The only reason that Jane Fonda wasn't prosecuted for treason (guess the same goes for Kerry) is that the US was not technically at war with North Vietnam. At least that's the way I've always understood it.


Just did a bit of research. From what I read a declaration of war isn't necessary, hostilities will do. However, apparently there must be an intent to betray the United States. In Fonda's case probably provable, doubt that would be so with Kerry.
