In fact I beleive is should be the parents or closest next of kin that determines the penalty and not a jury in such cases.

Now they're saying her life was in danger- what a crock of PR crap. From the time she started recording phone calls until Scott Peterson's arrest she was under police survellience and, in fact, Scott Peterson was never within twenty miles of her.

This whole thing has been ugly, all the way PAST  the penalty phase of the trial to the book deals and Oprah appearance.

I think when you allow emotion filled pleas one way or the other it detracts from the actual task assigned a jury- to determine the proper sentance for the crime convicted of. If you agree that the "feelings" of the family should be the paramount consideration of a jury in sentacing then what happens if the victim's family has forgiven the perp? Does that mean he should get less punishment for the same crime?

It's this type of thinking that results in African Americans getting sentanced to longer prison terms for the exact same crimes white people get away with, or serve a minimal sentance. I'm against victim impact statements to the Jury because it impacts equal justice.
