"SMART may use personal information MEMBER provides to SMART to enhance SMART'S ability to share information with MEMBER likely to be of interest to MEMBER while MEMBER is using freeXDSL(tm) SERVICE" ... means you will be spammed to death.

"MEMBER is also solely responsible for all charges associated with maintaining and using a phone line to connect to freeXDSLTM"...means you are responsible for getting the actual subsciber loop so that you can be connected at the CO to freeXDSL service. They don't provide the actual copper access to you from the phone company. It's like getting a phone line and THEN choosing a long distance carrier.

"AUTHORITY TO PROVIDE LOCAL OR LONG DISTANCE PHONE SERVICE, "CABLE" TV SERVICE..." This is a biggy. This means that should (and they probably do) they come to offer local calling, long distance tele service or cable programming in your area your agreement with these folks for freeXDSL allows them to automatically switch you to thier service. Believe me. In most areas you will be switched the moment you sign up for "free XDSL" and I'm sure thier rates for these other services will more than make up for thier costs in providing you the <cough> freeXDSL "service".

And the whopper (as noted above by kjb).."MEMBER agrees to pay to SMART as liquidated damages Five Hundred Dollars ($500.00) to offset SMART'S expense of allocating service, bandwidth, hardware, or human resources to process the order, arrange for service, or to provide freeXDSLTM service to MEMBER..."

** Note under the MODIFICATION section that by default you also agree to any changes they may make to any agreement or contract they have. At any time. Whether they email you or not. It is up to the subscriber to keep thier eyes peeled for change notifications on thier website, and I'm sure a nasty one would be in VERY small print or have an ambiguous link off another page.

My advice is to avoid this offer like the plague....
