawfully called out to suppress riot or rebellion, or to prevent or suppress invasion, or to assist in serving legal process, in suppressing opposition against him or her in the just and necessary discharge of his or her duty. (Amended 1983, No. 23, § 2.)

so you used the word baiting,  you even put it in the title.  but now you are saying you aren't.   that isn't covered by justifiable homicide.

You can't bait.  You will loose in court.  Someone broke into my house a few years ago while I was work, and only took my new big screen.  I wanted to install trap doors, land mines and boobie trap.

You are just trolling or bumping this thread for what, you know what the diff is

§ 2305. Justifiable homicide...

You are either playing around with this post now or you have a desire to kill someone? If you do, there are plenty of opportunities around the world to find that. Ask around, when you kill the trailer trash family's 19yr old tweaker son who is trying to break in and steal your atv next week, sooner or later you ain't going to feel like such a big man anymore, you'll realize killed someone's child.

Just punch them in the chops.

I doubt you would get reported by someone who trespassed on your property.

yes it is full of bad ideas :lol  my intent wasn't to get slammed like I have on here, was blowing steam off.  further more I never mentioned I was going to kill anyone, maybe detain them til the cops showed up.  as far as leaving the door open, if I were to put a $100 dollar bill with a roofing nail to my house I would expect it to stay there and if someone stole it I would hope it caught on fire and burned them to death.  there is 3 things I hate, that is a liar, a thief and a rapist(in backwards order) there isn't one that is worth the air they breathe.  NO I DONT WANT TO KILL ANYONE,  as I said that wasn't my intention on this post.
