No, we had very few serious altercations. Too many bouncers, most of them big and mean and we usually saw it coming and got things calmed down before they got out of hand. If it was just testosterone and they weren't drunk, we could usually restore things without anything more than talking. If they were drunk, then we would escort them out. I remember one guy who reached around the doorman to punch another guy. He was subdued, restrained and handed to police. We kept several rolls of duct tape which were used to restrain guys who wouldn't otherwise be trusted to sit quietly. We would duct tape his hands and ankles and hand him over like that, much to the cops' amusement. That happened only two or three time over four years.

Our regulars were all well behaved. It was usually someone who rarely, if ever visited.

I was an amateur boxer, weighed right around 145 lbs when not training for competition. At 5'11", I was tall and lanky. Not intimidating at all in appearance. That was the bouncers' job. I was shoved a few times, but didn't have to or need to retaliate. The trouble maker was going to lose no matter what he did.

I would merely step back and let the guys being paid to keep order do their job.

By the way, my brother was usually bartending. My father was the owner/manager and our lookout, having been in the business for 30 years, he knew what to look for. Not long after, I went off to the Navy. I never returned to the business. My father and brother eventually got out of the business. Today, my brother is Vice President of sales for the Sleepy's Mattress chain.

Interesting the cops are telling you not to press charges for what would be a class 4 felony agg assault and that they'd rather go after him for a class 4 felony meth possession which here in Arizona would fall under Prop 200 and not even land him in jail.

FYI,

I am pressing charges.  Spoke to the det again yesterday, and expressed my concerns, and then spoke to my fiancee this morning about it.  Frankly, we, my fiancee and I both feel the same way, and are not going to be intimidated by a POS racist.

Oh, and for those with the comments on the hate crime, I brought that up, and apparently there was another independant witness that said the same thing my friend and I said in regards to his racial comment.  What I did not know, was that while I was laying on my arse knocked out, the guy that hit me was yelling how do you like that ya white *****.... thats black power for you... so there is ample evidence of his racism besides the one comment I heard.

Anyways, as a few of you have said, this is already fast becoming a non issue to me.  I think that he is a POS and that I need to do what I can to ensure that he gets his just reward for acting like an idiot punk.

Will keep you informed about how it goes.

In Michigan you could get him on Criminal Sexual Conduct for that.  Either 2nd or 4th degree... possibly another felony there, at least a misdemeanor.  The detective say anything about the sex crime aspect of it?

Bohdi here is what you must do now.

Write down everything that was said and the sequence of events exactly as they happened.

Go over it with your friend who was there. Leave out nothing. Write down what they were wearing if you remember and what you were wearing, where they were standing, what hand the guy hit you with, what the other guy was doing.

Discuss it with the other witness. Make sure you have it all clear and writtten down.

Right now it is fresh in your memory. But in 6 months it is amazing what you will forget. You can be sure the other guy will fight the charge in court and you will have to be a witness. When you get on the stand give you version of the events and do not stray from it. If they ask you if the guy had glasses on or gloves or a hat or whatever tell them if you remember but if not say "after he knocked me out I was a bit fuzzy and do not recall that" or I don't remember that detail.

Trust me if you want to nail his bellybutton do this and court will be a breeze. If not you will be amazed at how your version of the events can be so different from your friends if they cross examine you sperately.

my friend is going to be deployed to Iraq in 2 months, so his testimony will be all written.  They (the police) are already arranging that as soon as they find out who the schmcuks attorney replies on monday.

You will have no problem getting him convicted of criminal assualt.

Be sure to write down things that showed how he was beligerant and pugnacious and lucid and coherent, but not drunk and incoherent. He will probably claim you provoked the attack by making a sudden movement or threatening action so be sure to remember what you were wearing and show how it was impossible to conceal a weapon for example.

Make sure you get across how you were blindsided and did not even raise your arm to block the punch. They will probably make you demonstrate how he hit you in court. Work out all the moves in advance so they can't trip you up with the "he is left handed but you claim he hit you with his right or visa versa."

Show how your friend was not nearby enough to make it look like both of you were ganging up on him. You need to show that you were not threatening to attack him by your actions or words or posture.

He only defense is that you were going to hit him and he hit you first as self defense. Make sure you stay calm and cool in court, the other lawyer will try to make you lose your temper to show you are a hot head. It is all just a show, be sure to play the part you have to to convince the judge you are right.

Appreciate the advice.  I have testified as an expert witness on other ends so am aware of attorneys scare tactics.  As for the way he hit me, I never saw it.  I had been turned away by his friend as best as I can remember and he hit me in the side of the face.

The next thing I knew, I woke up on the ground...
