I dont need to watch it again Cap I write accident reports for a living. First off the biker slows down and doesnt hit the brakes hard. Not that it matters, if you strike a vehicle in front of you in the rear you are the striking vehicle. I guess technically the biker could get a ticket for improper lane change prior but the lane change itself had nothing to do with the accident. If it was only a traffic accident the SUV would get the ticket.

Unless there are extenuating circumstances. Even then I'd still write this SUV driver a ticket for striking the biker initially and let him explain himself in court. Right now he has bigger problems then a traffic ticket.

Just cause your put on an accident report as the striking vehicle, or just cause you get a ticket, doesnt mean your guilty. Only a judge or jury can make that determination.

I used to ride too, with a group. And in all the unending stupid, moronic incidents Ive had to be around like the one being discussed in this thread Ive stood there speechless at how GD stupid and unnecessary they are.
So you're standing on a train track so your friends can play on the track. The train comes along and runs you and your friends over. It's the train's fault? Nothing personal, but I hope you never play any part of investigating any accident or deliberate attack by a pack of thugs that I'm involved in.
What the bike did to the RR was no different that this:

Now imagine that woman has 100 of her friends surround the car with your family inside and they start to enter the vehicle. There was no "accident", there was a terrorist attack.

Thugs and terrorists.
Quote
Christopher Cruz, 28, of Passaic, NJ, faces misdemeanor charges of reckless driving and imprisonment for suddenly slowing his bike in front of the Range Rover, causing the fender-bender blamed for sparking the chase and violence.
Meanwhile, the only biker injured during the rampage threatened he may sue Lien for running him over with the Range Rover when he hit the gas as his SUV was first surrounded.
“He was attempting to diffuse the situation,” lawyer Gloria Allred said of Edwin Mieses, 32, whom she said may be paralyzed from the waist down “for the rest of his life.”
Mieses hasn't had a valid license in his home state of Massachusetts since 1999, and has never applied for a motorcycle license.

Ive seen the video. Obviously you didnt see in my post where I said traffic altercation CAN be started by just one party or that its possible this was MC, as in motorcycling, wilding.

But you still dont know what started it. Jeez am I the only objective one around here?

Look not that news paper articles actually tell what actually happened but now they are reporting   In other words "nobody knows what fracking happened and the Police are still collecting evidence".

Its possible the biker was actually slowing down in order to slow down the others, to organize the ride, and some sort of verbal confrontation happened. You'll notice an obvious verbal exchange at about 0.18 in the video. He might have been trying to warn the driver of the SUV he was slowing down the group and get them all together. The driver of the SUV had plenty of time to slow down as well and NOT hit the MC driver initially. Then, apparently, there was no physical contact before the SUV driver decided to run over a few bikers and take off.

So how pissed would you be if you saw your friends ran over by an SUV on purpose?

My guess is, based on 30 years of doing this stuff, that the visceral reactions among many is do to the fact the actual attackers of the SUV are black. But even there there is a clue. The Bikers are both white and black so we can rule out bike gangs or street gangs cause they dont mix. Besides there were no Harleys and biker or street gangs dont wear fruity colored helmets and with either the entire affair would have ended with gun fire anyways. Its very likely the entire thing started by accident and progressed thru miscalculation and over reaction.

But I dont know. And neither do any of you. Being a black kid on a motorcycle isnt a crime, nor does it automatically make you a criminal. We have a lot of problems with "flash mobs" here, or "wilding", but Ive never ever seen a racially mixed one.

You either have to be trolling or extremely naive.   If you think that the first thing on that driver's mind, while out for a cruise on his WEDDING ANNIVERSARY, was to pick a fight, is nothing short of asinine.   The comedy of it all are the bikers instigating, then playing the defense card.   Sorry, you lost that privilege when you instigated.  Ironic that the cripple didn't have a license.

This is why I have lost faith in this Society and even more so in insurance companies.  Make something up and try to get the most while the getting is good.   Race has absolutely nothing to do with this, so I have no clue why you keep playing that card in post after post.  The cripple got what he deserved, though it is a shame he is still breathing oxygen.    Kudos to the driver of the RR.

Have you lost your mind? Where did I say the SUV driver was "out to pick a fight"?

And what in hell does this analogy have in common with a rear end motor vehicle traffic accident?

You typed this post full assumptions.   You are clearly the one losing your mind.   My analogy is spot on, but it flew over your head.

You typed this post full assumptions.   You are clearly the one losing your mind.   My analogy is spot on, but it flew over your head.

I'll try and explain this to with the hope that you can understand this is Traffic Law that BTW I didnt write. A train striking pedestrians on the track has nothing to do with a motor vehicle accident between two or more motor vehicles. It doesnt matter if vehicle 2 stops for a deer, a raccoon, for other traffic, or cause a naked woman is in the window of the house nearby. Its the responsibility of the vehicle in back of him to stop, which makes that vehicle the "striking vehicle".

I have nothing to do with it. Its the GD traffic Law and its the same everywhere in the country. Had this gone no further then the initial accident then Veh #1 "SUV" would be the striking vehicle. Big deal, he might get a ticket and the insurance companies can fight it out.

A train is NOT a motor vehicle because it cannot operate on a road or highway and instead only does so on a fixed track. Thats why your analogy is insane, because it doesnt include any "motor vehicles". Now if you hit the pedestrian on the roadway in your car you'd be the striking vehicle because you were operating a motor vehicle and its your responsibility to avoid a pedestrian. Which means your the striking vehicle, ticket...et al.

I know my post is full of "assumption". I said it was in the post. For the 5'th time nobody here knows what really happened out there during this incident.

Joe your a goof. Stop reading. For the rest of you, the ones with brains. I hope you understand that if you get caught up in something like this you'll be surrounded by a world of legaleeze that your going to have to navigate and understand. And if you get in front of a jury you'd better believe race is going to be a factor.

Hey, I tried. But you cant make the horse drink.

Wrong. The motorcycle purposely struck the RR with his wheel. What part of "attack" don't you understand?

Why did the bike come to a complete stop in front of Lein's vehicle?   You know damn well why.
Why did his punk buddies lay their bikes down in front of Lein's vehicle?   You know damn well why.

I know traffic laws but you seem to be posting with an angle of being the devil's advocate.

The cripple/everyone else on bikes committed multiple traffic violations each and one of the morons was dumb enough to not only film it, but post it.   The cripple was unlicensed.   But please, keep trying to tap dance on a landmine.

I dont automatically assume anybody is guilty of anything. Thats not my job.

People were ran over and gravely injured. Another citizen was taken out of an auto and beaten. Who gives a damn about traffic violations? I was only trying to explain to you how the traffic accident system works. How many times do I have to say the last thing they are worried about is traffic tickets right now.

Look, I cant keep trying to explain this. Especially now that the trolls have shown up. And I cant keep posting the same thing again and again only to be misquoted. So, so long to this thread.

Because "those 50+ idiots" needed to "group up in front of the RR", instead of being civil and legal riders.   Instead the criminal with a rap sheet longer than a roll of Charmin finds out what Karma is.    Come on rpm, you should have known that already.   SUV out for a cruise on his Anniversary instigated the entire thing.

Rich, this discussion has opened up some doors.   Behind these doors are some of the most confusing instances of typing syntax that some of us have ever had the displeasure of reading.

My last post is backed by the film recorded.   Enjoy your peg leg devil's advocacy.

Sorry.   You keep tap dancing and I am the one not trolling.   The idiots that were run over, wouldn't have been run over if they obeyed simple traffic laws.  The cripple would be walking if he hadn't hopped on his uninsured/unregistered bike Sunday.  100's of lane changes, knifing tires (brandishing weapons) and committing assault and battery on another motorist.   The traffic violations are presented forth to show the stupidity of any defense of the bikers, which you continue to stick up for.

It is a shame more of those punks didn't get the karma that they most certainly deserve.   The irony is one of the morons has given the Criminal Justice system enough license plate shots and photos of reckless driving.   In addition, the "legally registered" riders will lose their licenses over this, because of accrued points.   No "assumptions" needed.
